HomeMy WebLinkAboutOrdinance 17448-03-2007ORDINANCE NO. 17448-03-2007 AN ORDINANCE VACATING AND EXTINGUISHING A PORTION OF N.W. 28~ STREET RIGHT OF WAY BETWEEN AN UNNAMED ALLEY AND COLITMBUS AVEl\fIJE SITUATED WITHIN THE ROSEN HEIGHTS ADDITION IN THE CITY OF FORT WORTH, TA.ItRANT COUNTY, TEXAS AS RECORDED IN VOLUME 106, PAGE 56, OF THE PLAT RECORDS OF TA,ItRANT COUNTY TEXAS; AND CONTAINING APPROXIMATELY 0.11 ACRE OF LAND, MORE OR LESS; PROVIDING FOR THE REVERSION OF FEE IN SAID LAND; THE RETA~:NMENT OF EXISTING UTILITY EASEMENTS; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That a portion of N.W. 28~' Street right of way between an unnamed alley and Columbus Avenue situated in the Rosen Heights Addition in the City of Fort Worth, Tarrant County, Texas as recorded in Volume 106, Page 56 of the Plat Records of Tarrant County Texas; and containing approximately 0.11 acre of land, more or less, and as more specifically described in Exhibits "A" and "B" attached hereto and incorporated herein by reference, be and the same is vacated and extinguished. SECTION 2. That the fee to the land in the above-described street and alley rights-of--way is released and shall revert to the adjacent owner as provided bylaw. SECTION 3. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. SECTION 4. That this ordinance shall take effect upon adoption. APPROVED AS TO FORM AND LEGALITY: ~~ G.~. Adopt an ordinance vacating a portion of NW 28th Street right-of-way from a point at the alley to the west and to a point at the east of Columbus Avenue, being a variable width (21ft by 49ft) feet wide by approximately 140 feet long consisting of 0.11 acre of land, in the Rosen Heights Addition located in the City of Fort Worth, as filed in Volume 106, Page 56, Plat Records, Tarrant County, Texas; and 2. Waive any and all purchase fee value of the vacated land. DISCUSSION: Donnie Tucker of Texas Surveyors, on behalf of Maria and Ernesto Rodriguez, requests to vacate the above referenced surplus right-of-way and to replat and incorporate it within the adjoining property to expand a residential yard. The City Plan Commission recommended approval of this request at its meeting on April 23, 2003. An acceptable replat (FS-03-218) has been received. Any existing utilities will be relocated at the applicant's expense, or retained within a designated easement, along with an appropriate plat note that no permanent structures may be constructed or placed thereon. The Department of Engineering, Real Property Division states that the fee value of the subject property is $1,509.50. The City of Fort Worth originally obtained the above mentioned right-of-way through platting process. The City does not own land under or adjacent to the above referenced right-of-way. Since no City funds have been expended to purchase property or easement rights, collection of the fee value or any portion thereof is recommended by staff to be waived. This request is in COUNCIL DISTRICT 2. FISCAL INFORMATION/CERTIFICATION: The Finance Director certifies that this action will have no material effect on City funds.
