AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF
ALSTON AVENUE, FROM BROADWAY AVENUE TO WEST
PETERSMITH STREET, BLOCK 34, JENNINGS SOUTH ADDITION, AN
ADDITION TO THE CITY OF FORT WORTH, TARRANT COUNTY,
TEXAS; CONTAINING APPROXIMATELY 16,216 SQUARE FEET OF
LAND, PROVIDING FOR REVERSION OF FEE IN SAID LAND;
PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING
UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN
CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That a portion of Alston Avenue, from West Broadway Avenue to West Petersmith
Street, Block 34, Jennings South Addition, an addition to the City of Fort Worth, Tarrant County,
Texas, and containing approximately 16,216 square feet of land more or less, and as more
specifically described in Exhibits "A" and `B" attached hereto and incorporated herein by
reference be and the same is vacated and extinguished.
SECTION 2.
That the easement to the land in the above - described vacated street right of way is hereby
released and shall revert to the adjacent owner as provided by law.
SECTION 3.
All existing utility easement be shall be retained by the City until such time all utilities
located in that easement are relocated at the owner's expense.
SECTION 4.
That all ordinances or parts of ordinances in conflict herewith are hereby repealed.
SECTION 5.
That this ordinance shall take effect upon adoption.

Description for a portion of Alston Avenue to be vacated,
said portion being more particularly described b7 metes
and bounds as follows:
Beginning at a 112" rebar rod found (Control Monument)
in the east line of Alston Avenue and in the north line of
West Peter Smith Street for the southwest corner of Lot 4,
Jennings South Addition (an unrecorded plat);
Thence West (Base Bearing), 40.54 feet through Alston
Avenue along the north line of West Peter Smith Street to
a 112" capped rebar rod found (Control Monument) in the
west line of Alston Avenue for the southeast corner of Lot
3 of said Jennings South Addition;
Thence North 400.00 feet along the west line of Alston
Avenue same being the east line of Lots 3 and 2 of said
Jennings South Addition and a tract of land described in
deed to F. & C. Williams Sr., Property, Ltd., recorded in
Volume 13589, Page 333, Deed Records, Tarrant Count7,
Texas to a point in the south line of West Broadway for a
northeast corner of said Williams Tract;
Thence East 40.54 feet along the south line of West
Broadway, to a point for a northwest corner of the
Williams Tract;
Thence South 400.00 feet along the east line of Alston
Avenue same being the west line of said Lots 1 and 4 and
the Williams Tract to the point of beginning and
containing 16,216 square feet of land.

RECOMMENDATION:
It is recommended that the City Council:
1. Adopt an ordinance vacating a portion of Alston Avenue from Broadway Avenue to West Petersmith
Street; and
2. Waive any and all purchase fee value of the vacated land in accordance with City Policy (M &C G-
15624).
DISCUSSION:
Delta Surveying, on behalf of GLGP, LLC, has requested the vacation of this portion of Alston Avenue to
replat the right -of -way with the adjoining property for a new multifamily development. The City Plan
Commission recommended approval of this request at its meeting on June 25, 2008. An acceptable replat
(FS- 011 -062) has been received. Any existing utilities will be relocated at the applicant's expense, or
retained within a designated easement, along with an appropriate plat note that no permanent structures
may be constructed or placed thereon.
The City of Fort Worth (City) originally obtained the above mentioned right -of -way through the platting
process. The City does not own land under or adjacent to the above referenced street. Since no City funds
have been expended to purchase property or easement rights, collection of the fair market value or any
portion thereof is recommended by Staff to be waived.
This land is located in COUNCIL DISTRICT 9.

funds.
