COUNTY OF TARRANT §
WHEREAS, the City of Fort Worth (City) and Lockwood, Andrews & Newnam,
Inc., (Engineer) made and entered into City Secretary Contract No. 31490 (the Contract)
which was authorized by the City Council by M&C C-20484 on the 11 to day of January
2005; and
WHEREAS,the Contract involves engineering services for the following project:
Standard Agreement for engineering Services for Miscellaneous Drainage
Improvements to Luther Channel, Colonial Channel and Smithfield Channel, (2004
CIP Minor Drainage Miscellaneous Structural Improvements Contract E).
WHEREAS, it has become necessary to execute Amendment No. 2 to said
Contract to include an increased scope of work and revised maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through their duly
authorized representatives, enter into the following agreement, which amends the
Contract:
1.
Article I of the Contract is amended to include the additional engineering services
specified in a proposal letter dated July 17, 2007, a copy of which is attached hereto and
incorporated herein. The cost to City for the additional services to be performed by
Engineer total $8,275.00.
2.
Article II of the Contract is amended to provide for an increase in the maximum
fee to be paid to Engineer for all work and services performed under the Contract, as
amended, so that the total fee paid by the City for all work and services shall not exceed
the sum of$84,213.64.
3.
Article II of the Contract is amended to provide for a schedule extension to the
Engineer for all work and services performed under the Contract, as amended, so that the
final plans and specifications can be bid August 2007.

All other provisions of the contract,which are not expressly amended herein, shall
remain in full force and effect.

RE: 2004 Capital Improvements Drainage Project; Miscellaneous Structural
Improvements—Contract E; Project No. 00097 DOE No. 4724
Dear Mr. Sahu,
Following completion of the final design including preparation of legal descriptions and
exhibits for easements, the City learned of future improvements proposed by TCU while
acquiring easements. TCU entered an agreement for Barnett Shale gas production after
Lockwood, Andrews, & Newnam, Inc. (LAN) coordinated with the university in locating
the channel improvements for Colonial Creek. These future improvements have impacted
the design and will require minor alterations of the proposed channel improvements as
well as revisions to the legal descriptions and exhibits prepared for Colonial Creek. TCU
proposes to construct a maintenance building adjacent to the designed channel
improvements. TCU is unable to relocate their building due to set back restrictions from
the adjacent residential properties.
Having completed the final design and easements for the above referenced project, it is
necessary to request additional funds to revise the easements and design for the alterations
associated with future improvements at TCU. Easement and design alterations are required
for the construction and maintenance of the Colonial Creek Channel.
A. Field Surveys and Easement Descriptions: The ENGINEER will revise metes and
bounds description of the TCU easement area. There will be a total of two
easement descriptions that require revising. These revisions and coordination
with TCU and preparation of a letter of intent agreeing to the proposed
improvements will be provided for $3,925.
B. Revise Colonial Channel Design: The ENGINEER will revise the plans to reflect
the revised easements, as well as redesign any conflicting retaining walls,
driveway pavement and fence placement that intersect the new easement
boundaries, including resubmitting final construction plans and bid proposals and
specifications. These revisions will be provided for $4,350.
The total cost to provide all the services shown above is $8,275.00.
