HomeMy WebLinkAboutOrdinance 20000-12-2011Ordinance No.20000 -12 -2011 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE COMMUNITY TREE PLANTING PROGRAM FUND IN THE AMOUNT OF $439,116.24, FROM AVAILABLE FUNDS, FOR THE PURPOSE OF FUNDING THE COMMUNITY TREE PLANTING PROGRAM; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2011- 2012 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Community Tree Planting Program Fund in the amount of $439,116.24, from available funds, for the purpose of funding the Community Tree Planting Program. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No.19911 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the use of $237,958.74 of tree removal fee revenue, $100,000.00 from Chesapeake Energy Corporation, and a $1,157.50 donation from Urban Renewal to fund the Community Tree Planting Program; 2. Authorize the use of $100,000.00 of Parks Royalty Revenue to fund the Community Tree Planting Program; 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Park Gas Lease Project Fund in the amount of $100,000.00 from available funds; 4. Authorize the transfer of $100,000.00 from the Park Gas Lease Project Fund to the Community Tree Planting Program fund; and 5. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Community Tree Planting Program fund in the amount of $439,116.24 from available funds. DISCUSSION: The purpose of this Mayor and Council Communication (M &C) is to authorize the use of funds from various revenue sources to fund the Parks and Community Services Department's Community Tree Planting Program (the Program). During the deliberations for the Fiscal Year 2009 operating budget, the City Manager was authorized to use three funding sources in order to continue the Program, which was slated for elimination. These sources include Tree Removal Fee Revenue, Parks Royalty Revenue, and donations from Chesapeake Energy Corporation and Urban Renewal. On September 16, 2008, (M &C G- 16276) City Council authorized the City Manager to accept a monetary donation in the amount of $100,000.00 per year for five -years for a total of $500,000.00 from Chesapeake Energy Corporation. This will be the fourth payment from Chesapeake Energy Corporation. The Program provides approximately 1,600 trees annually for neighborhood associations and organizations for community tree planting projects on public property. Additionally, the Foresters included in this Program manage the Citizen Forester Program and other volunteer programs which train volunteers for tree planting, data collection and ongoing care and maintenance of the City's tree farm. The Fiscal Year 2012 budget also appropriates funds in the amount of $36,346.24 to address overages in the Fiscal Year 2011 Budget resulting from increased personnel, equipment repair and maintenance costs. The Community Tree Planting Program benefits ALL COUNCIL DISTRICTS. FISCAL INFORMATION / CERTIFICATION: The Financial Management Services Director certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinances, funds will be available in the current operating budget, as appropriated, of the Community Tree Planting Fund.
