AN ORDINANCE AMENDING CHAPTER 2 (ADMINISTRATION) OF THE
CODE OF THE CITY OF FORT WORTH, BY ABOLISHING ARTICLE V,
"LITERARY REVIEW," THEREOF AND SUBSTITUTING IN LIEU THERE-
OF ARTICLE V, "RULES AND PROCEDURES FOR CERTAIN CITY
BOARDS", TO ESTABLISH RULES AND PROCEDURES FOR CERTAIN
CITY BOARDS; ADOPTING DEFINITIONS OF "CITY BOARD"; CREAT-
ING SUNSET PROVISIONS FOR CERTAIN BOARDS, PROVIDING AN
ABSENCE RULE FOR CERTAIN BOARDS; PROVIDING FOR NUMBER OF
MEMBERS AND TERMS OF SERVICE FOR CERTAIN BOARDS; PROVIDING
FOR THE ESTABLISHMENT OF PLACES FOR CERTAIN CITY BOARDS;
PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE
CUMULATIVE OF PRIOR ORDINANCES AND REPEALING ALL PRIOR
ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFEC-
TIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH,
TEXAS:
SECTION 1.
That Chapter 2 (Administration) of the Code of the City of Fort
Worth, Texas (1964), as amended, is hereby amended by repealing and
abolishing Article V, "Literary Review," and substituting in lieu
thereof a new Article V, and that hereafter Article V of Chapter 2
of the said City Code shall be and read as follows:
"ARTICLE V. RULES AND PROCEDURES FOR CERTAIN CITY BOARDS
"Sec. SUNSET PROVISIONS FOR CERTAIN CITY BOARDS.
"Sec. 2-33.1. Definition.
As used in
this secti(n,
the term
"City Board" shall
mean any board,
commission,
committee
or other body which
is created by the
City
Council and is
not required to ex-
ist by the City
Charter
or State Law.
"Sec. 2-33.2. Report by City Secretary.
Before the first day of March of each year, the City
Secretary shall report the following information to the
City Council in writing:
(a) the
name of
any City
Board which has not met during
the
preceding
twelve
months;
(b) the name of any City Board which has a vacancy in the
membership thereof and such vacancy has not been
filled durinq the preceding twelve months.
"Sec. 2-33.3. Abolition of Boards.
When any
board is
reported
to
the
City
Council by
the
City Secretary under (a) or
(b)
of
Sec.
2-33.2,
the
Council shall
within
thirty days
after
the receipt
of
such
report, take
action
to continue
the
existence
of
such
board. Should no such action be taken, the board shall be
abolished.
"Sec. 2-34. ABSENCE RULE FOR CERTAIN CITY BOARDS
"Sec. 2-34.1. Definition.
As used in this section, the term "City Board" shall
mean any board, commission, committee or other body of the
City of Fort Worth whose members the City Council has the
power to remove.
"Sec. 2-34.2. Reports to City Secretary.
When a member of any City board, as defined in
Sec. 2-34.1, is absent from three successive meetings of
such board, or misses 25 percent or more of the meetings
of such board in a twelve-month period, the Chairman,
Vice -Chairman or Secretary of such board shall report this
fact to the City Secretary in writing, within ten days of
the third missed meeting.
"Sec. 2-34.3. Report to City Council; removal of board
members.
At the next City Council meeting after a report under
Sec. 2-34.2 is received, the City Secretary shall report
such information to the City Council, in writing. When the
absences of any board member are reported to the City
Council, the City Council shall, by the next regular City
Council meeting, take action to retain such board member.
Should no such action be taken, the position filled by
such board member shall be declared vacant. The City
Secretary shall notify such board member, in writing, of
his or her removal. The City Secretary shall include the
vacancy in the next regular listing of board vacancies.
"Sec. 2-35. NUMBER OF MEMBERS AND TERMS OF SERVICE; ESTAB-
LISHMENT OF PLACES.
"Sec. 2-35.1. Number of members; terms of service; places.
Unless otherwise provided by state law, city charter
or City Council exception, all City boards shall be com-
posed of nine (9) members. Board members shall serve for
terms of two (2) years, provided that the terms of office
shall be staggered as follows:
Five members shall be appointed for terms which expire
October 1, 1983.
Four members shall be appointed for terms which expire
October 1, 1984.
Thereafter, each such board shall have nine (9) places,
and all appointments shall be made for two (2) year terms,
as follows:
Places 1, 3, 5, 7 and 9 - Terms expire October 1, each
odd -numbered year.
Places 2, 4, 6 and 8 - Terms expire October 1, each even -
numbered year.
"Sec. 2-35.2. Exceptions.
Those boards excepted from the provisions of this
section because of conflicting state law, city charter
provision or City Council exception shall include current-
ly, but shall not be limited to, the following:
Board of Adjustment
Civil Service Commission
Dallas -Fort Worth Regional Joint Airport Zoning Board
Meacham Field Joint Airport Zoning Board

SECTION 2.
That this ordinance shall be cumulative of all provisions of
ordinances of the Code of the City of Fort Worth, Texas (1964), as
amended, except where the provisions of this ordinance are in direct
conflict with the provisions of such ordinances and such Code, in
which event conflicting provisions of such ordinances and such Code
are hereby repealed.
SECTION 3.
It is hereby declared to be the intention of the City Council
that the sections, paragraphs, sentences, clauses and phrases of
this ordinance are severable, and, if any phrase, clause, sentence,
paragraph or section of this ordinance shall be declared unconstitu-
tional by the valid judgment or decree of any court of competent
isdiction, such unconstitutionality shall not affect any of the
remaining phrases,
clauses,
sentences,
paragraphs
and
sections
of
this ordinance since the same would have been enacted by the City
Council without the incorporation in this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or section.
SECTION 4.
This ordinance shall be in full force and effect from and after
the date of passage.

Background
On November,,e,1982, the City Council approved M&C G-5476, "Handbook for Boards
and Commissions; Changes in Rules for and Composition of Boards and Commissions."
The-M&C made several recommendations about the establishment of general rules and
--- procedures for those City boards which are established by the City Council.
It is proposed that three of these general recommendations be incorporated into
Chapter 2 (Administration) of the City Code as Article V thereof. It will
replace the current Article V. "Literary Review." It is proposed that Article
V, "Literary Review," be repealed, as this article has not been used and the
Literary Review Committee provided for has not met for many years. The replace-
ment Article V will be entitled, "Rules and Procedures for Certain City Boards."
Part A of Article V is a sunset provision for certain City boards. Each year in
March, the City Secretary will have the duty to report to the Council the name
of any board which has not met during the preceding twelve months or which has
had a vacancy for that period. The City Council will have thirty days during
which to take action to continue the existence of the board. Otherwise, the
board will be abolished.
Part B of Article V establishes an absence rule for City boards over which the
Council had removal power. When a board member is absent from three successive
meetings or 25 percent of the board meetings in a twelve month period, the Council
will have thirty days during which to take action to retain the member. Other-
wise, after notice to the member, the position will be declared vacant.
Part C of Article V establishes nine membership places for each City board, un-
less membership is otherwise governed by conflicting state law, City Charter
provision or Council exception, which exceptions are listed in Part C. This
part also establishes staggered, two-year terms for board members. In addition
to passage of Part C of Article 5, it is recommended that each ordinance and/or
City Code provision dealing with one of the affected boards be amended, to pro-
vide for nine members, and staggered, two-year terms.
Recommendation
It is recommended that the City Council adopt the attached Ordi�������(ing �
