Home My WebLink AboutContract 44546-A4 CITY SECRETARY CONTRACT NO. 5 4 M FOURTH AMENDMENT TO CITY SECRETARY CONTRACT NO.44546 This Fourth Amendment to City Secretary Contract Number 44546("Agreement"),as previously amended and addended ("Fourth Amendment") is by and between the City of Fort Worth ("City"), a home-rule municipal corporation of the State of Texas, acting by and through its duly authorized Assistant City Manager,and McKay Lodge Fine Arts Conservation Laboratory, Inc. ("Conservator"),an Ohio Corporation, acting by and through Robert G. Lodge, its President. The City has designated the Arts Council of Fort Worth&Tarrant County,Inc.,to manage this Agreement on its behalf. WHEREAS, on June 19, 2013, the City and Conservator entered into a professional services agreement whereby Conservator will provide general maintenance, conservation, and consultation to the City for the City's art collection, the same being City Secretary Contract (CSC) No. 44546; three amendments CSC 44546-Al, CSC 44546-A2, and CSC 44546-A3AD3; three renewals CSC 44546-A2, CSC 44546-R2 and CSC 44546-R3;and three addenda CSC 44546-AD I, CSC 44546-AD2,CSC 44546- A3AD3; WHEREAS, under CSC 44546-A3AD3, Conservator agreed to provide professional condition assessment services using equipment provided by City; WHEREAS, City-provided equipment was determined to be insufficient for Conservator to safely provide services; WHEREAS, after on-site observation, Conservator wishes to add scope to the original proposal for additional time and labor; and WHEREAS, City wishes to amend the compensation in accordance with the Conservator's revised bid to allow for unexpected conditions; NOW, THEREFORE, in consideration of the mutual covenants herein expressed, the parties agree as follows: I. The parties wish to revise Compensation for Services in CSC No.44546-A3AD3 as follows: 1. In consideration of the Services to be performed under CSC No. 44546-A3AD3, the City agrees to pay the Contractor an amount up to Eleven Thousand,Six Hundred and One Dollars and Fourteen Cents ($11,601.14) in accordance with the terms of Article 3 of the Agreement and the exhibit attached hereto as Exhibit "I" to allow Conservator to rent necessary equipment to complete the Services,which was originally going to be provided by City and is N% insufficient.Any amounts paid in under CSC No.44546-A3AD3 and this Fourth Amendment shall be credited towards the total amount paid under the Agreement, including any 0 O �G amendments or addenda.
