HomeMy WebLinkAboutOrdinance 19991-12-2011Ordinance No. 19991-12-2011 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE PUBLIC ART CONSERVATION SECTION OF THE SPECIALLY FUNDED CAPITAL PROJECTS FUND IN THE AMOUNT OF $2,000.00, FROM AVAILABLE FUNDS, UPON RECEIPT OF A DONATION FROM DOWNTOWN FORT WORTH INITIATIVES, INC., FOR THE PURPOSE OF ASSISTING WITH COSTS ASSOCIATED WITH THE DEINSTALLATION AND TRANSPORTATION OF ARTWORK LOCATED AT GENERAL WORTH SQUARE; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That, in addition to those amounts allocated to the various City departments for Fiscal Year 2011 -2012 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Public Art Conservation Section of the Specially Funded Capital Projects Fund in the amount of $2,000.00, from available funds, upon receipt of a donation from Downtown Fort Worth Initiatives, Inc., for the purpose of assisting with cost associated with the deinstallation and transportation of artwork located at General Worth Square. That, should any portion, section, or part of a section of this ordinance be declared invalid, inoperative, or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 19911 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect upon adoption. Authorize acceptance of a monetary donation in the amount of $2,000.00 from Downtown Fort Worth Initiatives, Inc., to assist with costs associated in the deinstallation and transportation of an artwork entitled Hats by Cameron Schoepp, which is currently located at General Worth Square in downtown Fort Worth; 2. Adopt the attached supplemental appropriation ordinance increasing estimated receipts and appropriations in the Public Art Conservation section of the Specially Funded Capital Projects Fund in the amount of $2,000.00 from available funds upon receipt of a donation from Downtown Fort Worth Initiatives, Inc.; 3. Authorize an addendum with Unified Fine Art Services, L.L.C., City Secretary Contract No. 40164, in an amount not to exceed $20,000.00 for deinstallation of artwork and transportation to storage; and 4. Authorize a Sole- Source Artwork Acquisition and Installation Agreement with Cameron Schoepp in the amount of $77,774.00 for acquisition, temporary storage, engineering, site preparation and installation of the artwork at the Fort Worth Community Art Center located at 1300 Gendy Street. DISCUSSION: Hats (the Artwork) is a whimsical public artwork composed of five limestone sculptures created at the 1999 Sculpture Symposium held at the Botanic Gardens by Fort Worth based artist Cameron Schoepp. The Artwork has been on long -term loan to the City of Fort Worth since that time and was permanently installed in General Worth Square. Construction of the JFK Tribute and other improvements at General Worth Square are scheduled to begin very soon. As a result, the Artwork must be removed from the site. Recognizing that the Artwork has become a beloved part of the urban environment of Fort Worth and has been on loan for over a decade, the Fort Worth Art Commission made a formal recommendation on October 10, 2011 to acquire the Artwork by Cameron Schoepp for the Fort Worth Public Art Collection and relocate it to the Fort Worth Community Art Center. Cultural District stakeholders have indicated support of this effort. Logname: 20HATS ARTWORK ACQUISITION Page 1 of 2 The Long Range Public Art Plan for the 2004 Bond Program included funding for the realignment of Harley and the project scope includes, among other goals, Landscape Gendy Street Phase II. The city - owned Fort Worth Community Art Center is located at 1300 Gendy Street and offers a suitable site for the Artwork that will be compatible with the architecture of the building, which is clad in limestone. Sited along the sidewalk, the Artwork will be accessible to pedestrians and visible to vehicles driving on Gendy Street. Approval of this Mayor and Council Communication will make it possible for the Artwork to be removed from General Worth Square in a timely manner using Unified Fine Art Services, L.L.C., currently under retainer by the City of Fort Worth for such projects. Funding for the addendum will be derived from the Specially Funded Capital Projects Fund (Conservation). Artist Cameron Schoepp will present a proposal for the exact placement of the Artwork along.the sidewalk on Gendy Street to the Fort Worth Art Commission for approval and will work with a professional engineer to design new footings for the City's approval. Installation at the new site will be scheduled for Spring 2012.
