HomeMy WebLinkAboutOrdinance 23646-05-2019 Ordinance No. 23646-05-2019 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER AND SEWER CAPITAL PROJECTS FUND, FROM AVAILABLE FUNDS IN THE AMOUNT OF $124,200.00, FOR THE PURPOSE OF FUNDING THE NORTHSIDE II 30- INCH WATER TRANSMISSION MAIN ALONG STATE HIGHWAY 170 FROM N. BEACH STREET TO US 377 PROJECT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2018-2019 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water and Sewer Capital Projects Fund in the amount of$124,200.00, from available funds, for the Northside II 30- inch Water Transmission Main Along State Highway 170 from N. Beach Street to US 377 project. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 23392-09-2018 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Schultz, Inc. dba Circle C Construction Company, for a Revised Contract Amount of$6,131,630.00, for Northside II 30-inch Water Transmission Main along State Highway 170 from N. Beach Street to US 377 and Adopt Appropriation Ordinance (COUNCIL DISTRICT 7) RECOMMENDATION: It is recommended that the City Council: 1. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water and Sewer Capital Projects Fund in the amount of$124,200.00 from available funds; and 2. Authorize execution of Change Order No. 2 to City Secretary Contract No. 50627 with William J. Schultz, Inc. dba Circle C Construction Company, in the amount of$124,200.00 and the addition of 90 calendar days for Northside 11 30-inch Water Transmission Main Along State Highway 170 from N. Beach Street to US 377. (City Project No. 100261) DISCUSSION: On April 3, 2018, Mayor and Council Communication (M&C C-28653), the City Council authorized a contract with William J. Schultz, Inc. dba Circle C Construction Company, (City Secretary Contract No. 50627) in the amount of$5,910,255.00 for construction of Northside 11 30-inch Water Transmission Main Along State Highway 170 from N. Beach Street to US 377. The contract was subsequently revised by Change Order No. 1 in the amount of$97,175.00 authorized administratively on March 1, 2019. Change Order No. 2 will provide compensation for the installation of 207 linear feet of the project main along S.H. 170 by other than open cut as required by TxDOT in lieu of open cut installation. MWWBE OFFICE —William J. Schultz, Inc. dba Circle C Construction Company, a waiver of the goal for MBE/SBE subcontracting requirements was requested by the Department and approved by the MWBE Office, in accordance with the MWBE or BIDE Ordinance, because the purchase of goods or services is from sources where subcontracting or supplier opportunities are negligible. The project is located in COUNCIL DISTRICT 7. FISCAL INFORMATION / CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendation and adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of the Water and Sewer Capital Projects Fund. The Fiscal Year 2019 Water Operating Budget includes Logname: 60NSIISH17030INWLCO2-CIRCLEC Page 1 of 2 appropriations of$23,865,180.00 for the purpose of providing Pay-As-You-Go funding for Water Capital Projects.
