AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE
GENERAL CAPITAL PROJECTS FUND, FROM AVAILABLE FUNDS IN THE AMOUNT OF
$24,733.59, FOR THE PURPOSE OF IMPROVEMENTS TO MOSIER VALLEY PARK;
PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE
OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH;
AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2018-2019 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the
General Capital Projects Fund in the amount of $24,733.59, from available funds, to provide improvements
to Mosier Valley Park.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair
the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 23392-09-2018 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Valley Park and Adopt Appropriation Ordinance (COUNCIL DISTRICT 5)
RECOMMENDATION:
It is recommended that the City Council:
1. Accept funding in the amount of $24,733.59 from Dunaway Associates, LP, for improvements to Mosier
Valley Park; and
2. Adopt appropriation ordinance increasing estimated receipts and appropriations in the General Capital
Projects Fund in the amount of $24,733.59 for these improvements.
DISCUSSION:
The purpose of this Mayor and Council Communication (M&C) is to accept funding in the amount of
$24,733.59 from Dunaway Associates, LP, for improvements to Mosier Valley Park.
On January 24, 2017, City Council authorized the execution of a construction contract with Denco
Construction Services Corp. (M&C C-28086) for Mosier Valley Park improvements.
On May 30, 2018, the City of Fort Worth (City), Dunaway Associates, LP, (Consultant) and Denco
Construction Services Corp. (Contractor) met to discuss the cause of cracking on the new concrete slab
which was installed by the Contractor at Mosier Valley Park. The possible causes included: construction
methods (lack of vibration during installation, stripping concrete forms within 24 hours of installation); and
design issues including the fact that the layout plan did not include control joints or expansion joints, and
there was no designed separation between the existing slab and new slab such as sand or another type of
barrier.
While there was no resolution as to the absolute cause of the cracking, the City, the Consultant and the
Contractor agreed to share the cost of repair or replacement. The three parties explored several options to
address the cracking including: filling the cracks and sealing the surface, sandblast treatment of the
surface, and removal and replacement of the new slab. Ultimately, it was determined that the best course
of action is to remove and replace the slab.
On July 13, 2018, the Contractor provided a quote of $74,200.79 to remove and replace the new concrete
slab (6,600 SF). Additionally, the aforementioned price includes a barrier separation from the existing
concrete, and expansion and control jointing. This cost divided equally between the City, the Consultant
and the Contractor amounts to $24,733.59 each. While this M&C appropriates the contribution from the
Consultant, the Contractor's contribution will be reflected in a Change Order.

On August 17, 2018, after all parties reviewed the proposal it was agreed upon to proceed with the
proposal and complete the project with all parties sharing one-third of the quote.
Mosier Valley Park is located in COUNCIL DISTRICT 5.
This M&C does not request approval of a contract with a business entity.
FISCAL INFORMATION / CERTIFICATION:
The Director of Finance certifies that the Park & Recreation Department will have the responsibility for
collection of these funds. Upon approval of the above recommendations, funds will exist in the General
Capital Projects Fund as outlined above. Prior to an expenditure being incurred, the Park & Recreation
Department has the responsibility to validate the availability of funds.
