HomeMy WebLinkAboutOrdinance 23645-05-2019Ordinance No. 23645-05-2019 AN ORDINANCE REVISING ORDINANCE 23392-09-2018, AS AMENDED AND SUPPLEMENTED, TO REALLOCATE $86,000.00 IN THE JUSTICE ASSET FORFEITURE FUND AS A TRANSFER OUT TO THE GRANTS FUND INSTEAD OF THE GENERAL FUND TO PROVIDE BETTER GRANTS ACCOUNTING, TO REDUCE REVENUES FROM TRANSFERS IN THE GENERAL FUND BY $86,000.00 AND TO INCREASE REVENUES IN THE GENERAL FUND FROM TAX REVENUES BY $86,000,00 FROM HIGHER -THAN - BUDGETED RECEIPTS; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That Section 2, "Special Revenue Funds," of Ordinance 23392-09-2018, as amended and supplemented, is hereby further amended to revise the budget for the Justice Asset Forfeiture to re -designate $86,000.00 that was identified as Transfer to General Fund to instead be for Transfer to Grants Fund, as needed, for Police grant match, to provide for better grants accounting. SECTION 2. That Section 1, "Special General Fund," of Ordinance 23392-09-2018, as amended and supplemented, is hereby further amended to reduce the budgeted "Other Interdepartmental Transfers" Revenues by $86,000.00 and to increase budgeted Revenues by $86,000.00 from higher -than -budgeted tax revenues. SECTION 3. That all other provisions of Ordinance 23392-09-2018, as previously amended and supplemented, shall remain in full force and effect unless explicitly amended herein. SECTION 4. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competentjurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 5. That this ordinance shall be cumulative of Ordinance 23392-08-2018 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Authorize the substitution of $43,000.00 previously appropriated in the Justice Asset Forfeiture Fund to serve as the grant match for the Texas Department of Transportation Fiscal Year 2019 Comprehensive Selective Traffic Enforcement Program Grant in place of General Fund dollars that were originally identified for that purpose; and 2. Adopt the attached ordinance revising the Fiscal Year 2019 budget ordinance (Ordinance 23392-09- 2018), as amended and supplemented, to (i) redesignate $86,000.00 in the Justice Asset Forfeiture Fund for transfers to the Grants Fund, as needed, for Police grant match purposes; (ii) reduce Revenues in the General Fund from transfers by $86,000.00; and (iii) increase estimated receipts and appropriations in Revenues in the General Fund by $86,000.00 from higher than budgeted tax revenues. DISCUSSION: The purpose of this Mayor and Council Communication (M&C) is to take actions to make technical budgetary changes regarding the funding of Police grant matching funds to provide for better accounting of funding associated with Police Department grants. In January 2018, the City Council approved the Police Department's application for and acceptance, if awarded, of the Texas Department of Transportation (TxDOT) Fiscal Year 2019 Comprehensive Selective Traffic Enforcement Program ("STEP") with the required local match proposed to come from the General Fund (M&C C-28526). Funds did not get transferred out of the General Fund at that time because the grant had not yet been awarded. In September 2018, the City Council approved the Fiscal Year 2019 budget (Ordinance 23392-09-2018), which included appropriations for the Justice Asset Forfeiture Fund, $86,000.00 of which was identified for "Transfer to General Fund". Staffs intent was for this money to serve as grant matching funds, which is an allowed use under the asset forfeiture regulations. Logname: 35TXDOT2019 COMPREHENSIVE GRANT MATCH Page 1 of 2 Staff has been notified that the STEP grant has been awarded; therefore a transfer to the Grants Fund is needed, Rather than going through two separate steps —transferring funds from the Justice Asset Forfeiture Fund to the General Fund and then transferring funds from the General Fund to the Grants Fund, staff proposes (i) revising the FY19 budget to allow for direct transfer of the $86,000.00 from Justice Asset Forfeiture to the Grants Fund, as needed, in order to provide Police grant matching funds and improved accounting; (ii) maintaining balance in the General Fund by replacing the $86,000.00 that would have come from transferred forfeiture funds with $86,000.00 from higher than budgeted tax revenues; and (iii) explicitly authorizing the use of Justice Asset Forfeiture funding as the source of the match for the previously approved STEP grant. Approval of this M&C and adoption of the attached ordinance will accomplish the changes that staff proposes. It should also be noted that the City Council recently approved an appropriation in the Justice Asset Forfeiture Fund that included an additional $10,000.00 to serve as grant match funding. (M&C G-19515) Following approval of this M&C, a total of $96,000.00 will have been appropriated to -date in the Justice Asset Forfeiture Fund for transfers to the Grants Fund, as needed, to serve as matching funds for Police grants. Following the transfer for the STEP grant, a balance of $53,000.00 of that amount will remain available for other grants. This M&C does not request approval of a contract with a business entity. This M&C serves ALL COUNCIL DISTRICTS. FISCAL INFORMATION /CERTIFICATION: The Director of Finance certifies that funds are available in the Fiscal Year 2019 Operating Budget, as appropriated, of the Justice Asset Forfeiture Fund and that upon approval of the above recommendations, funds will be available in the Grants Operating Federal Fund. This is a reimbursement grant.
