AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE
2014 BOND PROGRAM FUND FOR THE HEMPHILL/BERRY URBAN VILLAGE
STREETSCAPE PROJECT, FROM AVAILABLE FUNDS IN THE AMOUNT OF$19,000.00,
FOR THE PURPOSE OF PAYING CONTRACTUAL OBLIGATIONS; PROVIDING FOR A
SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR
ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS.-
SECTION 1.
That in addition to those amounts allocated to the various City departments for Fiscal Year 2018-2019 in the
Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the 2014
Bond Program Fund in the amount of$19,000.00 for the Hemphill/Berry Urban Village Streetscape project,
from available funds, to provide payment of contractual obligations.
SECTION 2.
That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void
for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair
the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall
be and remain in full force and effect.
SECTION 3.
That this ordinance shall be cumulative of Ordinance 23392-09-2018 and all other ordinances and
appropriations amending the same except in those instances where the provisions of this ordinance are in
direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of
said prior ordinances and appropriations are hereby expressly repealed.
SECTION 4.
This ordinance shall take effect upon adoption.

Fund and Reduce Funds in the 2014 Bond Program Unspecified Fund by the Same Amount (COUNCIL
DISTRICT 9)
RECOMMENDATION:
It is recommended that the City Council adopt the attached appropriation ordinance increasing estimated
receipts and appropriations in the Hemphill/Berry Urban Village Streetscape Project in the amount of
$19,000.00 from the 2014 Bond Program Unspecified Fund and reduce funds in the 2014 Bond Program
Unspecified Fund by the same amount.
DISCUSSION:
On June 16, 2015 (M&C C-27331), City Council approved the execution of a contract with C. Green
Scaping, LP, in the amount of$670,337.80 for the construction of pedestrian and streetscape
improvements along Hemphill Street in the Hemphill/Berry Urban Village and to provide for project costs
and contingencies for a project total amount of$916,853.85. The project was funded with the FHWA
Urban Village Funds for Urban Village improvements ($650,948.17) and New Development 2004 Bond
Funds ($265,905.68).
The Hemphill/Berry Urban Village Streetscape Project construction was completed in June 2016 but the
contract contained a two-year landscape maintenance obligation.
Bond Funds
In 2017, the City was notified by the Texas Department of Licensing and Regulation (TDLR) of a violation
with the Texas Accessibility Standards (TAS) on the Magnolia Urban Village Streetscape Project. The
Magnolia Urban Village Streetscape Project was completed in 2014, and is located on Hemphill Street
north of the Hemphill/Berry Urban Village Streetscape Project. The TAS violation indicated a higher than
allowed ADA accessibility slope percentage adjacent to the pedestrian signal actuator button at the
northeast and southwest corners of the Magnolia and Hemphill intersection. In order to correct the
violation and avoid potential administrative penalties, $21,646.70 of the 2004 Bond Funds were reallocated
to the Magnolia UV project to correct the TAS violation.
As a result, the Hemphill/Berry Urban Village Streetscape Project incurred a shortfall which now requires a
change order to close out the project. Available funding from the 2014 Bond Program Unspecified Fund, in
the amount of$19,000.00, will be used to pay for the contractual obligations ($17,280.00) and the final
change order ($1,269.65)which will allow staff to close-out the Hemphill/Berry Streetscape Project. After
reconciling and closing the project, any remaining 2014 Bond funds will be returned to the Unspecified
Fund.
This M&C does not request approval of a contract with a business entity.

FISCAL INFORMATION /CERTIFICATION:
The Director of Finance certifies that upon approval of the above recommendations and adoption of the
attached appropriation ordinance, funds will be available in the current capital budget, as appropriated
from the 2014 Bond Program Unspecified Fund.
