TO CITY SECRETARY CONTRACT No. 44649
WHEREAS, the City of Fort Worth (CITY) and Wade Trim, Inc. ,
(ENGINEER) made and entered into City Secretary Contract No. 44649, (the
CONTRACT) which was authorized by M&C C-26320 on the 9th day of July, 2013
in the amount of $ 524,244 . 00; and
WHEREAS, the CONTRACT was subsequently revised by Amendment Number 1
in the amount of $47, 710. 00 which was administratively authorized on May
12, 2016, Amendment Number 2 in the amount of $574, 992 . 00 which was
authorized by M&C C-28254 on June 6th, 2017; and
WHEREAS, the CONTRACT involves engineering services for the
following project:
Westcliff Drainage Improvements Project; and
WHEREAS, it has become necessary to execute Amendment No. 3 to the
CONTRACT to include an increased scope of work and revised fee.
NOW THEREFORE, CITY and ENGINEER, acting herein by and through their
duly authorized representatives, enter into the following agreement,
which amends the CONTRACT:
1.
Article I of the CONTRACT is amended to include the additional
engineering services specified in a proposal dated April 16th, 2019, a
copy of which is attached hereto and incorporated herein. The cost to
City for the additional design services to be performed by Engineer
totals $836,860. 00. (See Attached Funding Breakdown Sheet, Page -3-)
2.
Article II of the CONTRACT is amended to provide for an increase in
the fee to be paid to Engineer for all work and services performed under
the Contract, as amended, so that the total fee paid by the City for all
work and services shall be an amount of $1,983,806. 00.
3.
All other provisions of the Contract, which are not expressly
amended herein, shall remain in full force and effect.

Re: Westcliff Drainage Improvements Design —Amendment No. 3
Dear Mr. Bennett:
As a follow-up to discussions at our project coordination meetings, we are submitting this request for
Amendment No. 3 to the Westcliff Drainage Improvements design project to provide engineering
services for the next project phase to be implemented by the City as described below. A location map
for the revised project phasing areas is provided on Attachment E.
Our original design contract as amended through Amendment 2 authorized design and construction
services for the upstream Phase 2A Surrey Relief, and Phase 2B Relief Sewers along Suffolk,
Cherokee, and Seminary in advance of the Phase 1 relief sewer, including 30% level concept design
for the Phase 1 Relief Sewers. The Phase 2A sewer has been constructed but not placed into service
pending construction of additional phases to provide an acceptable outlet. The Phase 2B Relief
Sewers were designed, bid, and are currently under construction using an interim outlet to the
existing Suffolk sewer for the Phase 2 project areas pending final design and construction of Phase 1.
Based on our discussions, the City would like to proceed at this time with final design and construction
of the Phase 1 project components along Suffolk, Anita, Manderly and Trail Lake, including the open
channel outlet from Trail Lake to Overton Creek. Completion of Phase 1 will provide the permanent
outlet for the upstream Phase 2A and 2B segments and the additional Phase 1 Relief components.
Amendment No. 3 covers the additional design services to complete final design and construction
services for the Phase 1 project and will integrate utility improvement plans by others for water and
sewer improvements for this area in one bid package. The final design authorization of Phase 1 also
includes an outfall design for the downstream outlet channel and enhanced downstream assessment
of Overton Creek within the park property near the outlet for the area.
Amendment 3 Scope of Services
The scope of services is to follow tasks as outlined and described in Attachment A for design and
construction services. Specific items for the Phase 1 final design, bidding and construction services
are described as follows:

- Complete design, bidding and construction services for the Phase 1 project areas shown on
Attachment E along Suffolk, Anita, Manderly and Trail Lake.
- Identify conflicts with existing utilities that will require utility relocations by others.

- Coordinate design and bid plans with Water and Sewer Department to incorporate planned
improvements by others along the Phase 1 alignment in one bid project.
- Evaluate Trail Creek road crossing requirements and outlet to the existing open drain west of
Trail Creek.
- Conduct hydraulic analysis to confirm adequacy of outfall for discharge to Overton Creek.
- Update cost estimates based on revised plans.
- Identify any easements or right-of-way anticipated.
- Complete the following tasks as described in Attachment A Phase 1 project areas:

Budget Amendment Request
To complete the Amendment No. 3 scope of work items, we request a design authorization in the
amount of$836,860.
A cost and man-hour breakdown by task for Amendment No. 3 is provided in Attachment B. The
budget amount includes services by our subconsultants in the amount of$140,445, with $117,245
MBE/SBE [for Pacheco Koch (PK), Rios, Alliance Geotechnical Group (AGG) and Westra], and
$23,200 non-MBE/SBE [for Schnabel and Cox-McClain]. The MBE/SBE amount represents 14% of
the Amendment No. 3 budget amount.
Schedule
The City is programming bidding and construction of the Phase 1 project for Fiscal Year 2019-2020
with construction to begin in April 2020; this requires the project design be completed and ready for
bidding in February 2020.

Scope for Engineering Design Related Services for Storm Water Improvements Projects
The scope set forth herein defines the work to be performed by the ENGINEER in
completing the project. Both the CITY and ENGINEER have attempted to clearly define the
work to be performed and address the needs of the Project. Under this scope, "ENGINEER"
is expanded to include any sub-consultant, including surveyor, employed or contracted by
the ENGINEER.
OBJECTIVE
The objective of this project is to relieve flooding in the Westcliff South Drainage Basin, and
thereby also relieve crossover flooding from the South to the North Basin. Scope includes
design and construction of Phase 1 drainage improvements along portions of Suffolk, Anita,
Manderly, and Trail Lake; analysis of potential downstream and environmental impacts at
the outfall; and design and construction of outfall improvements for the full relief sewer
ultimate condition. Refer to Attachment E— Location Map.

TASK 1. DESIGN MANAGEMENT.
ENGINEER will manage the work outlined in this scope to ensure efficient and effective use
of ENGINEER's and CITY's time and resources. ENGINEER will manage change,
communicate effectively, coordinate internally and externally as needed, and proactively
address issues with the CITY's Project Manager and others as necessary to make progress
on the work.
Basic Services for Task 1 will be compensated on a fixed fee basis and include:

clarify scope, understand CITY objectives, and ensure economical and functional
designs that meet CITY requirements.
• Conduct and document monthly project update meetings with CITY Project Manager.
Update monthly project documents including Project Status Report and Risk Register
• Conduct review meetings with the CITY at the end of each design phase.
• Prepare invoices, in accordance with Attachment B to this Standard Agreement and
submit monthly in the format requested by the CITY.
• Prepare and submit monthly progress reports in the format provided by the respective
CITY Department.
• Prepare and submit baseline Project Schedule initially, and Project Schedule updates
with a schedule narrative monthly, as required in Attachment D to this Standard
Agreement and according to the City of Fort Worth's Schedule Guidance Document.
• Complete Monthly M/WBE Report Form and Final Summary Payment Report Form at
the end of the project.
• Coordinate with other agencies and entities as necessary for the design of the
proposed infrastructure, and provide and obtain information needed to prepare the
design.
• With respect to coordination with permitting authorities, ENGINEER shall
communicate with permitting authorities such that their regulatory requirements are
appropriately reflected in the designs. ENGINEER shall work with regulatory
authorities to obtain approval of the designs, and make changes necessary to meet
their requirements, as part of the design scope.
• Personnel and Vehicle Identification: When conducting site visits to the project
location, the ENGINEER or any of its sub-consultants shall carry readily visible
information identifying the name of the company and the company representative.

TASK 2. CONCEPTUAL DESIGN (30 PERCENT).
The Conceptual Design shall be submitted to CITY per the approved Project Schedule.
The purpose of the conceptual design is for the ENGINEER to identify, develop,
communicate through the defined deliverables, and recommend the design concept that
successfully addresses the design problem, and to obtain the CITY's endorsement of this
concept. ENGINEER will utilize concepts and criteria contained in the current CITY— iSWM
Criteria Manual for Site Development and Construction for conceptual planning and design.
ENGINEER will develop the conceptual design of the infrastructure for the outfall
improvements as follows
Basic Services for Task 2.2 will be compensated on a fixed fee basis, if authorized, and
include:
2.2. Drainage Computations
• ENGINEER will prepare and submit a conceptual design for Step Pool Outfall
Channel Improvements, if such a design is requested by CITY or by another
permitting agency, such as the US Army Corps of Engineers. The ENGINEER's
responsibility includes recommendations for improvements of the existing system
as deemed reasonable and consistent with CITY standards.
Basic Services for Task 2.3 will be compensated on a fixed fee basis and include:
2.3. Subsurface Utility Engineering
Provide Subsurface Utility Engineering (SUE)to Quality Level B, and Quality Level A at
select locations as described below. The SUE shall be performed in accordance with
Cl/ASCE 38-02.
Quality Level D
• Conduct appropriate investigations (e.g., owner records, County/CITY records,
personal interviews, visual inspections, etc.), to help identify utility owners that
may have facilities within the project limits or that may be affected by the project.
• Collect applicable records (e.g., utility owner base maps, "as built" or record
drawings, permit records, field notes, geographic information system data, oral
histories, etc.)on the existence and approximate location of existing involved
utilities.
• Review records for: evidence or indication of additional available records;
duplicate or conflicting information; need for clarification.
• Develop SUE plan sheets and transfer information on all involved utilities to
appropriate design plan sheets, electronic files, and/or other documents as
required. Exercise professional judgment to resolve conflicting information. For
information depicted, indicate: utility type and ownership; date of depiction;

quality level(s); end points of any utility data; line status (e.g., active, abandoned,
out of service); line size and condition; number of jointly buried cables; and
encasement.
Quality Level C (includes tasks as described for Quality Level D)
• Identify surface features, from project topographic data and from field
observations, that are surface appurtenances of subsurface utilities.
• Include survey and correlation of aerial or ground-mounted utility facilities in
Quality Level C tasks.
• Survey surface features of subsurface utility facilities or systems.
• The survey shall also include (in addition to subsurface utility features visible at
the ground surface): determination of invert elevations of any manholes and
vaults; sketches showing interior dimensions and line connections of such
manholes and vaults; any surface markings denoting subsurface utilities,
furnished by utility owners for design purposes.
• Exercise professional judgment to correlate data from different sources, and to
resolve conflicting information.
• Update (or prepare) plan sheets, electronic files, and/or other documents to
reflect the integration of Quality Level D and Quality Level C information.
• Recommend follow-up investigations (e.g., additional surveys, consultation with
utility owners, etc.) as may be needed to further resolve discrepancies.
• Provide Quality Level C to identify overhead utilities on the project and provide
the overhead utility information on the SUE plan sheets.
Level B (includes tasks as described for Quality Level C)
• Select and apply appropriate surface geophysical method(s)to search for and
detect subsurface utilities within the project limits, and/or to trace a particular
utility line or system.
• Based on an interpretation of data, mark the indications of utilities on the ground
surface for subsequent survey. Utilize paint or other method acceptable for
marking of lines.
• Unless otherwise directed, mark centerline of single-conduit lines, and outside
edges of multi-conduit systems.
• Resolve differences between designated utilities and utility records and surveyed
appurtenances.
• Recommend additional measures to resolve differences if they still exist.
Recommendations may include additional or different surface geophysical
methods, exploratory excavation, or upgrade to Quality Level A data.
• As an alternative to the physical marking of lines, the ENGINEER may, with
CITY's approval, utilize other means of data collection, storage, retrieval, and
reduction, that enables the correlation of surface geophysical data to the project's
survey control.
Level A
• Expose and locate utilities at specific locations.
• Tie horizontal and vertical location of utility to survey control.
• Provide utility size and configuration.
• Provide paving thickness and type, where applicable.

• Provide general soil type and site conditions and such other pertinent information
as is reasonably ascertainable from each test hole site.
Basic Services for Task 2.4 will be compensated on a fixed fee basis, if authorized, and
include:
2.4. The Conceptual Design Package, if authorized through Task 2.2, shall include the
following:
• Written summary of alternative design concepts considered, strengths and
weaknesses of each, and the rationale for selecting the recommended design
concept.
• Plan sheets showing the proposed Step Pool Outfall Channel Improvements
• Revised Conceptual iSWM Checklist in accordance with the current iSWM
Criteria Manual for Site Development and Construction. Include documentation
that the proposed storm water project will not impact upstream and downstream
properties.
• SUE Plan sheets sealed by a licensed professional engineer registered in the
State of Texas.
• Proposed phasing of water, sanitary sewer, street and drainage work
documented in both the project schedule and narrative form.
• Revised Documentation of key design decisions (Project Decision Log).
• Revised Estimates of probable construction cost.
ASSUMPTIONS
• All storm water calculations and design shall be derived from and based on the
previously-approved InfoWorks SD model, which was developed during the study
phase of this project. The model will be updated to reflect the current design.
Project design will follow the current CITY iSWM Criteria Manual for Site
Development and Construction. Any deviations from the Manual will need
approval from the CITY before proceeding.
• All storm water calculations and design shall conform to the current CITY iSWM
Criteria Manual for Site Development and Construction except as noted above.
• The SUE and SUE plan sheets shall be in accordance with Cl/ASCE 38-02.
Level A& B SUE obtained during previous Phase 213 will be updated for Level A
& B SUE in the following locations:
• Newly-installed communications line running along the East side of Trail Lake
Drive where the line crosses the proposed storm sewer. (Level A)
• Within the limits of the additional survey to be obtained for the analysis and
design of outfall improvements. (Level A & B)

TASK 3. PRELIMINARY DESIGN (60 PERCENT).
Preliminary plans shall be submitted to CITY per the approved Project Schedule.
ENGINEER will develop the preliminary design of the infrastructure as follows.
Basic Services for Task 3 will be compensated on a fixed fee basis and include:
3.1. Development of Preliminary Design Drawings shall include the following:
• Cover Sheet
• Drainage area maps showing proposed improvements with drainage calculations
and hydraulic computations in accordance with the current iSWM Criteria Manual
for Site Development and Construction.
• A Project Control Sheet, showing all Control Points, used or set while gathering
data. Generally on a scale of not less than 1:400. The following information shall
be indicated for each Control Point: Identified (existing City Monument#8901, PK
Nail, 5/8" Iron Rod); X, Y and Z Coordinates, in an identified coordinate system,
and a referred bearing base. Z coordinate on City Datum only; descriptive location
(i.e. set in the centerline of the inlet in the South curb line of North Side Drive at the
East end of radius at the Southeast corner of North Side Drive and North Main
Street).
• Overall project easement layout sheet(s).
• SUE plan drawings.
• Preliminary iSWM Checklist in accordance with the current iSWM Criteria Manual
for Site Development and Construction
• Plan and profile drawings of proposed storm water improvements, including
existing lot layout with property ownership, streets, curb lines, driveways,
medians (if applicable), sidewalks, existing and proposed water and sanitary
sewer mains, existing utilities gathered during the SUE and existing utility
easements within the project limits.
• No less than two bench marks per plan/profile sheet.
• The ENGINEER will prepare standard and special detail sheets that are not
already included in the City's standard details. These may include connection
details between various parts of the project, tunneling details, boring and jacking
details, waterline relocations, details unique to the construction of the project,
trenchless details, and special service lateral reconnections.
• The ENGINEER will update the Downstream Assessment previously conducted,
as outlined below:
1. Review existing hydrologic and hydraulic (1 D) models for the Overton
Creek Watershed obtained from the CITY.
2. At the request of the CITY, provide a general review of hydrologic
assumptions made in the Overton Study existing conditions (1 D) model as

compared to the InfoWorks SD existing conditions analysis for overall
consistency.
3. Utilize the Westcliff pre-and post-project outfall hydrographs from the
InfoWorks SD model to update the Overton Creek existing conditions
hydrologic model (1 D)for the 1-, 5-, and 100-year storm events, and
calculate peak flows. All other Overton tributary area flow inputs will be
taken as currently developed in the existing Overton Model.
4. Analyze the updated peak flows from the revised 1 D hydrologic model in
the existing Overton hydraulic model (1 D)to determine the water surface
elevation impacts for the 1-, 5-, and 100-year storm events.
5. Summarize analysis and results in a concise technical memorandum.
6. Conduct up to two (2) meetings with the CITY to discuss modeling
approach and review comments.
7. Revise analysis based on meetings and review comments from the CITY
and provide final models and memorandum to document the analysis.
• The CITY will provide the following items for use in the Downstream Assessment:
1. The existing 1 D hydrologic and hydraulic models for the Overton Creek
watershed, and the specific HEC-HMS and HEC-RAS input files to be used
for the existing conditions analysis.
2. Any updates made to the Overton Creek Watershed study report and
exhibits previously provided for use in the analysis.
3.2. Geotechnical Investigation/Pavement Design
• The ENGINEER shall obtain pavement cores where it deems appropriate, with
CITY approval, and perform testing on the cores as needed to aid in trench repair
and paving design.
• Testing will include compressive strength testing of concrete cores where
concrete pavement is encountered.
• The ENGINEER shall incorporate information acquired from the pavement core
testing into the plans and specifications, as requested by the CITY.
3.3 Constructability Review
• Prior to the 60 percent review meeting with the CITY, the ENGINEER shall
schedule and attend a project site visit with the CITY Project Manager and
Construction personnel to walk the project. The ENGINEER shall summarize the
CITY's comments from the field visit and submit this information to the CITY in
writing.
3.4 Public Meeting
• After the preliminary plans have been reviewed and approved by the CITY, the
ENGINEER shall prepare project exhibits, and attend public meeting to help
explain the proposed project to residents. The CITY shall select a suitable
location and mail the invitation letters to the affected customers. The ENGINEER

shall coordinate with CITY GIS staff to identify affected property owners/residents
and develop a spreadsheet listing addresses of those to invite to the public
meeting.
3.5 Utility Clearance
• The ENGINEER will consult with the CITY's Transportation and Public Works
Department, Water Department, and other CITY departments, public utilities,
private utilities, and government agencies to determine the approximate location
of above and underground utilities, and other facilities (current and future) that
have an impact or influence on the project. ENGINEER will design CITY facilities
to avoid or minimize conflicts with existing utilities, and where known and
possible consider potential future utilities in designs.
• The ENGINEER shall upload individual DWF files for each plan sheet of the
approved preliminary plan set to the designated project folder in Buzzsaw for
forwarding to all utility companies which have facilities within the limits of the
project. The DWF files should be created directly from the CAD files as opposed
to PDF files.
3.7 Traffic Control Plan
• Develop a traffic control plan utilizing standard traffic reroute configurations
posted as "Typicals" on the CITY's Buzzsaw website. The typicals need not be
sealed individually, if included in the sealed contract documents.
• Develop supplemental traffic control drawings as needed for review and approval
by the Traffic Division of the Transportation and Public Works Department.
These drawings shall be sealed by a professional engineer registered in the
State of Texas.
• Develop a recommended staging plan to minimize road closures and impacts to
homeowners in the project area. The staging plan will be incorporated as part of
the traffic control plan.
ASSUMPTIONS
• All storm water calculations and design shall be derived from and based on the
previously-approved InfoWorks SD model, which was developed during the study
phase of this project. The model will be updated to reflect the current design.
Project design will follow the current CITY iSWM Criteria Manual for Site
Development and Construction. Any deviations from the Manual will require
approval from the CITY before proceeding.
• No InfoWorks 2D modeling of the downstream outfall channel and Overton Creek
and contributing drainage areas will be required.
• No mitigation of adverse impacts in the Overton Creek floodplain will be required
beyond concrete energy dissipators or the Step Pools improvements mentioned
in Task 2.2.
• All storm water calculations and design shall conform to the current CITY iSWM
Criteria Manual for Site Development and Construction except as noted above.

• Seven (7) pavement cores will be provided.
• Traffic Control "Typicals" will be utilized to the extent possible. It is assumed an
additional 2 project specific traffic control sheets will be developed.

• Following a 90% construction plan review meeting with the CITY, the ENGINEER
shall submit Final Plans (100%)to the CITY per the approved Project Schedule.
Each plan sheet shall be stamped, dated, and signed by the ENGINEER
registered in State of Texas.
4.2 Public Meeting
• After the final plans have been reviewed and approved by the CITY, the
ENGINEER shall prepare project exhibits, and attend public meeting to help
explain the proposed project to residents. The CITY shall select a suitable
location and mail the invitation letters to the affected customers. CITY GIS staff
will identify affected property owners/residents and develop a spreadsheet listing
addresses of those to invite to the public meeting.
ASSUMPTIONS
• All storm water calculations and design shall be derived from and based on the
previously-approved InfoWorks SD model, which was developed during the study
phase of this project. The model will be updated to reflect the current design.
Project design will follow the current CITY iSWM Criteria Manual for Site
Development and Construction. Any deviations from the Manual will need
approval from the CITY before proceeding.
• All storm water calculations and design shall conform to the current CITY iSWM
Criteria Manual for Site Development and Construction except as noted above.
• 14 half size (11" x 17") and 2 specifications will be delivered for the 90% design.
• A DWF file for the 90% Design will be created from design CAD drawings and

Basic Services for Task 5 will be compensated on a fixed fee basis and include:
5.1. Bid Support
• The ENGINEER shall upload all plans and contract documents onto Buzzsaw for
access to potential bidders.
• Contract documents shall be uploaded in a .xIs file.
• Unit Price Proposal documents are to be created utilizing CFW Bidtools only
and combined in a specified spreadsheet workbook, Bid Proposal Worksheet
Template, and will be populated and configured so that all pages are
complete and the Summary Worksheet(s) in the workbook detail and
automatically summarize the totals from the inserted Unit Price Proposal
document worksheets.
• Plan Sets are to be uploaded to Buzzsaw in two formats, .pdf and AM files.
The .pdf will consist of one file of the entire plan set. The Awf will consist of
individual files, one for each plan sheet, and will be numbered and named in
a manner similar to that of the plan set index.
• The ENGINEER shall sell contract documents and maintain a plan holders list on
Buzzsaw from documents sold and from Contractor's uploaded Plan Holder
Registrations in Buzzsaw.
• The ENGINEER will develop and implement procedures for receiving and
answering bidders' questions and requests for additional information. The
procedures shall include a log of all significant bidders questions and requests
and the response thereto. The log shall be housed and maintained in the
project's Buzzsaw folder titled Request for Information. The ENGINEER will
provide technical interpretation of the contract bid documents and will prepare
proposed responses to all bidder's questions and requests, in the form of
addenda. The ENGINEER shall upload all approved addenda onto Buzzsaw and
mail addenda to all plan holders.
• Attend the prebid conference in support of the CITY.
• Assist the CITY in determining the qualifications and acceptability of prospective
contractors, subcontractors, and suppliers.
• When substitution prior to award of contracts is allowed in the contract
documents, the ENGINEER will advise the CITY as to the acceptability of
alternate materials and equipment proposed by bidders.
• Attend the bid opening in support of the CITY.
• Tabulate and review all bids received for the construction project, assist the CITY
in evaluating bids, and recommend award of the contract. A copy of the Bid
Tabulation and the CFW Data Spreadsheet created utilizing CFW Bidtools only
are to be uploaded into the project's Bid Results folder on Buzzsaw.
• Assist the CITY with assembling and awarding contracts for construction,
materials, equipment, and services.
• Incorporate all addenda into the contract documents and issue conformed sets.

6.1 Construction Support
• The ENGINEER shall attend the preconstruction conference.
• After the pre-construction conference, the ENGINEER shall provide project
exhibits and attend public meeting to help explain the proposed project to
residents. The CITY shall select a suitable location and mail the invitation letters
to the affected customers.
• The ENGINEER shall visit the project site at requested intervals as construction
proceeds to observe and report on progress.
• The ENGINEER shall review shop drawings, samples and other submittals
submitted by the contractor for general conformance with the design concepts and
general compliance with the requirements of the contract for construction. Such
review shall not relieve the Contractor from its responsibility for performance in
accordance with the contract for construction, nor is such review a guarantee that
the work covered by the shop drawings, samples and submittals is free of errors,
inconsistencies or omissions. The ENGINEER shall log and track all shop
drawings, samples and other submittals in Buzzsaw.

• As requested by the CITY, the ENGINEER shall provide necessary interpretations
and clarifications of contract documents, review change orders, and make
recommendations as to the acceptability of the work.
• The ENGINEER shall attend the "Final' project walk through and assist with
preparation of final punch list.
• The ENGINEER shall provide Construction Support services for the Phase 2B
segment of the overall project (Suffolk Drive from Granbury Road to Stadium
Drive, Cherokee Trail from Standish Road to Surrey Street, and W Seminary Drive
from Harwen Terrace to Surrey Street). Construction Support services for Phase
2B will include specific tunnel-related services agreed upon with the CITY.
• The CITY shall allocate funds to replenish Construction Support budget from the
previous amendment of this contract (Amendment 2) which ENGINEER was
requested to utilize to expedite the Environmental investigation at the outfall for
this amendment. The ENGINEER shall provide Construction Support for the
"Westcliff Drainage Improvements, Phase 2B: Suffolk Drive, Cherokee Trail, and
W Seminary Drive" project, to include the above-mentioned activities.
6.2 Record Drawings
• The ENGINEER shall prepare record drawings from information provided by the
CITY depicting any changes made to the Final Drawings during construction.
The following information shall be provided by the CITY:
o As-Built Survey
o Red-Line Markups from the Contractor
o Red-Line Markups from City Inspector
o Copies of Approved Change Orders
o Approved Substitutions
• The ENGINEER shall modify the Final Drawings electronically and shall place a
stamp on the plans indicating that they represent Record Drawings of the project
as constructed. The stamp shall be signed and dated by the ENGINEER and
shall be placed on each plan sheet, whether there are any revisions on the sheet
or not. Each sheet shall clearly indicate all changes which apply to that sheet by
clouding and numbering, or other suitable means.
• The following disclaimer shall be included with the Record Drawing stamp:
o These Record Drawings were prepared using information provided by
others and represent the as constructed conditions to the extent that
documented changes were provided for recording. The ENGINEER
assumes no liability for undocumented changes and certifies only that the
documented changes are accurately depicted on these drawings.
• The ENGINEER shall submit a set of sealed Final Drawings, modified and
stamped as Record Drawings, on mylar for record storage. The ENGINEER may
keep copies of the information provided by the CITY for their files, but all original
red-lined drawings shall be returned to the CITY with the mylars.

ENGINEER will support and perform activities related to ROW and easements as outlined
below, per scoping direction and guidance from the CITY's Project Manager.
Basic Services for Task 7 will be compensated on a fixed fee basis and include:
7.1. Right-of-Way Research
• The ENGINEER shall determine rights-of-way and easement needs for
construction of the project. Required temporary and permanent easements will
be identified based on available information and recommendations will be made
for approval by the CITY.
7.2 Right-of-Way/Easement Preparation and Submittal.
• The ENGINEER shall prepare documents to be used to obtain right-of-way and
permanent and/or temporary easements required to construct the improvements.
• The documentation shall be provided in conformance with the checklists and
templates available on the CITY's Buzzsaw site.
7.3 Temporary Right of Entry Preparation and Submittal
• Prior to construction, the ENGINEER shall prepare, mail and obtain Temporary
Right of Entries from landowners. It is assumed that letters will only be required
for land owners adjacent to temporary construction easements or who are
directly affected by the project and no easement is required to enter their
property.
• The documentation shall be provided in conformance with the checklists and
templates available on the CITY's Buzzsaw site.
7.4 Parks Conversion
• The ENGINEER shall determine the limits of property which must go through the
"Parks Conversion" process to delineate and allow for non-parks use of park
property.
• The ENGINEER shall prepare a metes & bounds description of the property to be
converted, to be utilized by the CITY.
• The ENGINEER shall attend two (2) Parks Board meetings, and one (1) City
Council meeting to aid the CITY in obtaining the necessary internal
authorizations to proceed with the conversion process.
• The ENGINEER shall prepare a presentation exhibit for the above-mentioned
meetings, to be utilized by the CITY.
• The documentation shall be provided in conformance with the checklists and

ASSUMPTIONS
• Right-of-Way research includes review of property/right-of-way records based on
current internet based Tarrant Appraisal District (TAD) information available at
the start of the project and available on-ground property information (i.e. iron
rods, fences, stakes, etc.). It does not include effort for chain of title research,
parent track research, additional research for easements not included in the
TAD, right-of-way takings, easement vacations and abandonments, right-of-way
vacations, and street closures.

TASK 8. SURVEY.

8.1 Design Survey
• ENGINEER will perform field surveys to collect horizontal and vertical elevations
and other information needed by ENGINEER in design and preparation of plans
for the project. Information gathered during the survey shall include topographic
data, utilities as required by the SUE, structures, trees (measure caliper, identify
overall canopy, and have qualified arborist identify species of trees), and other
features relevant to the final plan sheets. Existing drainage at intersections will
be verified by field surveys. Spot elevations will be shown on intersection layouts
with cross slope to fit intersecting grade lines.
• The minimum survey information to be provided on the plans shall include the
following:
— A Project Control Sheet, showing ALL Control Points, used or set while
gathering data. Generally on a scale of not less than 1:400:
— The following information about each Control Point;
a. Identified (Existing. CITY Monument#8901, PK Nail, 5/8" Iron Rod)
b. X, Y and Z Coordinates, in an identified coordinate system, and a
referred bearing base. Z coordinate on CITY Datum only.
c. Descriptive Location (Ex. Set in the centerline of the inlet in the South
curb line of North Side Drive at the East end of radius at the Southeast

8.2. Temporary Right of Entry Preparation and Submittal
• Prior to entering property for field survey, the ENGINEER shall prepare, mail and
obtain Temporary Right of Entry from landowners.
• The documentation shall be provided in conformance with the checklists and
templates available on the CITY's Buzzsaw site.
8.3. Construction Survey
• The construction survey/staking and as-built survey will be provided by the CITY
or Contractor.
• ENGINEER shall be available to the CITY on matters concerning the layout of the
project during its construction.
ASSUMPTIONS
• The tree survey required for the Parks Conversion process is limited to the area of
the property impacted by construction activities. For this project, this area will be
contained within the subject tract property boundaries from the headwall of the
outfall pipe to a point approximately 600 feet along the outfall channel.
• The construction survey/staking and as-built survey will be provided by the CITY
or Contractor.

TASK 9. PERMITTING.

• For projects that disturb an area greater than one (1) acre, the contractor will be
responsible for preparing and submitting the Storm Water Pollution Prevention
Plan (SWPPP)with appropriate regulatory agencies. The ENGINEER will
prepare the iSWM Construction Plan according to the current CITY iSWM
Criteria Manual for Site Development and Construction with will be incorporated
into the SWPPP by the contractor.
9.2. Environmental Services

determine there are no impacts to the Overton Creek floodplain requiring any
additional mitigation to the floodplain beyond improvements provided with the
outlet channel design, and the mitigation bank credit purchase to be paid for by
the City.

ADDITIONAL SERVICES NOT INCLUDED IN THE EXISTING SCOPE OF SERVICES
Additional Services not included in the existing Scope of Services --CITY and
ENGINEER agree that the following services are beyond the Scope of Services
described in the tasks above. However, ENGINEER can provide these services, if
needed, upon the CITY's written request. Any additional amounts paid to the
ENGINEER as a result of any material change to the Scope of the Project shall be
agreed upon in writing by both parties before the services are performed. These
additional services include the following:
• Negotiation of easements or property acquisition.
• Services related to development of the CITY's project financing and/or budget.
• Services related to disputes over pre-qualification, bid protests, bid rejection
and re-bidding of the contract for construction.
• Construction management and inspection services
• Performance of materials testing or specialty testing services.
• Services necessary due to the default of the Contractor.
• Services related to damages caused by fire, flood, earthquake or other acts of
God.

Lump Sum Project
I. Compensation
A. The ENGINEER shall be compensated a total lump sum fee of $836,860 as
summarized in Exhibit B-1 — Engineer Invoice and Section IV— Summary of Total
Project Fees. The total lump sum fee shall be considered full compensation for
the services described in Attachment A, including all labor materials, supplies,
and equipment necessary to deliver the services.
B. The ENGINEER shall be paid monthly payments as described in Section II -
Method of Payment.
II. Method of Payment
A. Partial payment shall be made to the ENGINEER monthly upon City's approval of
an invoice prepared and submitted by the ENGINEER in the format and including
content as presented in Exhibit B-1, Progress Reports as required in item III. of
this Attachment B, and Schedule as required in Attachment D to this Agreement.
B. The estimated current physical percent complete as required on the invoice shall
be calculated from the progress schedule as required in Attachment D to this
Standard Agreement and according to the current version of the City of Fort
Worth's Schedule Guidance Document.
C. The cumulative sum of such monthly partial fee payments shall not exceed the
total current project budget including all approved Amendments.
D. Each invoice shall be verified as to its accuracy and compliance with the terms of
this Agreement by an officer of the ENGINEER.
III. Progress Reports
A. The ENGINEER shall prepare and submit to the designated representative of the
Transportation and Public Works Department, Stormwater Management Division,
monthly progress reports and schedules in the format required by the City.

PROJECT SCHEDULE
A. ENGINEER Project Schedule Development
ENGINEER shall prepare a project schedule for the services to be provided in fulfilling
the requirements of the Agreement and encompassing the Scope of Work defined in
Attachment A to the Agreement.
ENGINEER shall prepare and maintain project schedule throughout the life of the project
as defined in the Agreement in compliance with the City's Specification 00 31 15 entitled
Engineer Project Schedule.
ENGINEER's project schedule will follow the Critical Path Methodology (CPM) for
planned sequencing of the work activity and timing of the work.
B. Schedule "Tier" Selection
City has identified three "Tier" levels for project schedules as defined in City's
Specification 00 31 15, to align with the size and complexity of the project as a basis for
schedule development. City's Project Manager will determine the "Tier" level for the
ENGINEER's project schedule as part of the negotiation of the Agreement.
C. Project Baseline Schedule
ENGINEER will produce an initial project schedule and submit as a "baseline" for review
and acceptance by City's Project Manager as defined in City's Specification 00 31 15
which will be referred to as the Project Baseline Schedule. Updates to the baseline
schedule follow the requirements of City's Specification 00 31 15.
D. Project Progress Schedule
ENGINEER will provide to the City, monthly updates to their project schedule indicating
progress of the Work in compliance with the requirements of City's Specification 00 31
15 and said schedule will be referred to as the Project Progress Schedule.
E. Master Project Schedule
City will develop and maintain a master project schedule for the overall project.
ENGINEER's project baseline and progress schedule submittals will be an integral part
of the development and updating process of City's Master Project Schedule.

Re: Westcliff Drainage Improvements Outfall Environmental Assessment
Dear Mr. Bennett:
Wade Trim is pleased to submit this cost proposal and scope to provide Section 404 of the
Clean Water Act permitting for the proposed Westcliff South Drainage Improvements Project
Phase I in the City of Fort Worth, Tarrant County, Texas. The City of Fort Worth proposes to
construct two-4-foot x 6-foot reinforced concrete box culverts at Trail Lake Drive to discharge
storm water onto an approximately 1.06 acre tract of land (Tarrant County Appraisal District
Account Number 41434897). Proposed improvements to this tract include channel shaping and
installation of energy dissipaters. This tract drains to an unnamed tributary to the Clear Fork
Trinity River. Based on a preliminary data search, waters of the U.S. may be located on-site.
The preliminary plans indicate that construction of the proposed project may include the
placement of fill materials into waters of the U.S. which may require permit authorization from
the Fort Worth District-U.S. Army Corps of Engineers (USACE)for these activities. Coordination
with the Fort Worth District-USACE Regulatory Office is anticipated.
Scope of Work—Section 401/404 of the Clean Water Act USACE Permitting
Waters of the U.S., including Wetlands, Delineation and Determination
This task will include a review of readily available aerial photography and published data for the
1.06-acre tract, including U.S. Geological Survey (USGS)topographic maps, National Wetland
Inventory (NWI), National Hydrography Dataset(NHD), and United States Department of
Agriculture (USDA) soils maps. This task also includes field reconnaissance of the tract to
determine the extent of potentially jurisdictional wetlands and other waters of the U.S. that may
be subject to Section 401/404 of the Clean Water Act. Preliminary plans indicate that
construction activities may include the placement of fill materials into on-site aquatic features.
These activities could be subject to Section 401/404 of the Clean Water Act and require
coordination with the USACE. The following tasks are presented to address these potential
requirements.
The WOUS Delineation/Determination will be performed by qualified wetland ecologists. The
WOUS Delineation/Determination will be based on the professional judgment of CMEC, its use
of the USACE 1987 manual (as modified by the Interim Regional Supplement to the USACE
Wetland Delineation Manual: Great Plains Region, Version 2.0, March 2010), and it is
understood that final authority over the delineation of waters of the U.S. lies with the appropriate
federal agency.

Preliminary Jurisdictional Determination (PJD) Report
After completion of the WOUS Delineation/Determination, a PJD Report will be prepared.
Potentially jurisdictional areas will be described in the text of the report and will be graphically
depicted on aerial photography and other base data to give the USACE an understanding of the
potentially jurisdictional areas. Wade Trim will submit the PJD Report to the City for review and
minor comments (one revision assumed). The requested minor revisions will be made based
upon the City's review of the PJD Report. Wade Trim may submit the Final PJD Report to the
Fort Worth District m USACE, if requested by the City.
USACE NWP Pre-Construction Notification (PCN) (If Needed)
This Task is for preparing and submitting, to the USACE, a permit application/request for
authorization under the NWP program. It is likely that the project may be authorized by NWP 12
which authorizes the placement of dredged or fill material into WOUS for the construction,
maintenance, repair, and removal of utility lines and associated facilities. Discharges generally
cannot cause the loss of greater than 0.50-acre of waters of the U.S. or more than 300 linear
feet of stream bed (a waiver may be requested for greater than 300 linear feet of ephemeral or
intermittent stream bed). A PCN is required to be submitted to the USACE prior to commencing
the activity if any of the following criteria are met:
• The activity involves mechanized land clearing in a forested wetland for the utility line
right-of-way.
• A section 10 permit is required,
• The utility line in waters of the United States, excluding overhead lines, exceeds 500
feet.
• The utility line is placed within a jurisdictional area (i.e., water of the United States), and
it runs parallel to or along a stream bed that is within that jurisdictional area.
• Discharges that result in the loss of greater than 1/10-acre of waters of the United
States.
• Permanent access roads are constructed above grade in waters of the United States for
a distance of more than 500 feet.
• Permanent access roads are constructed in waters of the United States with impervious
materials.
The USACE would require that the Applicant show avoidance and minimization of impacts to
aquatic resources. Compensatory mitigation for unavoidable impacts to waters of the U.S. is not
typically required for permanent impacts that are less than 0.10 acre in size. It is expected that
any required compensatory mitigation for proposed unavoidable losses to waters of the U.S.
can be accomplished with the purchase of mitigation bank credits. However, the availability and
pricing of credits is market based. The City is responsible for fees associated with bank credit
purchases. Additional mitigation strategies can be studied under a separate scope of work.
If needed, a USACE NWP PCN will be prepared for the proposed project. Wade Trim
anticipates providing, at a minimum, the following information in the permit application:
• Permit Application Contents,
• Proposed Preliminary Jurisdictional Determination Report(Task 2),
• Project Description (input from Design Engineer will be necessary),
• Purpose and Need (input from Design Engineer will be necessary),

• Alternatives Analysis (input from Design Engineer will be necessary),
• Plan, Profile, and other CAD Drawings (input from Design Engineer will be necessary),
• Conceptual Mitigation Plan (Mitigation Bank Credits), if necessary,
• Threatened and Endangered species information from readily available databases, and
• Cultural Resources information from readily available databases.
The PCN Application will be submitted to the City for review and minor comments (one revision
is assumed). Minor revisions based upon the City's review of the Application will be made, and
Wade Trim will submit the Final PCN Application to the Fort Worth District— USACE.
Assumptions
• This scope assumes that the guidance documents specifically cited will be used to
generate the necessary environmental deliverables. If new guidance is released by any
agency with jurisdiction over the proposed project, it may be necessary to amend this
scope of services to account for updated guidance. Regulatory changes affecting the
scope of services will also require an amendment to the scope.
• These Tasks are based on the ability to receive authorization under the current NWP
Program (2017-2021).
• These tasks assume that ordinary and reasonable measures to meet the required
compensatory mitigation requirements will be achievable with the purchase of mitigation
bank credits, if necessary.
• If the USACE does not accept the purchase of mitigation bank credits in lieu of on-site
mitigation, additional services will be required to fulfill the mitigation requirements.
• It shall be the City's responsibility to obtain (purchase) the required mitigation bank
credits.
• An intensive archeological/cultural resource survey will not be required. If the USACE
requests an archeological survey, the engineer may provide this service under a
separate scope of work.
• The City will provide right-of-entry to the project area.
Fee and Schedule
The Section 401/404 of the Clean Water Act USACE Permitting Scope of Services described
above will be conducted for the following lump sum fee:
Waters of the U.S., including Wetlands, Delineation and Determination = $2,200.00
Preliminary Jurisdictional Determination (PJD) Report = $4,400.00
USACE NWP Pre-Construction Notification (PCN)(If Needed) _ $5,500.00

It is our understanding that the City of Fort Worth is requesting Wade Trim to provide a proposal
for geotechnical and tunnel consulting construction phase services for the construction of the
Phase 2B Westcliff Drainage Improvements.
The tunnel portion of the Phase 26 alignment consists of approximately 181 linear feet of 90-
inch diameter steel casing pipe to be installed under a roadway and railroad.
Our specific geotechnical and tunnel consulting services are anticipated to include:
• Review of construction submittals required in the tunnel specification. These include
qualifications, detailed descriptions of the means and methods for the tunneling
operations, details for the construction and support of the pits, settlement mitigation plan,
instrumentation and monitoring plan, instrumentation readings, details for contact
grouting, daily reports, and pre-and post-construction inspections. This includes
preparing comments on the submittals and performing review of re-submittals as
required.
• A site visit at the start of tunnel construction. We understand that the City will provide
construction inspection services. We propose a site visit after the start of tunnel
construction to observe the actual tunneling conditions and contractor's means and
methods, and to meet with the City's inspector and discuss inspection procedures. This
visit will be early in the tunneling work and before the tunnel approaches the railroad
tracks.
• Site visits during tunneling beneath the railroad. We propose to visit the site while the
contractor is tunneling below the railroad to review the progress of the work, observe the
tunneling conditions and performance of the work, coordinate with the City's inspector
regarding the work and inspection procedures, and to participate in meetings with the
railroad or contractor if issues arise. A total of 3 site visits is budgeted.
• Allowance for meetings or conference calls. An allowance is included for meetings or
conference calls between Schnabel and Wade Trim, and possibly with the City and/or
railroad. It is anticipated that there may be a kickoff meeting or call prior to or at the start
of the work, as well as a need for other calls or meetings if issues arise in the field during
the progress of the tunnel work.

Assumptions
Senior engineering personnel registered in the State of Texas will provide most of the
engineering and consultation services including the review and development of written
response. Minutes for conference calls or meetings will be prepared by others if needed.
Services rendered under this proposed agreement will consist of professional opinions and
recommendations made in accordance with generally accepted geotechnical and materials
engineering practice. Under no circumstance is it the intent for Wade Trim or its subconsultants
to directly control the physical activities of the contractor or be responsible for the contractor's
designs or means and methods for the work.
If a site visit is requested, the client shall provide safe access to all areas requiring observations.
We request at least 48-hours' notice to schedule personnel for a site visit or in-person meeting.
Compensation
Compensation for engineering services will be performed on a unit time basis and will be based
on the Schedule of Personnel Fees included as Attachment 1. Direct expenses including travel
will be billed at cost plus 15%. We will charge travel time and mileage for project-related trips
between our office and the job site. Mileage will be charged at the current IRS prevailing rate
plus 15%.

5. Time spent during depositions, hearings, and in court is charged at 1.5 times the regular hourly

RECOMMENDATION:
It is recommended that the City authorize the execution of Amendment No. 3
to City Secretary Contract No.44649,an Engineering Agreement with Wade
Trim,Inc., in the amount of$836,860.00 for additional engineering
services for the Westcliff Drainage Improvements project;thereby revising
the total contract amount to$1,983,806.00.
DISCUSSION:
Home flooding has been observed by residents in the Westcliff Neighborhood.
On July 9,2013,(M&C C-26320)the City Council authorized an Engineering
Agreement with Wade Trim,Inc.,in the amount of$524,244.00 for
engineering services for design,analysis and cost-benefit evaluation of
capital improvements to mitigate the flood risk. The engineering assessment
determined that an enlarged pipe system from near Stadium Dr. and Seminary
to a creek off of Trail Lake Dr. and Seminary Dr. would significantly
mitigate the flood risk.It was decided that a phased approach to
constructing the project would be used. Attachment 1 to this M&C shows the
limits of each phase.
The contract was subsequently amended as discussed below.
Stormwater took advantage of opportunities to partner with other groups
within the City and constructed early phases in a different order than
originally planned. The initial contract was used for the design of Phase
2A Drainage Improvements,which were completed in 2017 in conjunction with
a bond-funded paving project.Amendment 1 provided for construction phase
services for Phase 2A. Amendment 2 provided for design and construction
phase services for Phase 2B and revisions to the Phase 1 concept plan.
Construction of Phase 2B will begin in April of 2019.
This M&C will amend the contract with Wade Trim Inc.,to complete the
design of Phase 1,including stream modeling and improvements design in
Foster Park near the outfall, and construction phase services. Construction
of Phase 1 is anticipated to begin in 2020.
