AMENDMENT NO. 1 TO
COMMUNITY FACILITIES AGREEMENT AND ESCROW AGREEMENT

COUNTY OF TARRANT §
WHEREAS,the City of Fort Worth("City")and Fourth&Sylvania Inc., ("Developer")
entered into a Community Facilities Agreement ("CFA") and, the City, Developer and R Bank
("Escrow Agent") entered into an Escrow Agreement("Escrow Agreement"),the CFA and the
Escrow Agreement being filed with the City Secretary as City Secretary Contract No. 51748,
wherein Developer is to make certain improvements related to a project generally described as
South of Fourth Residences Phase 1 Paving ("Project"); and
WHEREAS, the Developer has not been issued a notice to proceed to construction for
the improvements; and
WHEREAS, the Developer has selected a new contractor to construct the
improvements; and
WHEREAS, the Developer desires to amend the CFA and the Escrow Agreement to
allow the Developer to construct the improvements with the new contractor
NOW THEREFORE, City and Developer, acting herein by and through their duly
authorized representatives, enter into the following agreement, which amends the CFA, and
City, Developer and Escrow Agent enter into the following agreement which amends the
Escrow Agreement:
I.
The Cost Summary Sheet in the CFA is hereby amended to be and read as follows:

Project Name: South of Fourth Residences Phase 1 Paving
CFA No.: 2018-011 City Project No.: 10124;
An Engineer's Estimate of Probable Cost is acceptable. However, the construction contract price
will ultimately determine the amount of CFA fees and financial guarantee. The bid price and any
additional CFA payments will be required prior to scheduling a pre-construction meeting. An

II.
The Paving Cost Estimate in the CFA is amended to be acid read as set forth in Exhibit
"A" to this Amendment No. 1 to Community Facilities Agreement and Escrow Agreement
which is attached hereto and incorporated herein by reference.
III.
The definition of"Security Funds"in Section 1 of the Escrow Agreement is amended
to be and read as follows:

"Security Funds"shall mean the cash deposit of Two Hundred Forty-Seven Thousand Two
Hundred Seventy Dollars and No Cents($247,270.001,which sum represents one hundred
twenty-five percent (125%) of the estimated Developer's cost of constructing the CFA
Obligations(the "Estimated Developer's Cost").
IV.
1. All other provisions of the CFA and the Escrow Agreement, which are not
expressly amended herein, shall remain in full force and effect.
2. All terms of this Amendment No. 1 to Community Facilities Agreement and
Escrow Agreement that are capitalized but not defined shall have the meanings assigned to
them in the Agreement.

IN TESTIMONY WHEREOF, the City, Developer and Escrow Agent have each caused
this instrument to be executed in each entity's respective name by its duly authorized signatories
effective as of the date executed by the City's Assistant City Manager.Escrow Agent executes this
instrument only in connection with the amendment of the Escrow Agreement.
