HomeMy WebLinkAboutOrdinance 23474-11-2018CITY OF HASLET ORDINANCE NO. 022-2018 CITY OF FORT WORTH ORDINANCE NO. ,:, 3 ~° 4 -11 _.2e_ S3 JOINT ORDINANCE AND BOUNDARY AGREEMENT WHEREAS, the City of Haslet (hereinafter called "HASLET") is a type A general law municipality located in Tarrant and Denton Counties, Texas; and WHEREAS, the City of Fort Worth (hereinafter called "FORT WORTH") is a home rule city located in Tarrant, Wise, Parker, Johnson and Denton Counties; and WHEREAS, HASLET and FORT WORTH share a common boundary; and WHEREAS, HASLET and FORT WORTH most recently approved a Joint Ordinance and Boundary Agreement in April 1987 to adjust the corporate boundaries and extraterritorial jurisdiction of the cities, and to facilitate annexation and development of the North Fort Worth Airport site; and WHEREAS, HASLET and FORT WORTH now desire to adjust the boundary between the two cities to promote orderly development to insure public safety and effective delivery of municipal services; and WHEREAS, Section 43.015 of the Texas Local Government Code authorizes adjacent municipalities to make mutually agreeable changes to their boundaries that are less than 1,000 feet in width; and WHEREAS, Subchapter G of Chapter 43 of the Texas Local Government Code allows a home rule City to disannex areas in accordance with its City Charter, and allows a general law municipality to disannex sparsely populated areas by ordinance; and Section 42.023 of the Texas Local Government Code allows municipalities to release extraterritorial jurisdiction by ordinance; and WHEREAS, HASLET and FORT WORTH want to make other commitments as part of this Agreement to promote the efficient delivery of services; and WHEREAS, HASLET and FORT WORTH agree that this boundary adjustment will clarify maintenance responsibility, traffic management and related municipal services for these roadways; and NOW, THEREFORE, BE IT ORDAINED AND MUTUALLY AGREED BY THE CITY COUNCIL OF THE CITY OF HASLET AND THE CITY COUNCIL OF THE CITY OF FORT WORTH: SECTION 1 (5.700 acre portion of Blue Mound Road Right -of -Way) Pursuant to Section 43.031 of the Texas Local Government Code, HASLET and FORT WORTH hereby agree that the boundary between the cities will be adjusted as set out herein so that the 5.700-acre tract located in HASLET, as described and shown in Exhibit "A", and with a width of less than 1,000 feet, will be located in the extraterritorial jurisdiction of FORT WORTH. In accordance with this Joint Ordinance and Boundary Agreement, HASLET hereby relinquishes the 5.700 acres described in Exhibit A to FORT WORTH and disannexes and discontinues such property as part of HASLET. In accordance with the terms of this Joint Ordinance and Boundary Agreement, FORT WORTH accepts 5.700 acres into its extraterritorial jurisdiction as reflected in Exhibit A attached and incorporated herein. SECTION 2 (3.482 acre portion of Blue Mound Road Right -of -Way) Pursuant to Section 43.031 of the Texas Local Government Code, HASLET and FORT WORTH hereby agree that the boundary between the cities will be adjusted as set out herein so that the 3.482-acre tract located in HASLET, as described and shown in Exhibit "B", and with a width of less than 1,000 feet, will be located in the city limits of FORT WORTH. In accordance with this Joint Ordinance and Boundary Agreement, HASLET hereby relinquishes the 3.482-acres described in Exhibit B to FORT WORTH and disannexes and discontinues such property as part of HASLET. In accordance with the terms of this Joint Ordinance and Boundary Agreement, FORT WORTH accepts and annexes 3.482 acres into its corporate limits as reflected in Exhibit B attached and incorporated herein. SECTION 3 (3.901 acre portion of Blue Mound Road Right -of -Way) Pursuant to Section 43.031 of the Texas Local Government Code, HASLET and FORT WORTH hereby agree that the boundary between the cities will be adjusted as set out herein so that the 3.901-acre tract located in Tarrant County, as described and shown in Exhibit "C", and with a width of less than 1,000 feet, will be located in FORT WORTH extraterritorial jurisdiction. In accordance with the terms of this Joint Ordinance and Boundary Agreement, FORT WORTH accepts 3.901 acres into its extraterritorial jurisdiction as reflected in Exhibit C attached and incorporated herein. SECTION 4 (6.372 acre portion of Bonds Ranch Road Right -of -Way) Pursuant to Section 43.031 of the Texas Local Government Code, HASLET and FORT WORTH hereby agree that the boundary between the cities will be adjusted as set out herein so that the 6.372-acre tract located in HASLET, as described and shown in Exhibit "D", and with a width of less than 1,000 feet, will be located in the city limits of FORT WORTH. In accordance with this Joint Ordinance and Boundary Agreement, HASLET hereby relinquishes the 6.372-acres described in Exhibit D to FORT WORTH and disannexes and discontinues such property as part of HASLET. In accordance with the terms of this Joint Ordinance and Boundary Agreement, FORT WORTH accepts and annexes 6.372 acres into its corporate limits as reflected in Exhibit D attached and incorporated herein. SECTION 5 (3.961 acre portion of Bonds Ranch Road Right -of Way) Pursuant to Section 43.031 of the Texas Local Government Code, HASLET and FORT WORTH hereby agree that the boundary between the cities will be adjusted as set out herein so that the 3.961-acre tract located in FORT WORTH extraterritorial jurisdiction, as described and shown in Exhibit "E", and with a width of less than 1,000 feet, will be located in the city limits of FORT WORTH. In accordance with this Joint Ordinance and Boundary Agreement, FORT WORTH accepts and annexes 3.961-acres described in Exhibit E attached and incorporated herein. SECTION 6 (3.264 acre portion of Harmon Road Right -of -Way) Pursuant to Section 43.031 of the Texas Local Government Code, HASLET and FORT WORTH hereby agree that the boundary between the cities will be adjusted as set out herein so that the 3.264-acre tract located in HASLET, as described and shown in Exhibit "F", and with a width of less than 1,000 feet, will be located in the city limits of FORT WORTH. In accordance with this Joint Ordinance and Boundary Agreement, HASLET hereby relinquishes the 3.264-acres described in Exhibit F to FORT WORTH and disannexes and discontinues such property as part of HASLET. In accordance with the terms of this Joint Ordinance and Boundary Agreement, FORT WORTH accepts and annexes 3.264 acres into its corporate limits as reflected in Exhibit F attached and incorporated herein. SECTION 7 (0.017 acre portion of Golden Heights Road Right -of -Way) Pursuant to Section 43.031 of the Texas Local Government Code, HASLET and FORT WORTH hereby agree that the boundary between the cities will be adjusted as set out herein so that the 0.017-acre tract located in HASLET, as described and shown in Exhibit "G", and with a width of less than 1,000 feet, will be located in the city limits of FORT WORTH. In accordance with this Joint Ordinance and Boundary Agreement, HASLET hereby relinquishes the 0.017-acres described in Exhibit G to FORT WORTH and disannexes and discontinues such property as part of HASLET. In accordance with the terms of this Joint Ordinance and Boundary Agreement, FORT WORTH accepts and annexes 0.017 acres into its corporate limits as reflected in Exhibit G attached and incorporated herein. SECTION 8 As of the effective date of this Joint Ordinance and Boundary Agreement, HASLET hereby transfers ownership of all portions of road right-of-way relinquished by HASLET to FORT WORTH pursuant to this Joint Ordinance and Boundary Agreement, and FORT WORTH shall have all maintenance responsibility for such road right-of-way, subject to the reservation by HASLET of a waterline easement for HASLET's existing eight (8) inch waterline within the Bonds Ranch Road right-of-way (the "Waterline Easement"), and the reservation of an easement for the existing HASLET entry monument located in the Bonds Ranch Road right-of-way at the northeast corner of its intersection with FM 156 (the "Monument Easement"). SECTION 9 (Waterline Easement) HASLET shall be entitled to retain the existing waterline in place until such time as relocation is required by FORT WORTH, provided that HASLET at its sole cost shall be responsible for all maintenance of the waterline, including restoration of the roadway surface from such maintenance activities to FORT WORTH right-of-way construction standards. If in the future, FORT WORTH desires to relocate the waterline, FORT WORTH shall be responsible for all costs associated with the waterline relocation. SECTION 10 (MONUMENT EASEMENT) HASLET shall be entitled to retain the existing city entry monument in place until such time that the right-of-way is widened. FORT WORTH will provide 90 days' notice to HASLET to remove or relocate the entry monument prior to any construction. SECTION 11 This ordinance shall be cumulative of all provisions of the ordinances of the City of Haslet and the City of Fort Worth, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances, in which event the conflicting provisions of such ordinances are hereby repealed. SECTION 12 It is hereby declared to be the intention of the City Councils of Haslet and Fort Worth that the phrases, clauses, sentences, paragraphs, and sections of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs, and sections of this ordinance, since the same would have been enacted without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 13 The City of Haslet and the City of Fort Worth do hereby covenant and agree to protect, preserve and defend the herein described boundary adjustment. SECTION 14 The City of Haslet and the City of Fort Worth agree and ordain that the adoption by both cities of this Joint Ordinance and Boundary Agreement, and the boundary change resulting from this Agreement do not mitigate, diminish or lessen in any way the rights that either party may have, at law or in equity, to challenge or contest any other annexations, attempted annexations or extraterritorial jurisdiction claims made by the other party. SECTION 15 This joint ordinance and boundary agreement shall become effective and shall become a binding agreement upon the City of Haslet and the City of Fort Worth by the adoption of same in regular open city council meetings of the City of Haslet and the City of Fort Worth. SECTION 16 The Mayor of each city shall execute this Joint Ordinance and Boundary Agreement, upon adoption by both cities, in duplicate originals.
