Morgan Chase Bank 420 Throckmorton, Suite 200 Fort Worth,Texas 76102 Re: Consent to Pool City of Fort Worth Lease Brumbaugh CFW Unit 1H: 128.791 Acre Pooled Unit Tarrant County,Texas Dear Paul, This is XTO's written request to pool a portion of the following described City of Fort Worth lease into the Brumbaugh CFW Unit referenced above: Oil and Gas Lease dated effective April 28, 2005 covering 131.139 gross acres by & between the City of Fort Worth and XTO Energy Inc. A portion of this lease was previously pooled into the Brumbaugh 8H Unit. The City of Fort Worth lease represented 45.9% of the total acreage included in this unit,as well as 46% of the gross acres contained in the lease. Presently we are proposing to pool 48.92 gross acres of said lease into the proposed 128.791 acre unit. This represents 37.98% of the gross acres going into the pooled unit, and includes the remaining tracts covered by the lease, with the exception of one non-contiguous tract. A copy of the unit plat is attached hereto as Exhibit"A";the City of Fort Worth tracts in the unit are shown in "yellow". If this projected pooled unit is agreeable to The City of Fort Worth, please indicate your approval by signing below. Your earliest consideration of this matter would be appreciated.
