ADVANCE FUNDING AGREEMENT
AMENDMENT# 1
THIS AMENDMENT is made by and between the State of Texas, acting through the Texas
Department of Transportation, called the State, and City of Fort Worth, acting by and through its duly
authorized officials, called the Local Government.
WITNESSETH
WHEREAS, the State and the Local Government executed a contract on July 13'h of 2017 to
effectuate their agreement to develop the Fort Worth to Dallas Regional Veloweb shared-use path
(trail) between Trinity Boulevard/Elm Street and the existing THE/DART CentrePort Station, and also
connecting to River Legacy Trail in Arlington; and,
WHEREAS, it has become necessary to amend that contract;
NOW THEREFORE, in consideration of the premises and of the mutual covenants and agreements
of the parties, the State and the Local Government do agree as follows:
AGREEMENT
1. Description of Amended Items
Article 4, Scope of Work, language is deleted in its entirety and replaced with the following:
The scope of work for this LPAFA is described as the engineering/design and construction of
the CentrePort Trail between River Legacy Trail in Arlington and the THE CentrePort Station
(reference Attachment B-1, Project Location Map) and the preliminary engineering of the trail
for the continuation from the THE/DART CentrePort Station eastward to the Tarrant/Dallas
County boundary south of the THE railroad in order to connect the Veloweb Network segment
in Irving and the Mike Lewis Park in Grand Prairie through Trinity Boulevard and Roy Orr
Boulevard in order to connect Mike Lewis Trail (reference Attachment B-1, Project Location
Map). -

Article 8, Compliance with Accessibility Standards, language is deleted in its entirety and
replaced with the following:
All parties to this Agreement shall ensure that the plans for and the construction of all projects
subject to this Agreement are in compliance with standards issued or approved by the Texas
Department of Licensing and Regulation (TDLR) as meeting or consistent with minimum
accessibility requirements of the Americans with Disabilities Act (P.L. 101-336) (ADA).
Attachment A, Resolution or Ordinance, is updated by adding Attachment A-1, Resolution or
Ordinance, which is attached to this amendment.
Attachment B, Project Location Map, is deleted in its entirety, and replaced with Attachment
B-1, Project Location Map, which is attached to this amendment. The map contains the limits in
the revised scope of work.
Attachment C, Project Budget Estimate and Source of Funds, is deleted in its entirety, and
replaced with Attachment C-1, Project Budget Estimate and Source of Funds, which is attached to
this amendment. Subtotal project costs increase from $2,470,000.00 to $3,500,000.00
($1,030,000.00) and added Right of Way and Utilities costs.
All other provisions of the original contract are unchanged and remain in full force and effect.
2. Signatory Warranty
Each signatory warrants that the signatory has necessary authority to execute this agreement on
behalf of the entity,represented.

WHEREAS, the Congestion Mitigation and Air Quality Improvement (CMAQ)
Program, administered by the Texas Department of Transportation, provides funding for
surface transportation projects and other related efforts that contribute air quality
improvements and provide congestion relief.; and
WHEREAS, the City of Fort Worth and the Texas Department of Transportation
C'TxDOT") entered into a Local Projeet Advance Funding Agreement (City Secretary No.
49494) for the division of costs and responsibilities associated with the design and
construction of the Project,of which the City's share is S520,002.00;and
WHEREAS, The City and TxDOT desire to amend the original Funding Agreement
to increase the amount of the City's share by$179,998.00 and increase the total amount of
the Funding Agreement to S3,684,450.00, with correlative increases by the other project
participants for additional design of a connection to the Mike Lewis Trait in the City of
Grand Prairie;
NOW THEREFORE, DE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF FORT WORTH,THAT:
The City Manager is authorized to execute the Amendment No. 1 to Local
Transportation Project Advance Funding Agreement with the Texas Department of
Transportation(City Secretary No. 49494) Increasing the total amount of the Agreement to
to S3,684,430.40 with a correlative increase the City's participation by the amount of
S179,998.00 for a revised amount of City participation of$700,000.00 for the additional
design of the Mike Lewis Trail Connection to the CentrePort Trail Project.

RECOMMENDATION:
It is recommended that the City Council:
1. Adopt the attached Resolution authorizing the execution of Amendment No.1,in the amount of
$926,862.00,to the Advance Funding Agreement with the Texas Department of Transportation for the
CentrePort Trail Project(City Secretary Contract No.49494)to increase the total amount to$3,684.,450.1X1
with Federal Participation in the amount of 52,800,0W.00,lndVW State Participation in the amount of
$184,450.00 and City Participation increased by$179,998-00 for a total amount of VW I)W.00;
2- Authorize the acceptance of additional$720,000.00 in federal funds contributing to CentrePort Trail
Project through the Texas Department of Transportation;
3- Authorize the acceptance of additional$26,864-00 in state funds co►tribubng to CentrePort Trail
Project through the Texas Department of Transportation;
4- Authorize the transfer of$89,998-00 from the General Capital Projects Fund towards the Cilys match;
5- Accept$90,000-00 from the City of Grand Prairie for use toward local match;and
6. Adopt the attached appropriation ordnance increasing estimated receipts and appropriations in the
Grants Capital Pr*cts Federal Fund in the mount of$926,862.00.
DISCUSSION:
The purpose of this Mayor and Council Commrnicat-ron(M&C)is to adopt a Resolution authorizing the
City Manager to execute Amendment No.1 to an Advance Funding Agreement(AFA)with the Texas
Department of Transportation(TxDOT)(City Secretary Contract No..49494)_The Amendment details the
responsibilities of both the City and TxDOT in the development of the project and includes additional

design for the connection to the Mike Lewis Trail in the City of Grand Prairie. This M&C also authorizes
acceptance of additional state and federal grant funds for the project,acceptance of funds from the City of
Grand Prairie,appropriation of matching funds and transfer of funds for the City's match_
This project is a part of the Veloweb Trail Network of the North Central Texas Council of Governments,
connecting the CentrePort Trail from its terminus at the THE CentrePort Station to the: 1)Mike Lewis Trail
in Grand Prairie,and 2)future Veloweb Trail at the eastern county boundary south of THE Railroad.
The City Council approved an Advanced Funding Agreement with TxDOT in the amount of$2,757,568.00
on June 20,2017(M&C G-18975 and M&C G-19040)for the engineering and construction of the
CentrePort Trail between River Legacy Trait in Arlington and the THE CentrePort Station,which will also
connect to the American Airlines Headquarters.
This amendment is for the preliminary engineering of the trail for the continuation from the THE CentrePort
Station eastward to the:1)Tarrant f Dallas County boundary south of the THE railroad in order to connect
the Veloweb Network segment in Irving;and 2)Mike Lewis Park in Grand Prairie through Trinity Blvd.,and
Roy Orr Blvd.,in order to connect Mike Lewis Trail_
An Interlocat Agreement(CSC No.50713)with the City of Grano!Prairie for its anticipated share of the
design costs was administratively executed on May 2,2018. Terms of this agreement require the City of
Grand Prairie contribute$90,000.00 for the local match.
Indirect costs associated with the ability for the City to recapture costs associated with administering this
program are not allowed under this agreement.
