HomeMy WebLinkAboutOrdinance 18565-04-2009Ordinance No. 18565-44-2449 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS W THE CULTURE AND TOURISM FUND IN THE AMOUNT OF 535,040.00 AND DECREASING UNAUDITED, UNRESERVED, UNDESIGNATED FUND BALANCE BY THE SAME AMOUNT, FOR THE PURPOSE OF AUTHORIZING A PROFESSIONAL SERVICES AGREEMENT WITH WALKER PARKING CONSULTANTS FOR DEVELOPMENT OF THE REQUEST FOR PROPOSAL PROCESS TO SELECT A PARKING OPERATOR FOR THE WESTERN HERITAGE PARKING GARAGE AND WILL ROGERS MEMORIAL CENTERtGULTURAL DISTRICT PARKING SYSTEM; PROVIDING FOR A SEVERABIL4TY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORD{NANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2448- 2009 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Culture and Tourism Fund in the amount of 535,400.40 and decreasing unaudited, unreserved, undesignated Fund Balance by the same amount, for the purpose of authorizing an Engineering Agreement with Walker Parking Consultants for development of the Request for Proposal process to select a parking operator for the Western Heritage parking Garage and Will Rogers Memorial CenterlCultura! District Parking System. SECTION 2. That should any portion; section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, ar parts of sections of this ordinance, which said remaining provisions shall be and remain in full farce and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 18283 and all other ordinances and appropriations amending the same except in these instances where the provisions of thks ordinance are in dieect conflict with such other ordinances and appropriations.. in ~.vhiah instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adapt the attached supplemental appropriation ordinance increasing estimated receipts and appropriafions in the Culture and Tourism Fund by $35,DOO.OD and decreasing the Unaudited, Unreserved, Undesignated Fund balance by the same amount; and 2. Authorize execution of a Professional Services Agreement an amount up to $35,000.00, including $1D,DDD.DD in contingency, with Walker Parking Consultants for development of the Request for Proposals and related processes to select a parking operator for the Western Heritage Parking Garage and the WiII Rogers Memorial CenterlCultural District Parking System. DISCUSSION: _ ___ On November 11, 2408, (M&C G-16355} the City Council adopted the ordinance providing for the issuance of City of Fort Worth, Texas, Combination Tax and Will Rogers Memorial Center Complex Parking Revenue Certificates of Obligation in an aggregate principal amount not to exceed $35,O0O,OOD.DO; establishing parameters regarding the sale of the Certificates of Obligation {CO}; approving the execution of a Purchase Agreement and ordaining other matters relating to the subject. The estimated costs included the design and construction related costs of the parking system improvements as well as the additional costs of financing and other related expenses. On February 3, 2008, (M&C C-23328} the City Council approued the construction contract in the amount of $16.D84,ODO.DD with W.G. Staff recommends that a Request for Proposals (RFP} for a potential third- party parking management company be issued in order to identify the most cost effective and efficient management of the consolidated parking system at Will Rogers Memorial Center. Walker Parking Consultants has submitted a proposal far the development of the RFP and related processes that included formulation of an optimal RFP process strategy, preparation of aII RFP documents, coordination of site inspections and conference caAs, review, analysis and assessment of proposers qualifications, business terms and pro-formas, coordination of final interviews, recommendations and management agreement negotiation oversight far a lump surn fee of $19,000.00 plus customary reimbursable expenses estimated not to exceed $6,000.00 plus $10,000.00 in contingency. Walker Parking Consultants have the comprehensive combination of skills necessary to assist the City in the development of the RFP and related processes to select a parking operator for the Western Heritage Parking Garage. MIWBE - A waiver of the goal for MIWBE subcontracting requirements was requested by the Public Events Department and approved by the MIWBE office because the purchase of goods or services from saurce(s}where subcontracting or supplier opportunities are negligible. Funds are available in the Unaudited, Unreserved, Undesignated Fund balance of the Culture and Tourism Fund. The overall project cost is estimated to be: Consulting Services Contingency, Reimbursables Total $19,040.00 $.16,000.00 ~~s,ooo.ao The project is located in COUNCIL DISTRICT 7, but will serve Fort Worth residents in ALL COUNCIL DISTRICTS. FISCAL INFORMATION_I GERTIFCATION: The Financial Management Services Director certifies that upon approval the Unaudited, Unreserved, Undesignated Fund balance of the Culture and Tourism Fund will exceed the minimum reserve as outlined in the Financial Management Policy Statements.
