TO CITY SECRETARY CONTRACT
WHEREAS, the City of Fort Worth (CITY) and Teague Nall and
Perkins, Inc. (ENGINEER) made and entered into City Secretary
Contract No. 47117, (the CONTRACT) which was authorized by M&C C-
27488 on the 29th day of September, 2015 in the amount of
$449,945 .00; and
WHEREAS, the CONTRACT was subsequently revised by: Amendment
No. 1 in the amount of $9,355 . 00 administratively authorized on
August 22, 2017 and Amendment No. 2 in the amount of $52,085 .00
administratively authorized December 4, 2018; and
WHEREAS, the CONTRACT involves engineering services for the
following project:
Upper Big Fossil Creek Drainage Basin Parallel Interceptor
Improvements; and
WHEREAS, it has become necessary to execute Amendment No. 3 to
the CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and
through their duly authorized representatives, enter into the
following agreement, which amends the CONTRACT:

Article I of the CONTRACT is amended to include the additional
engineering services specified in a proposal dated February 1, 2019,
a copy of which is attached hereto and incorporated herein. The cost
to City for the additional design services to be performed by
Engineer totals $166,706.00 .
2 .
Article II of the CONTRACT is amended to provide for an
increase in the fee to be paid to Engineer for all work and services
performed under the Contract, as amended, so that the total fee paid
by the City for all work and services shall be an amount of
$678,091 .00 .
3 .
�� All other provisions of the Contract, which are not expressly
, 1e 4ed herein, shall remain in full force and effect.

Dear Mr. Norwood:
Teague Nall and Perkins, Inc. is submitting this fee Amendment for the above referenced contract
based on additional services required. The following is a brief description and cost for the
additional services to be provided on this project:
I. Construction Inspection Services
TNP will provide an experienced Construction Inspector (to be approved by the Water
Department) to assist the Department in inspecting the Upper Big Fossil Creek Parallel
Interceptor project. The Construction Inspector will work under the supervision of the Water
Department's Construction staff.
A detailed scope of services is included in Attachment A-3 Scope of Services(see attached).
II. Fee Proposal for Contract Amendment No. 3: $ 166,706
TNP proposes a total fee of$166,706 to accomplish the scope of services. A breakdown of
the fee is included in Attachment B-3.

III. Project Schedule
The anticipated duration of construction inspection services is 18 months. See Attachment

IV. M/WBE Utilization:
This amendment does not include work effort for our certified M/SBE subconsultant partners.
With this amendment, the overall M/SBE participation will now be 8.54% which is below the
City's M/SBE goal of 10%.

SCOPE OF SERVICES
Construction Inspection Services for
Upper Big Fossil Creek Drainage Basin Parallel Interceptor Improvements
CONSTRUCTION INSPECTION SERVICES
ENGINEER will provide construction inspection services for the Open Cut and Tunneling portions of
the project. TNP will not provide construction inspection services for the CIPP and Pipe
Enlargement elements of the project. Duties include:
• Attend pre-construction meeting
• Attend public meeting
• Assign qualified staff to provide on-site inspection of contract work.
• Document work progress in daily work reports.
o Measure and record pay items placed each day
• Maintain project diary each day documenting all project activity inclusive of weather
conditions work items in progress and it location, and any significant project issues.
• Review contractor's traffic control set-up.
• Meet with/attend utility meetings to facilitate coordination of contract work with existing
utilities within the ROW.
• Facilitate the resolution of any issues arising with the abutting property owners.
• Coordinate Material Testing with approved geotechnical firm.
o Receive and review all test reports
• Inspect sanitary sewer main placement.
o Insure construction plans are followed
o Insure specified materials are provided
o Insure pavement is saw cut to acceptable lines/ backfill is placed at specified
density/ pavement is repaired in accordance with plan details
• Verify that contractor is collecting required horizontal and vertical survey data for use in
preparing as-built plans.
• Review and verify contractor pay requests each month prior.
• Review and verify the contractors progress report each month prior to City payment.
• Coordinate any needs for Field Changes with the City, Contractor and TNP Staff.
• Assist the City resolve any Contractor disputes relative to the work.
• Attend final inspection
• Prepare a final punch list prior to acceptance of the project.
• Advise the City of the status of Contractor's progress on punch list.

RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached Resolution Expressing Official Intent to Reimburse Expenditures with Proceeds
of Future Debt for the Upper Big Fossil Creek Drainage Basin Parallel Interceptor Improvements
within the Upper Big Fossil Creek Drainage Basin Project;
2. Adopt the attached Appropriation Ordinance increasing estimated receipts and appropriations in the
Water&Sewer Commercial Paper Fund in the amount of$14,339,476.00 for Upper Big Fossil
Creek Drainage Basin Parallel Interceptor Improvements within the Upper Big Fossil Creek
Drainage Basin;
3. Authorize the execution of Amendment No. 3 in the amount of$166,706.00 to City Secretary
Contract No. 47117, an Engineering Agreement with Teague Nall and Perkins, Inc., for inspection
services for Upper Big Fossil Creek Drainage Basin Parallel Interceptor Improvements within the
Upper Big Fossil Creek Drainage Basin (City Project No. CO2515); and
4. Authorize the execution of a contract with William J. Schultz, Inc. dba Circle C Construction
Company, in the amount of$13,006,286.25 for Upper Big Fossil Creek Drainage Basin Parallel
Interceptor Improvements within the Upper Big Fossil Creek Drainage Basin (City Project No.
CO2515).
DISCUSSION:
This Mayor and Council Communication provides for the construction of the Upper Big Fossil Creek
Drainage Basin Parallel Interceptor Improvements within the Upper Big Fossil Creek Drainage Basin.
On September 29, 2015, (M&C C-27488), the City authorized an engineering agreement in the amount of
$449,945.00 with Teague Nall & Perkins, Inc., for Upper Big Fossil Creek Drainage Basin Parallel
Interceptor Improvements within the Upper Big Fossil Creek Drainage Basin. The agreement was
subsequently revised by Amendment No. 1 in the amount of$9,355.00 administratively authorized August
22, 2018 and Amendment No. 2 in the amount of$52,085.00 administratively authorized December 4,
2018.
Amendment No. 3 will allow Teague Nall & Perkins, Inc., (TNP) to provide inspection services during
construction of the project. Staff considers the proposed fee to be fair and reasonable for the scope of

services proposed.
Construction of the project was advertised for bid on December 20, 2018 and December 27, 2018 in the
Fort Worth Star-Telegram. On January 31, 2019 the following bids were received:

In addition to the contract cost, $906,358.00 is required for Project Management, inspection and material
testing and $260,125.00 is provided for project contingency.
This project is anticipated to be included in a future revenue bond issue for the Water and Sewer Fund.
Available cash within the Water and Sewer portfolio and the City's portfolio along with the appropriation
authority authorized under the Callable Commercial Paper Program (CP) will be used to provide interim
financing for this project until debt is issued. To the extent resources other than the Water and Sewer
portfolio are used to provide interim financing, the Water and Sewer Fund will be charged interest that is
equivalent to the overall rate of return being earned by the City portfolio (currently approximately one-
percent annually). Should the City's portfolio not support the liquidity needed to provide an interim short-
term financing source, another funding source will be required, which could mean issuance of securities
under the CP Program or earlier issuance of Water and Sewer revenue bonds than is currently planned.
Once debt associated with this project is sold, bond proceeds will be used to reimburse the Water and
Sewer portfolio and the City's portfolio in accordance with the attached Reimbursement Resolution.
The City Council adopted the Water Department's Fiscal Year 2018-2022 Five Year Capital Improvement
Plan on September 26, 2017. This City Council adopted plan includes this specific project, with funding
identified through the CP program to be reimbursed with future revenue bonds. In accordance with the
provisions of the Financial Management Policy Statement, Staff anticipates presenting revenue-supported
debt issuances to the City Council for consideration within the next three years. This debt must be issued
within approximately three years to provide reimbursement for these expenses. If that does not occur, the
costs will no longer be reimbursable by issuing tax-exempt debt and the funding source will have to be
made whole through budgetary methods. Adoption of this resolution does not obligate the City to sell
bonds, but preserves the ability to reimburse the City from tax-exempt bond proceeds.
Construction is anticipated to commence in April, 2019 and be completed by November, 2020. This
project is part of the Water Department's Sanitary Sewer Overflow Initiative Program. This project will
have no impact on the Water Department's Operating Budget when complete.
M/WBE OFFICE: William J. Schultz, Inc., dba Circle C Construction Company, is in compliance with the
City's BDE Ordinance by committing to zero percent MBE participation and documenting good faith effort.
William J Schultz, Inc., dba Circle C Construction Company identified several subcontracting and supplier
opportunities. However, the firms contacted in the areas identified did not respond or did not submit the
lowest bids. The City's MBE goal on this project is 10 percent.
TNP: A waiver of the goal for MBE/SBE subcontracting requirements was requested by the Department

and approved by the MWBE Office in accordance with the MWBE or DBE Ordinance, because the MWBE
Waiver is based on the sole source information provided to the MWBE Office by the managing
department's project manager.
The project is located in COUNCIL DISTRICT 4.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendations and adoption of the
attached appropriation ordinance, funds will be available in Water& Sewer Commercial Paper Fund for
the Upper Big Fossil Creek Drainage Basin Parallel Interceptor Improvements within the Upper Big Fossil
Creek Drainage Basin Project. The Water and Sewer Commercial Paper Fund includes authority of
$150,000,000.00 for the purpose of providing interim funding for Water and Sewer Capital Projects. After
this transfer, the balance will be $48,249,647.00 for future capital projects. Funding for the Upper Big
Fossil Creek Drainage Basin Parallel Interceptor Improvements within the Upper Big Fossil Creek
Drainage Basin project is as depicted below:
