Home My WebLink AboutContract 44231-S2 R�C�`V219 Contract No. 02-1 XXM5003 Mp�2 (,rr� LAC. u�23i -�WOR�H C\v��FECvglP,� \ TATE OF TEXAS § COUNTY OF TRAVIS § CITYSECRErARY''`` CONTRACT NO.. `t 3 i- 'S vZ SUPPLEMENTAL AGREEMENT NO.2 TO AGREEMENT FOR THE INSTALLATION AND REIMBURSEMENT FOR THE OPERATION AND MAINTENANCE OF TRAFFIC SIGNALS WITHIN A MUNICIPALITY WHEREAS, on the 26th day of February, 2013, an Agreement for the Installation and Reimbursement for the Operation and Maintenance of Traffic Signals within a Municipality was entered into by and between the Texas Department of Transportation hereinafter called the "State," and the City of Fort Worth_, hereinafter called the "City," and subsequently identified the agreement as Contract Number 02-1XXM5003 ; and WHEREAS, the parties to this agreement have mutually determined that it is necessary to amend the original agreement due to the following feasee/reasons: additional intersections are added (#51 and #52) on page 4 under Exhibit#1 and Exhibit#2 to amend the traffic signal maintenance and operation provision, and Exhibit#3 to amend the quantity and cost for the Diamond Interchange Signal(s) NOW, THEREFORE, Contract No. 02-1 XXM5003 is amended as follows: EXHIBIT 1 EXHIBIT 1 is amended to add the traffic signal(s) #51 & 52 to amend the traffic signal maintenance and operation installation(s) at the intersection(s) of US 287 & Blue Mound Road, US 287 & BUS 287/FM 718. A copy of the revised EXHIBIT 1 is attached hereto and made a part of this agreement. EXHIBIT 2 EXHIBIT 2 is amended to modify the traffic signal maintenance and operation provision(s) for the following items: #4 (add "This is understood that this does not include replacement of foundation. Repair or replacement of Damaged foundations will be covered under article 5, line D of the original agreement"), #9 (removed the words "and galvanized", #10 (remove "and incandescent lamps of'), #16 (add "or replace"), #17 (add "to confirm and maintain the qualification of all claims for periodic payment revise. Use forms provided by TxDOT or city prepared documentation that includes the same information as a minimum for preventative maintenance checklists and signal trouble call reports. This information may be provide in electronic file or pdf prior to inspections if the city uses asset management software for signal maintenance."), #18 (revised to read "Signal timing will be the responsibili!Y of the City." Priority should be given to freeway or expressway frontage roads when recurrent congestion occurs on freeway or expressway main lanes. Provide a yearly schedule for preventative maintenance for all cabinets divided into sections to be serviced on a monthly basis that shall be used as TxDOT's basis for spot check of locations prior to payment. A copy of the revised EXHIBIT 3 is attached hereto and made a part of this agreement. Article 4. Compensation The maximum amount payable under this agreement is increased from $208,392.00 to $369,235.32 per year in accordance with the above changes. Calculations for the increase to the maximum amount payable are as follows: AMOUNT OF THIS SUPPLEMENTAL AGREEMENT $ 160,843.32 ORIGINAL MAXIMUM AMOUNT PAYABLE PER YEAR $ 208.392.00 TOTAL PREVIOUS SUPPLEMENTAL AGREEMENTS $ 0.0 REVISED MAXIMUM AMOUNT PAYABLE PER YEAR $ 369,235.32 ARTICLE 5. Payment The amount of this supplemental agreement shown above shall be a prorated amount based on the cost for the type of installation calculated on EXHIBIT 3 of the original agreement and any increases or decreases caused by any subsequent supplemental agreements. The (monthly/quarterly/annual) payment shall be adjusted accordingly. All other terms or conditions are unchanged and remain in full force and effect. Calculations: $142.00/month x 12 months = $1704.00/year $ 1704.00 x 15 intersections = $ 25,560.00/year Actuated Signals at Tee Intersections shall be reimbursed at $1,500.00 per intersection per year.17 Calculations: $125.00/month x 12 months = $1,500.00/year $ 1500.00 x 5 intersections = $ 7500.00/year Diamond Interchange Signals with one controller shall be reimbursed at $3582.00 per intersection per year.
