HomeMy WebLinkAboutOrdinance 23627-04-2019Ordinance No, 23627-04-2019 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE BOTANIC GARDEN SPECIAL REVENUE FUND, FROM FUND BALANCE IN THE AMOUNT OF $550,000.001 FOR THE PURPOSE OF TRANSFERRING FUNDS TO THE GENERAL CAPITAL PROJECTS FUND; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2018- 2019 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Botanic Garden Special Revenue Fund in the amount of $550,000.00, from fund balance, to transfer funds to the General Capital Projects Fund, SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion orjudgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 23392-09-2018 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached appropriation ordinance increasing receipts and appropriations in the Botanic Garden Special Revenue Fund in the amount of $550,000.00, from available unencumbered fund balance, for the purpose of transferring funds to capital for admission facility projects. 2. Adopt the attached appropriation ordinance increasing receipts and appropriations in the Botanic Garden Renovation Programmable Project of the General Capital Projects Fund in the amount of $550,000.00, from transferred funds, for the purpose of funding required admission facility projects at the Botanic Garden. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to take actions to authorize use of $550,000.00 to pay for capital projects associated with preparing the Botanic Garden for the institution of admission charges. On November 13, 2018, the City Council approved (M&C G-19422) that adopted the recommendations of the Botanic Garden Task Force which established general admission fees, membership fees and a financial accessibility program for the Botanic Garden effective July 15, 2019, or upon completion of necessary controls and accounting procedures. Additional recommendations included the following: 1. Authorize City staff to pursue management of the Botanic Garden by anon -profit organization; 2. Formally designate the Park &Recreation Department Director and personnel that are routinely tasked with collecting fees to act as agents of the Financial Management Services Department; and 3. Authorize the Park &Recreation Department to modify fees for financial accessibility programs, marketing, promotional, and educational purposes. Staff have identified several projects that need to be completed prior to charging an admission fee to the Botanic Garden. These include the items listed below. Logname: 80BGFIJNDBALANCE Page 1 of 2 a. Construct a fence to separate the free areas from the areas that require paid admission; b. Expand the building envelope and construct a new welcome desk in the Deborah Beggs Moncrief Garden Center to handle the additional admission traffic; and c. Renovate a portion of the conservation greenhouse structure to collect admission fees at the IH-30 overflow parking area. Following the above appropriations of $550,000.00, the Botanic Garden Special Revenue Fund is projected to be at the minimum reserve requirement equivalent to two months (16.67%) of regular, on- going Operating Expenditures (including operating transfer out). The Botanic Garden is a citywide facility and serves the entire city of Fort Worth. This M&C does not request approval of a contract with a business entity.
