HomeMy WebLinkAboutContract 35625 (2) City Secretary Contract No AMENDMENT NO. 2 TO ENGINEERING CONTRACT FOR WEST SIDE IV PUMP STATION, AND GREENWAY AND CASTLE CIRCLE LIFT STATIONS CONSTRUCTION MANAGEMENT STATE OF TEXAS § COUNTY OFTARRANT § WHEREAS, on March 25, 2003, the City of Fort Worth, the "City", and Chiang, Patel & Yerby, Inc., the "Engineer", made and entered into City Secretary Contract No. 28559, which was duly authorized by the City Council by M&C C-19523 on March 25, 2003, and WHEREAS, the Contract involves the engineering services for the construction management for the West Side IV Pump Station; WHEREAS, the "City"and "Engineer"desire to amend City Secretary Contract No. 28559. NOW, THEREFORE, That the City of Fort Worth, a municipal corporation situated in Tarrant County, Texas, acting herein by and through its duly authorized City Manager, hereinafter called "City", and Chiang, Patel & Yerby, Inc., acting and herein by and through its duly authorized President, hereinafter called "Engineer", hereby make and enter into the following agreement which amends the Contract: 1. Article 1, Section 1 of the Contract is amended to include the additional engineering services specified in Exhibit A which is incorporated herein. The cost for the additional services to be performed by the Engineer is $150,000.00. 2. Article III of the Contract is amended to provide for an increase in the maximum fee to be paid to the Engineer for all work and services performed under the Contract as specified in Exhibit A of which is hereto and incorporated herein, so that the total fee paid by the City for all work and services shall not exceed the sum of $348,946.00. 3. The Engineer acknowledges its commitment to obtain an additional 10% Minority/Women Owned Business Enterprise (M/WBE) Participation for this amendment. ORTMIOIL � EXHIBIT A AMENDMENT NO. 2 TO ENGINEERING CONTRACT FOR WEST SIDE IV PUMP STATION, AND GREENWAY AND CASTLE CIRCLE LIFT STATIONS CONSTRUCTION MANAGEMENT 1 SCOPE OF SERVICES 1.1 Additional Construction Phase Services for Westside IV Pump Station 1.1.1 General Description of Work Additional engineering services for the West Side IV Pump Station included additional services for: 1) additional site trips during construction, 2) additional requests for information, 3) additional construction management services due to extending the original 11 month project duration for West Side IV to 19 months, and 4) services related to replacement of electric motor on Pump No. 2. 1.1.2 Project Tasks As part of the additional professional services required for this project, Chiang, Patel and Yerby Inc. performed the following tasks: Task 1 Engineer provided services for 26 additional site trips to observe construction during the project through June 1, 2004. Task 2 Engineer provided additional office services related to more than 55 unanticipated requests for information during the project. Task 3 Engineer -provided additional construction management services for the time period extending from the original 11-month project duration to 19 months. The 19-month time period was from the construction contractor's Notice to Proceed dated January 6, 2003, until August 10, 2004. Task 4 Engineer provided additional construction management services after August 10, 2004, relating to the replacement of the electric motor on Pump No. 2. Services include witnessing the pump and motor alignment procedures, witnessing vibration tests, and conducting periodic review of the unit during its initial test period. Amendment 2 Page-3 July 27,2007 Contract No. 28559 1.2 Construction Phase Services for Greenway and Castle Circle Lift Stations 1.2.1 General Description of Work Chiang, Patel and Yerby, Inc. performed Construction Inspection services for the Greenway and Castle Circle Lift Stations that included part-time on-site construction observations and testing services 1.2.2 Project Tasks As part of the professional services required for these projects, Chiang, Patel and Yerby Inc. performed the following tasks: Task 1 General Project Inspection Activities General project inspection activities included the following: 1. Pre-Construction Meetings — Chiang, Patel and Yerby, Inc. attended the project pre- construction meeting for each facility. 2. Monthly Invoices — Chiang, Patel and Yerby, Inc. prepared and submitted six (6) monthly invoices for construction inspection activities. 3. Monthly Project Meetings — Chiang, Patel and Yerby, Inc. attended six (6) monthly progress meetings with representatives from the City and Contractor. 4. Review Contractor Pay Requests — Chiang, Patel and Yerby, Inc. reviewed six (6) Contractor Pay Requests to verify percent of construction activities completed. 5. Shop Drawings — Chiang, Patel and Yerby, Inc. received and kept on file one (1) copy of all contractor submittals. Engineer field verified equipment and materials were as submitted. 6. Other Items — Chiang, Patel and Yerby, Inc. review interpretations and clarifications of Contract Documents from the Design Engineer. Chiang, Patel and Yerby, Inc. made recommendations to the Owner as to acceptability of the work. Task 2 Construction Observations and Testing Construction testing services were furnished by a sub consultant to Chiang, Patel and Yerby, Inc. These construction testing services were provided to assist the Owner in determining that construction was proceeding in accordance with the Contract Documents. Construction observation was on a part-time basis involving an average of three (3) site trips per week over a 26-week period. Observations occurred during specific construction phases, or after specific portions of the work were complete. Construction observations included the following activities: Amendment 2 Page-4 July 27,2007 Contract No.28559 1. Conducted observations of Contractor's work in progress and performed field checks of materials and equipment. 2. Conducted observations of testing services that were provided by sub consultant. 3. Reported to Owner whenever Chiang, Patel and Yerby, Inc. believed that part of Contractor's work in progress would not produce a completed project that generally conformed to the Contract Documents; or prejudiced the integrity of the design concept of the completed project as a functioning whole as indicated in the Contract Documents; or was damaged, or did not meet the requirements of inspection, tests, or approval required to be made; and advised Owner of that part of the work in progress that we believed should be corrected or uncovered for observation, or required special testing, inspection, or approval. 4. Witnessed pipe pressure and leakage tests performed by the Contractor. 5. Attended walk-through of the completed project and assisted in preparation of a list of observed items requiring completion or correction. Observed whether items had been completed or corrected, and made recommendations to Owner concerning acceptance. 6. Reviewed Contractor's as-built drawings and provided comments to Owner to aid in completion of record drawings by others. 1.3 Project Schedule Chiang, Patel and Yerby, Inc. completed the tasks described in the Scope of Work within the six (6) month period designated for construction of the facilities from the Contractor's mobilization to final completion. 2 Compensation For construction management services under Amendment No. 2, the ""City" shall pay the "Engineer"a lump sum fee of $150,000. A breakdown of the fees is shown in Table 1. DISCUSSION: On March 25, 2003, (M&C C-19523) the City Council authorized the execution of an engineering agreement with Chiang, Patel and Yerby, Inc., for construction administration services and inspection services for the West Side IV Pump Station project and the Eagle Mountain Water Treatment Plant (EMWTP) Northside III High Service Pump Station project. The new West Side IV Pump Station expands the West Side IV water service area and the water service delivery capability in far west Fort Worth including Walsh Ranch. The EMWTP North Side III High Service Pump Station Improvements provide additional pumps to serve the growing North Side III pressure plane in far north Fort Worth. The completion time for the West Side IV Pump Station and the EMWTP Northside III High Service Pump Station construction contracts was extended by change orders requiring additional construction management services and part-time inspection work from the Engineer. The contractor for the West Side IV Pump Station project was unable to complete the work; however, the bonding company intervened using a take-over agreement to complete the project. Chiang, Patel and Yerby, Inc., provided inspection and construction management services during the take-over period. In addition, the Engineer will provide specialized electrical inspection and construction services support for small lift stations. The City is responsible for construction services for Castle Circle and Greenway Lift Stations. Specialized electrical and mechanical inspectors from the City were not available at certain times and Chiang, Patel and Yerby, Inc., was requested to provide support and inspection as necessary. In additioi to the amendment, $12,000 is required for project management by Water Department staff. Chiang Patel and Yerby, Inc., is in compliance with the City's MWBE Ordinance by committing to 10 percent MWBE participation on this Amendment No. 2. The City's goal on this Amendment is 10 percent. This project is located in COUNCIL DISTRICT 7.
