HomeMy WebLinkAboutOrdinance 17422-03-2007ORDINANCE NO. 17422-03-2007 AN ORDINANCE AMENDING ORDINANCE NUMBER 8300 TO AMEND THE TERM LIMITS OF THE COMMUNITY ACTION PARTNERS FROM TWO YEARS TO FIVE YEARS; PROVIDING THAT THIS ORDINANCE SHALL BE CUMULATIVE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the 1981, the Fort Worth City Council adopted Ordinance Number 8300 establishing a fifteen member commission entitled the "Neighborhood Resources Development Council" to assist the City Council in setting priorities and involving lower- income citizens in the decision making process for projects initiated with funding from the Community Achninistration of the Untied States; and WHEREAS, Ordinance Number 8300 established a fifteen (15) member Development Council whose members each served a two (2) year term; and WHEREAS, in 2004, the City Council adopted' Ordinance Number 15482, changing the name from Neighborhood Resources Development Council to Community Action Partners Council to reflect the collaborative nature of the services and to be more consistent with the names of other community action agencies; and . WHEREAS, throughout the state, community action agencies permit their members to serve five year terms; and WHEREAS, it is advisable to amend Ordinance Number 8300 to allow the members of the Conununity Action Partners Council to serve five (5) year terms to be consistent with other community action agencies in the state. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCH. OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That each of the members of the Community Action Partners Council shall hold ofFce for a term of five (5) years unless removed prior to the completion of such term. No member selected for Places 6-15 shall serve for more than five (5) consecutive years, or more than ten (10) years altogether. SECTION 2. This ordinance shall be cumulative of all provisions of ordinances and of the Code of the City of Fort Worth, Texas (1986), as amended, except where the provisions of this ordinance are in direct conflict with the provisions of such ordinances and such Code, in which event conflicting provisions of such ordinances and such Code are hereby repealed. SECTION 3. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance are severable, and, if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or.decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 4. All rights and remedies of the City of Fort Worth, Texas, are expressly saved as to any and all violations of the provisions of Ordinance Number 3011, Ordinance Number 13896 or any other ordinances affecting zoning which have accrued at the time of the effective date of this ordinance, and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such 2 ordinances, same shall not be affected by this ordinance but maybe prosecuted until final disposition by the courts. SECTION 5. DISCUSSION: In 1981, the Fort Worth City Council adopted Ordinance Number 8300 establishing a fifteen member commission entitled "Neighborhood Resources Development Council" to assist the City Council in setting priorities and involving lower-income citizens in the decision making process for projects initiated with funding from the Community Administration of the United States. The Ordinance established a 15 member Development Council whose members served for a year term. In 2004, the City Council adopted Ordinance No. 15842, changing the name from Neighborhood Resources Development Council to Community Action Partners Council to reflect the collaborative nature of the services and to be more consistent with the names of other community action agencies. Throughout the state, community action agencies permit their members to serve five year terms. It is advisable to amend Ordinance No. 8300 to allow the members of the Community Action Partners Council to serve five year terms to be consistent with other community action agencies in the state.
