HomeMy WebLinkAboutOrdinance 20009-12-2011Ordinance No. 20009 -12 -2011 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE CULTURE AND TOURISM FUND IN THE AMOUNT OF $40,000.00, UPON RECEIPT OF A DONATION FROM TRINITY F &B SERVICES, INC., FOR THE PURPOSE OF IMPROVEMENTS TO THE CONCESSIONS AREA AT THE FORT WORTH CONVENTION CENTER; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That, in addition to those amounts allocated to the various City departments for Fiscal Year 2011 -2012 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Culture and Tourism Fund in the amount of $40,000.00, upon receipt of a donation from Trinity F &B Services, Inc., for the purpose of improvements to the concessions area at the Fort Worth Convention Center. SECTION 2. That, should any portion, section, or part of a section of this ordinance be declared invalid, inoperative, or void for any reason by a court of competent jurisdiction, such decision, opinion, or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 19911 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4 This ordinance shall take effect upon adoption. Authorize the acceptance of a monetary donation in the amount of $40,000.00 from Trinity F &B Services, Inc., for improvements to the concessions area at the Fort Worth Convention Center; and 2. Adopt the attached supplemental appropriation ordinance increasing estimated receipts and appropriations in the Culture and Tourism Fund by $40,000.00, subject to receipt of the donation from Trinity F &B Services, Inc. DISCUSSION: On April 27, 2005, the City of Fort Worth (the City) and Omni Hotels Management Corporation (Omni) executed a Contract for Exclusive Food, Beverage and Alcoholic Beverage Services (Contract) at the Fort Worth Convention Center (CSC No. 31742), which, pursuant to a subsequent Amendment (CSC No. 37798, approved by M &C C- 22985), became effective on December 1, 2008 and expires on November 30, 2018. Trinity F &B Services, Inc., is a wholly owned subsidiary of Omni that was formed to assist Omni in complying with the Contract. Since the execution of the Contract, the City has invested over $650,000.00 to upgrade the kitchen HVAC and hood system, purchase equipment and buffet stations to enhance the dining experience for guests. A design is in progress for improvements to the concession stand in Exhibit Hall A. It is anticipated that the cost of the improvements will be between $80,000.00 and $100,000.00. Trinity F &B Services, Inc., wishes to donate $40,000.00 toward the costs of the concession improvements of Exhibit Hall A. The management of the Public Events department endorses this contribution. The Convention Center is located in COUNCIL DISTRICT 9 and serves ALL COUNCIL DISTRICTS. FISCAL INFORMATION / CERTIFICATION: The Financial Management Services Director certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance, funds will be available in the current operating budget, as appropriated, of the Culture and Tourism Fund. The Public Events Department is responsible for the collection and deposit of funds due the City.
