AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN
THE WATER CAPITAL PROJECTS FUND IN THE AMOUNT OF $136,700 AND THE
SEWER CAPITAL PROJECTS FUND IN THE AMOUNT OF $52,216 FROM A WATER
AND SEWER OPERATING FUND TRANSFER, FOR THE PURPOSE OF EXECUTING
AN ENGINEERING AGREEMENT WITH EJES, INC., FOR WATER AND SANITARY
SEWER REPLACEMENT CONTRACT 2005, WSM-L (CITY PROJECT NO. 00388);
PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE
CUMULATIVE OF PRIOR ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING
AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS:
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2006-2007 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the
Water Capital Projects Fund in the amount of $136,7D0 and the Sewer Capital Projects Fund in the amount
of $52,216 from a Water and Sewer Operating Fund transfer, for the purpose of executing an Engineering
Agreement with EJES, Inc., for Water and Sanitary Sewer Replacement Contract 2005, WSM-L (City
Project No. 00388).
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way
impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining
provisions shall be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance No. 17142 and all other ordinances and appropriations
amending the same except in those instances where the provisions of this ordinance are in direct conflict
with such other ordinances and appropriations, in which instance said conflicting provisions of said prior
ordinances and appropriations are hereby expressly repealed.
SECTION 4
This ordinance shall take effect upon adoption.

Authorize Execution of an Engineering Agreement with EJES, Inc., for Water and Sanitary Sewer
Replacement Contract 2005, WSM-L (City Project No. 00388) and Adopt Appropriation Ordinance
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the transfer of $188,916.00 from the Water and Sewer Operating Fund to the Water Capital
Projects Fund in the amount of $136,700.00 and Sewer Capital Projects Fund in the amount of $52,216.00;
2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriation in the Water
Capital Projects Fund in the amount of $136,700.00 and the Sewer Capital Projects Fund in the amount of
$52,216.00, from available funds; and
3. Authorize the City Manager to execute an Engineering Agreement with EJES, Inc., in the amount of
$160,650.00 for Water and Sanitary Sewer Replacement Contract 2005, WSM-L.
DISCUSSION:
This project consists of the preparation of plans and specifications for water and sanitary sewer line
replacement as indicated on the following streets:

All disturbed segments of pavement will be permanently repaired with asphalt after the proposed
improvements are complete.
EJES, Inc., proposes to perform the necessary design work for a lump sum fee of $160,650.00. City staff
considers this fee to be fair and reasonable for the scope of services proposed.
In addition to the $28,266.00 contract amount (water: $20,058 and sewer: $8,208), is required for project
management by the Engineering Department.
EJES, Inc., is in compliance with the City's M/WBE Ordinance by committing to 24 percent M/WBE
participation. The City's goal on the project is 19 percent.
The project is located in COUNCIL DISTRICT 9, Mapsca 75 V, 76 S and 90 E.

FISCAL INFORMATION/CERTIFICATION:
The Finance Director certifies that upon approval of the above recommendations and adoption of the
attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of
the Water and the Sewer Capital Projects Funds.
