WHEREAS, the City of Fort Worth (City) and Freese & Nichols, Inc.
("Engineer") made and entered into City Secretary Contract No. 34315 (the
Contract) which was authorized by M&C C-21809 on the 31st of October,
2006
WHEREAS, the Contract involves engineering services for the following
project:
MAGNOLIA URBAN VILLAGE PEDESTRIAN AND STREETSCAPE
PROJECT
WHEREAS, it has become necessary to execute Amendment No. 1 to
said Contract to include an increased scope of work and revised maximum
fee.
NOW THEREFORE, City and Engineer, acting herein by and through
their duly authorized representatives, enter into the following agreement
which amends the Contract:
1.
Article I of the Contract is amended to include the revised scope in
engineering services as specified in a proposal letter dated July 20, 2009,
and in modified Exhibits "13-3A," "13-36" and "13-3E," copies of which are
attached hereto and incorporated herein. The cost to City for the additional
services to be performed by Engineer total $23,457.00
2.
Article II of the Contract is amended to provide for an increase in the
maximum fee to be paid to Engineer for all work and services performed
under the Contract, as amended, so that the total fee paid by the City for all
work and services shall not exceed the sum of $160,540.00.
3.
All other provisions of the Contract, which are not expressly amended
herein, shall remain in full force and effect.

Re: Contract Modification Proposal for Expanded Magnolia Urban Village Scope
Dear Mr.Bellen:
This letter is written in response to our discussions at the May 5, 2009 project meeting
related to the expanded scope of the Magnolia Urban Village project. Our original
contract was developed based on an estimated City Budget of $850,000. During the
development of the contract documents for the Magnolia project, the construction budget
was established at $1,248,000 resulting in an expanded engineering, landscaping and
lighting scope. In addition our team has developed contract documents for two bid
alternatives at the request of the City.
Revised Project Scone
Paving and Drainage Improvements
The original contract scope of services for paving and drainage improvements was based
on a percentage of construction for a construction budget of$625,000.00. The original
scope of services was based on implementing the paving and drainage improvements
between Feliks Gwozdz and Rosedale, with microsurfacing and restriping on each end of
the improvement, within the limits of Allen Street to the south and Terrell. The current
paving and drainage construction cost is estimated at$1,000,000.00.
Landscaping and Irrigation
The original contract scope for landscaping and irrigation was based on preparing plans
and specifications for a total of fifty-four (54) trees located between (Feliks Gwozdz to
Rosedale). The current project scope also includes preparing plans for an additional
twenty-eight (28) trees (between Allen Street to Feliks Gwozdz) to be included as a bid
alternate.
Electrical Design Services
The original contract scope for electrical design services was based on preparing plans
and specifications for twenty-four (24) street light locations. The current project scope
includes thirty-six (36) street light locations in the base bid from (Feliks Gwozdz to
Rosedale) and an additional twenty-three (23) locations in the bid alternate from (Allen
Street to Feliks Gwozdz).
Additional Scope Modifications
In November of 2006, the City requested a proposal for the development of a roadway
capacity traffic study for the Hemphill Corridor between Terrell Avenue and Allen Street.
At that time,the City removed the Environmental and Historical Surveys from our scope
of services. In February of 2008, the City requested a proposal for collecting pedestrian
counts between Terrell Avenue and Rosedale.
Compensation
FNI's compensation for the contract fee modification shall be the lump sum fee of
$23,457.00 for a total project contract amount of$160,540.00. Refer to the Compensation
summary below for a detailed breakdown of the fees.
