COUNTY OF TARRANT S
WHEREAS, the City of Fort Worth (City) and TCB, Inc. , (Engineer)
made and entered into City Secretary Contract No. 35274, (the Contract)
which was authorized by the City Council by M&C C-22038 on the 3rd day of
April 2007; and
WHEREAS, the Contract involves engineering services for the
following project:
Milam-Robinhood Drainage, Far East Fart Worth Drainage, and Wilbarger-
Hughes Storm Drain Extension, Project No. 00182.
WHEREAS, it has become necessary to execute Amendment No. 2 to said
Contract to reflect the merger and subsequent name change of TCB, Inc.
to AECOM USA, Inc. , and to include an increased scope of work and
revised maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through
their duly authorized representatives, enter into the following
agreement which amends the Contract:
1.
Change the Engineer name from TCB, Inc. to AECOM USA, Inc.
2.
Article I, of the Contract is amended to include the additional
engineering services specified in a proposal letter dated November 3,
2008, copies of which are both attached hereto and incorporated herein.
The cost to City for the additional services to be performed by Engineer
total $58,253.00.
3.
Article II, of the Contract is amended to provide for an increase
in the maximum fee to be paid to Engineer for all work and services
performed under the Contract, as amended, so that the total fee paid by

the City for all work and services shall not exceed the sum of
$216,513.00-
4.
All other provisions of the Contract which are not expressly
amended herein shall remain in full force and effect.

RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute Amendment No.2 to City
Secretary Contract No. 35274 to change the Engineering Firm TCB,Inc.,to AECOM USA,Inc.,and
increase the total by$68,253.00, thereby revising the total contract amount to$216,513.00.
The Storm Water Management Program was established to reduce flooding in Fort Worth,preserve streams,
minimize water pollution and to operate the storm water system in a more effective manner to fully comply
with state and federal regulatory requirements.This will be accomplished by infrastructure reconstruction
and system maintenance,master planning,enhanced development review and increased public education and
outreach.
The scope of the original agreement included the design of storm drainage facilities near the intersections of
Milam and Robinhood,Meadowbrook and Ederville, and Wilbarger and Hughes. Amendment No. 2 provides
additional design services to incorporate roadside ditches and a closed storm drain system for the
Meadowbrook and Ederville drainage area.
A request for qualifications to provide drainage design was issued by the City in January of 2006 and 24
design consultants submitted statements of qualifications,including TCB,Inc.
TCB,Inc., was selected to provide design services for drainage improvements.
On October 16,2007,(Ordinance No. 17840-10-2007)City Council authorized the issuance and sale of
$25,000,000 in Storm Water(Drainage)Revenue Bonds, Series 2007,to fund a two year Storm Water
Capital project program.
On April 3,2007,(M&C C-22038)City Council approved an engineering agreement with TCB, Inc„for the
design of Milam—Robinhood Drainage,Far East Fort Worth Drainage, and Wilbarger—Hughes Storm Drain
Extension for a lump sum fee of$128,780.00.
On May 8,2008,Amendment No. i was executed administratively for a lump sum fee of$19,470.00.
Amendment No. 1 included services to perform subsurface utility engineering(SUE)for Quality Level "A".
Effective January 3,2009,TCB,Inc. was merged with AECOM USA,Inc., (AECOM)and has been reflected
as such in the City's database as of March 2009.
AECOM proposes to perform the design services under Amendment No.2 for a lump sum fee of$68,263.00.
City staff considers the fee to be fair and reasonable for the scope of services proposed.
AECOM is in compliance with the City's MIWBE Ordinance by committing to an additional 14 percent
MIWBE participation for this Amendment No.2.
This project is located in COUNCIL DISTRICT 5,Mapsco 80F.
FISCAL INFORMATION:
The Financial Management Services Director certifies that funds are available in the current capital budget,
as appropriated,of the Storm Water Capital Projects 2007 Revenue Bond Fund.

Dear Mr. Argomaniz:
Attached for your review is TCB's request for Amendment No.2, including additional information
requested by Dena Johnson on Monday,November 3,2008.The amendment reflects the design
fee associated with the proposed schematic presented during the July 29,2008,project review
meeting for the Far Bast FW Meadowbrook and Edervllle drainage improvements area.The
proposed schematic delineates roadside ditches and a closed storm drain system discharging to
Findlay Park Lake in the City of Arlington. In addition to this area, Steve Eubanks requested tree
speciation be provided for the Milam-Robinhood project area.
Additional survey will be performed by our subconsultant,Gorrondona&Associates, Inc. Forestry
services will be performed by Urban Forestry Consultant, Larry Schaapveld,a non MIWBE firm.A
breakdown of fees and Opinion of Probable Construction cost is attached.

Additional Services Task Justification Information:
Design Surveys: Per Truett Wilson,the linear foot cost for topographic survey performed by
Gorrondona and Associates,Inc.is$3.25 per linear foot.
Milam Street Tree Survey,Steve Eubanks requested using an arborlst to provide speciation
for trees in parkways along the Milam Street project route during the last review meeting.
Melinda Adams,COFW Arborist recommended utilizing the services of Larry Schaapveld for this
task.
Neighborhood Drainage and Exhibits Preparation Presentation:The task fee has been reduced
to$2,060.00.
Utility Coordination:The fee has been reduced to$554,00.Although the city distributes plans to
the franchise utilities, the consultant PM invariably handles coordination issues required. Fiber optic
lines In addition to the usual utilities found in residential streets are prevalent in the project design
locations.
City of Arlington Coordination:The coordination fee has been reduced to$1,216.00.
The basis for the fee estimated accounts for three hours of Tony's time and 4 hours of my
time over the duration of project.Design review, revisions,drive time,coordinating inter-city
agreements with both cities,verbal and etectronle mail communication time required were elements
factored in the task fee.
