AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND
APPROPRIATIONS IN THE CULTURE AND TOURISM FUND IN THE AMOUNT
OF $835,000.00, AND DECREASING THE UNAUDITED, UNASSIGNED FUND
BALANCE BY THE SAME AMOUNT, FOR THE PURPOSE OF CONSTRUCTION,
STAFF, AND CONTINGENCY COST TO UPGRADE THE BOILER PLANT AT THE
WILL ROGERS MEMORIAL CENTER; PROVIDING FOR A SEVERABIL,ITY
CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES;
REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2011 -2012 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the
Culture and Tourism Fund in the amount of $835,000.00, and decreasing the unaudited, unassigned fund
balance by the same amount, for the purpose of construction, staff, and contingency cost to upgrade the
boiler plant at the Will Rogers Memorial Center.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or
void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 19911 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict
with such other ordinances and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed.
SECTION 4
This ordinance shall take effect upon adoption.

Authorize Execution of a Contract with Johnson Controls, Inc., in the Amount of $736,874.00 Plus
$98,126.00 in Contingency for the Will Rogers Memorial Center to Upgrade the Boiler Plant and Adopt
Appropriation Ordinance (COUNCIL DISTRICT 7)
RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached appropriation ordinance increasing appropriations in the Culture and Tourism Fund
by $835,000.00 and decreasing the unaudited, unassigned fund balance by the same amount; and
2. Authorize the execution of a contract with Johnson Controls, Inc., in the amount of $736,874.00 plus
$98,126.00 in contingency and staff administration using a Texas Multiple Award Schedule Contract
Number TXMAS -6- 840160 to upgrade the boiler plant at the Will Rogers Memorial Center.
DISCUSSION:
A Design Agreement was previously executed in the amount of $8,000.00 to provide the design and
construction administration services to upgrade the boiler plant. The boiler plant serves to provide
conditioned water to heat the entire WRMC complex with the exception of the barns. The existing
equipment was installed in the early 1980's and has been re -tubed twice to expand the service life. The
equipment has reached the end of its service life and frequent, costly repairs are required to maintain the
heating comfort for the guests of the scheduled events.
PRICE ANALYSIS — The vendor prices were obtained using a Texas Multiple Award Schedule ( TXMAS)
Cooperative Contract Number 6- 840160.
The overall project cost is expected to be:
Design (Previously funded for $8,000.00)
Construction $736,874.00
Contingency, Staff $ 98.126.00
Total $835,000.00
M /WBE — A waiver for the goal for M /WBE subcontracting requirements was requested by the Public
Events Department and approved by the M /WBE Office because the purchase of goods and services is
from sources where subcontracting or supplier opportunities are negligible.

COOPERATIVE PURCHASE — State Law provides that a local government purchasing an item under a
Cooperative Purchasing Agreement satisfies State laws requiring that the local government seek
competitive bids for purchase of the item. TXMAS was established by the State of Texas to provide a list
of approved contracts that have been competitively bid and awarded by Federal, State, or Local
Government entities to increase and simplify the purchasing power of governmental entities across the
State of Texas.
The project is physically located in COUNCIL DISTRICT 7 but will serve Fort Worth residents in ALL
COUNCIL DISTRICTS.
FISCAL INFORMATION / CERTIFICATION:
The Financial Management Services Director certifies that upon approval of the above recommendation
and adoption of the attached supplemental appropriation ordinance, funds will be available in the current
operating budget, as appropriated, of the Culture and Tourism Fund. Upon approval, the unaudited,
unassigned fund balance of the Culture and Tourism Fund will exceed the minimum reserve as outlined in
the Financial Management Policy Statements.
