HomeMy WebLinkAboutOrdinance 19992-12-2011Ordinance No. 19992 -12 -2011 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE CULTURE AND TOURISM FUND IN THE AMOUNT OF $179,762.25, AND DECREASING THE UNAUDITED, UNASSIGNED CULTURE AND TOURISM FUND BALANCE BY THE SAME AMOUNT, FOR THE PURPOSE OF FUNDING THE FORT WORTH CONVENTION CENTER PUMP GALLERY REVISIONS AND TEST PORTS; PROVIDING FOR A SEVERABILTTY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2011 -2012 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Culture and Tourism Fund in the amount of $179,762.25, and decreasing the unaudited, unassigned Culture and Tourism Fund balance by the same amount, for the purpose of funding the Fort Worth Convention Center pump gallery system and installation of test ports. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 19911 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect upon adoption. Adopt the attached supplemental appropriation ordinance increasing appropriations in the Culture and Tourism Fund by $179,762.25 and decreasing the unaudited, unassigned Culture and Tourism fund balance by the same amount; and 2. Authorize the execution of a contract with Johnson Controls, Inc., in the amount of $156,315.00 Plus $23,447.25 in contingency using a Texas Multiple Award Schedule Contract Number TXMAS -6- 840160 to make revisions to the Fort Worth Convention Center pump gallery system and install test ports. DISCUSSION: Revisions are necessary to the Fort Worth Convention Center HVAC system to retrofit the pump gallery system and add test ports. The revisions are necessary to maximize the new chillers and change the HVAC water flow due to the removal of the DX chillers from the system. This work will also enable staff to more efficiently monitor the hot water and chill water system in order to respond to client feedback regarding meeting room temperatures. On March 23, 2010, (M &C G- 16866) the City Council amended the Financial Management Policy Statements that authorized the Culture and Tourism fund balance in excess of the 20 percent reserve to be used exclusively for improvements and maintenance to the Public Events venues. The Culture and Tourism fund balance is sufficient to allow this appropriation and adhere to this policy statement. PRICE ANALYSIS — The vendor prices were obtained using a Texas Multiple Award Schedule ( TXMAS) Cooperative Contract Number TXMAS -6- 840160. The overall project cost is expected to be: Construction Contingency, Staff Total $156,315.00 $ 23,447.25 $179,762.25 M /WBE - A waiver for the goal for M /WBE subcontracting requirements was requested by the Public Events Department and approved by the M /WBE Office because the purchase of goods and services is Logname: 25JCI_FWCC_PUMP GALLERY Page I of 2 from sources where subcontracting or supplier opportunities are negligible. COOPERATIVE PURCHASE — State law provides that a local government purchasing an item under a Cooperative Purchasing Agreement satisfies State laws requiring that the local government seek competitive bids for purchase of the item. TXMAS was established by the State of Texas to provide a list of approved contracts that have been competitively bid and awarded by Federal, State or Local Government entities to increase and simplify the purchasing power of governmental entities across the State of Texas. The project is physically located in COUNCIL DISTRICT 9 but will serve Fort Worth residents in ALL COUNCIL DISTRICTS. FISCAL INFORMATION / CERTIFICATION: The Financial Management Services Director certifies that upon approval of the above recommendation and adoption of the attached supplemental appropriation ordinance, funds will be available in the current operating budget, as appropriated, of the Culture and Tourism Fund. Upon approval, the unaudited, unassigned fund balance of the Culture and Tourism Fund will exceed the minimum reserve as outlined in the Financial Management Policy Statements.
