HomeMy WebLinkAboutOrdinance 20046-01-2012Ordinance No. 20046 -01 -2012 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $4,020,000.00, SUBJECT TO RECEIPT OF A GRANT FROM THE UNITED STATES DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT FOR LEAD HAZARD REDUCTION DEMONSTRATION, FOR THE PURPOSE OF CONTINUING PAST LEAD HAZARD CONTROL PROGRAMS; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2011 -2012 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $4,020,000.00, subject to receipt of a grant from the United States Department of Housing and Urban Development for Lead Hazard Reduction Demonstration, for the purpose of continuing past lead hazard control programs. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3 That this ordinance shall be cumulative of Ordinance No. 19911 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the application for and, if awarded, the acceptance of a grant of up to $3,000,000.00 from the United States Department of Housing and Urban Development for a Lead Hazard Reduction Demonstration Program; 2. Authorize the use of up to $1,020,000.00 of Community Development Block Grant funds as the City's direct match; 3. Authorize the City Manager or his designee to enter into Agreements and amend or extend such Agreements with the Tarrant County Public Health Department, the Fort Worth Housing Authority, area non - profit organizations and other entities as may be necessary and appropriate within the scope of the program and in compliance with applicable laws and regulations; 4. Certify that the activities to be funded with the grant are consistent with the City's Consolidated Plan; and 5. Adopt the attached appropriation ordinance increasing the estimated receipts and appropriations in the Grants Fund by up to $4,020,000.00 subject to receipt of the grant. DISCUSSION: On November 28, 2011, the United States Department of Housing and Urban Development (HUD) issued a Notice of Funding Availability for competitive grant funds under the Lead Hazard Reduction Demonstration (LHRD) Program. The purpose of this program is to assist units of local government in undertaking programs to identify and control lead -based paint hazards in eligible privately owned rental or owner - occupied housing. The City's Housing and Economic Development Department received similar grants for 2002 -2005 and 2005 -2008 for the Lead -Based Paint Hazard Control Grant Program and is seeking further grant funding under the LHRD Grant Program to expand efforts to increase the supply of lead -safe housing in the City. Housing is generally made lead -safe through use of interim controls, a cost - effective treatment consisting Logname: 17LHRD2012 Page 1 of 2 of encapsulation of lead -paint surfaces and replacement of components such as doors and windows which have friction surfaces that can create lead dust. The average cost of treating homes has been approximately $12,500.00 per unit. The Housing and Economic Development Department is requesting authorization to apply for the $3,000,000.00 grant from HUD to continue past lead hazard control programs for a three year period from July 2012 to July 2015. Administrative costs for the Program are limited to 10 percent of the grant. The grant requires a minimum 25 percent direct match however Staff recommends 34 percent. The direct match will be made up of $618,750.00 of Community Development Block Grant (CDBG) funds previously approved in the 2010- 2011 Action Plan, and $401,250.00 from unprogrammed CDBG funds. The Action Plan will be amended to provide for the use of the unprogrammed funds upon grant approval. In addition, other CDBG funds committed for rehabilitation activities will be used as contributing match. The Housing and Economic Development Department will collaborate with the Tarrant County Public Health Department, the Fort Worth Housing Authority, area non - profit and community -based organizations and other entities to ensure that appropriate outreach is conducted among all at -risk populations and neighborhoods. The LHRD Program is available City -wide.
