HomeMy WebLinkAboutOrdinance 20045-01-2012Ordinance No. 20045 -01 -2012 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE SPECIAL TRUST FUND IN THE AMOUNT OF $25,000.00, SUBJECT TO RECEIPT OF A DONATION FROM CHESAPEAKE OPERATING, INC. FOR THE PURPOSE OF UNDERWRITING IMPROVEMENTS TO THE FITNESS FACILITY AT THE HIGHLAND HILLS COMMUNITY CENTER; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2011 -2012 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Special Trust Fund in the amount of $25,000.00, subject to receipt of a donation from Chesapeake Operating, Inc. for the purpose of underwriting improvements to the fitness facility at the Highland Hills Community Center. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 19911 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. APPROVE AS TO FORM AND LEGALITY: 4Assistntty t ey ADOPTED AND EFFECTIVE: January 10, City of Fort Worth, Texas Mayor and Council Communication RECOMMENDATION: It is recommended that the City Council: 1. Authorize the acceptance of a donation totaling $32,000.00 from Chesapeake Operating, Inc., consisting of a $25,000.00 donation for improvements at Highland Hills Community Center and a $7,000.00 donation for improvements at Sycamore Community Center; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Special Trust Fund by $25,000.00, on receipt of the donation; and 3. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the General Fund by $7,000.00, on receipt of the donation. DISCUSSION: In June 2011, Chesapeake Operating, Inc., contacted the Parks and Community Services Department requesting a list of park and community center improvement projects in southeast Fort Worth. In requesting the list, Chesapeake's representative explained that, because the company's natural gas production has been widespread throughout the City, the company desired to provide funds for improvements at two community centers that serve the residents of southeast Fort Worth. At Highland Hills Community Center, this funding will underwrite improvements to the fitness facility, which will offer equipment such as treadmills, weight benches, and dumbbells. Recognition of the donation will include a press release and grand re- opening ceremony for the fitness facility. At Sycamore Community Center, the funds will be used to provide a new scoreboard for the gym. Donation recognition will include placing Chesapeake Energy's name and logo on the scoreboard and holding an official switching on ceremony at the start of the winter Youth Athletics Program in January 2012. On October 26, 2011, the Parks and Community Services Advisory Board endorsed staffs recommendation to the City Council to accept this donation. Logname: 80CHESAPEAKE OPERATING, INC. FISCAL INFORMATION / CERTIFICATION: The Financial Management Services Director certifies that upon approval of the above recommendations, receipt of the contribution, and adoption of the attached appropriation ordinances, funds will be available in the current operating budget, as appropriated, of the General Fund and the current capital budget of the Special Trust Fund and the Parks and Community Services Department is responsible for the collection and deposit of funds.
