ORDINANCE N0.23625-04-2019 AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF CHAPIN ROAD (COUNTY ROAD 1029, SITUATED IN THE C.K. GLEASON SURVEY, ABSTRACT NO, 559 OF THE CITY OF FORT WORTH, TARRANT COUNTY, TEXAS, AS SHOWN ON THE PLAT RECORED IN VOUME 8448, PAGE 1968, PLAT RECORDS, TARRANT COUNTY, TEXAS, CONTAINING APPROXIMATELY 209517 SQUARE FEET OF LAND MORE OR LESS; PROVIDING FOR REVERSION OF FEE IN SAID LAND; PROVIDING THAT THE CITY SHALL RETAIN ALL EXISTING UTILITIES EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a portion of Chapin Road (County Road 1029), situated in the C.K. Gleason Survey, Abstract No. 559 in the City of Fort Worth, Tarrant County, Texas, Sylvan Crest, an addition to the City of Fort Worth as and as recorded in Volume 8448, Page 1968, Plat Records, Tarrant County, Texas and containing 20,517 square feet of land more or less, and as more specifically described in Exhibits A attached hereto and incorporated herein by reference be and the same is vacateA and extinguished. SECTION 2. That the easement to the land in the above -described vacated street right of way is hereby released and shall revert to the adjacent owner as provided by law. SECTION 3. All existing utility easement be shall be retained by the City until such time all utilities located in that easement are relocated at the owner's expense. Adopt the attached ordinance vacating a portion of Old Chapin Road to be replatted with the adjoining property for a Single Family Residential Subdivision, Chapin Village; and 2. Waive any and all purchase fee value of the vacated land. DISCUSSION: Teague Nall and Perkins, Inc., on behalf of Jabez Development, LP, has requested vacation of this street to be replatted with the adjoining property for a single family residential subdivision. The City Plan Commission recommended approval of this request at its meeting on November 28, 2018. An acceptable final plat (FP-18-033) has been received in accordance with the Subdivision Ordinance. The City of Fort Worth (City) originally obtained the above mentioned County Road 1029 (aka Chapin Road) right-of-way through annexation in 2005 (Ordinance No. 16691-11-2005). The City does not own any fee interest in the rights -of -way or own any property adjacent to the right-of-way and did not expend any City funds to purchase the right-of-way easement when the area was annexed. On March 6, 2007, the City Council approved, Mayor and Council Communication (M&C G-15624) which established the City's policy regarding street and alley vacation transactions and provided, among other valuation criteria, that the purchase price of right-of-way would be waived where the easement was dedicated by plat or separate instrument and did not require a financial investment. Though the right-of-way was not acquired through platting, the annexation of the right of way is analogous in that the annexation did not require a financial investment by the City, therefore staff recommends waiving the fair market value or any portion thereof of purchase price of this right-of-way easement for the streets and alley. This project is located in COUNCIL DISTRICT 3. This M&C does not request approval of a contract with a business entity.
