HomeMy WebLinkAboutOrdinance 23669-05-2019 CITY OF HASLET ORDINANCE NO. 010-2019 CITY OF FORT WORTH ORDINANCE NO. a340 -�5 - av►a JOINT ORDINANCE AND BOUNDARY AGREEMENT WHEREAS, the City of Haslet(hereinafter called "HASLET") is a Type A general law municipality located in Tarrant and Denton Counties, Texas; and WHEREAS, the City of Fort Worth (hereinafter called "FORT WORTH") is a home-rule city located in Tarrant, Wise, Parker, Johnson and Denton Counties; and WHEREAS, HASLET and FORT WORTH share a common boundary; and WHEREAS, HASLET and FORT WORTH most recently approved a Joint Ordinance and Boundary Agreement in November 2018 to adjust the corporate boundaries of the cities to promote the efficient delivery of services by clarifying maintenance responsibility, traffic management and related municipal services for certain roadways; and WHEREAS, HASLET and FORT WORTH now desire to adjust the boundary between the two cities to promote orderly development to insure public safety and effective delivery of municipal services; and WHEREAS, Section 43.015 of the Texas Local Government Code authorizes adjacent municipalities to make mutually agreeable changes to their boundaries that are less than 1,000 feet in width; and WHEREAS, HASLET and FORT WORTH want to make other commitments as part of this Agreement to promote the efficient delivery of services; and WHEREAS, HASLET and FORT WORTH agree that this boundary adjustment will clarify maintenance responsibility, traffic management and related municipal services for these roadways; and NOW, THEREFORE, BE IT ORDAINED AND MUTUALLY AGREED BY THE CITY COUNCIL OF THE CITY OF HASLET AND THE CITY COUNCIL OF THE CITY OF FORT WORTH: SECTION 1 (1.8790 acre portion of Avondale-Haslet Road Right-of-Way and Adjacent Land) Pursuant to Section 43.015 of the Texas Local Government Code, HASLET and FORT WORTH hereby agree that the boundary between the cities will be adjusted as set out herein so that the 1.8790-acre tract located in FORT WORTH, as described and shown in Exhibit "A", and with a width of less than 1,000 feet, will be located in the city limits of HASLET. Approve the attached Joint Ordinance and Boundary Agreement between the Cities of Fort Worth and Haslet; and 2. Authorize the Mayor to execute the attached Joint Ordinance and Boundary Agreement DISCUSSION: The City of Haslet has requested that the City of Fort Worth release extraterritorial jurisdiction (ETJ) to the City of Haslet as legally described in Exhibit A. The 1.879-acre tract is located on the north side of Avondale Haslet Road from Haslet's western city limit line to approximately 1,364 feet to the west. This boundary adjustment will allow the City of Haslet to improve Avondale Haslet Road as shown on Exhibit B. The ETJ released by the City of Fort Worth will then be annexed by the City of Haslet. Haslet will provide maintenance, traffic management and related municipal services for Avondale Haslet Road. Section 43.015 of the Texas Local Government Code authorizes adjacent municipalities to make mutually agreeable changes in their boundaries for areas that are less than 1,000 feet in width. The purpose of these changes in boundaries is to promote orderly development, public safety and effective delivery of municipal services. The Haslet City Council approved the agreement at their May 6, 2019 public hearing. If the City Councils for both cities approve the proposed boundary adjustment, the ordinance will be executed between the Cities of Fort Worth and Haslet. The proposed boundary adjustment is located in the Fort Worth extraterritorial jurisdiction (ETJ) within Tarrant County and closest to COUNCIL DISTRICT 7. Upon execution of the boundary agreement, the area will become part of the City of Haslet. This contract will be with a governmental entity, state agency or public institution of higher education: City of Haslet.
