WHEREAS, The City of Fort Worth and RPGA Design Group, Inc. (Architect) made and entered into City
Secretary Contract No. 35557 (The Contract)which was authorized by the City Council by M&C C-22224,
the 10th day of July, 2007; and
WHEREAS, further amendment is necessary to reimburse the Architect for including the geotechnical
services(soil borings, analysis, and report) as part of the design services agreement; and
NOW THEREFORE, City and Architect, acting herein by and through their duly authorized
representatives, enter into the following agreement which amends the Contract:
1.
Article 1.1, SECTION I—SERVICES OF THE ARCHITECT, a paragraph is added to read as follows:
"Provide additional design services to include additional, separate boundary surveys for closing
purposes for Lots 2, 19, 22, and 23 for Fire Station No. 5. The cost of this additional service is
$3,910,00. The scope of services is described more fully in the RPGA Design Group, Inc. letters
dated July 26, 2007 and August 16, 2007, subject: Fire Station #5 — Boundary Surveys, Fort
Worth, Texas, which is attached hereto and Attachments "A" and "B" and made a part of this
Agreement."

Paragraph 1 of SECTION V- COMPENSATION TO ARCHITECT, is amended as follows.-
"The total compensation for all of the assignments to be performed by Architect as described in
CHARACTER AND EXTENT of ARCHITECT'S SERVICES hereof shall be a fixed fee of
$125,460.00 plus up to$6,500.00 in reimbursable expenses."

All other provisions of this Contract which are not expressly amended herein shall remain in full force and
effect.

RE: Fire Station#5 —Boundary Surveys
Fort Worth, Texas
Mr. Murayama:
In order that we might reach a clear understanding, please accept this as our proposal regarding
Additional Services for individual boundary surveys on three (3) of the 20 possible lots proposed for
Fire Station#5. We submit the following:
1) The following services will be provided:
A. General
MJ Thomas Engineering, LLC,through RPGA Design Group, Inc.,will provide
separate boundary surveys for closing purposes for Lots 2, 19 and 23 of the south '/2 of
Block 7, Zurn Addition to the City of Fort Worth. A sub-consultant will perform
boundary deed research and field survey work to define the actual limits of the
property. This boundary survey will provide separately published documents for each
lot.
2) RPGA estimates between 2 and 3 weeks(weather permitting), after receipt of a"Notice to
Proceed"to complete these services.
3) Our proposed Additional Services fee for these boundary survey services is $2,915.00 plus
any reimbursable expenses incurred for filing fees or research documentation fees.
Service fees and reimbursable expenses for all services will be billed on a monthly basis as
they accrue.
4) Further Additional Services: Further Additional Services may be performed as requested by
the City of Fort Worth and may include modifications beyond the scope of work indicated.
Compensation for major variances to the agreed-upon services will be billed on an hourly basis.
5) The City of Fort Worth shall provide full information regarding the requirements of the
services, and RPGA shall be entitled to rely upon the accuracy and completeness thereof;

including,but not limited to, all site information, including complete legal site data and
restrictions, as well as, all essential information that may be supplied by subcontractors or
consultants retained by the Owner.
If the above items reflect your understanding of our agreement and are otherwise satisfactory, please
sign two copies of this proposal and return them to RPGA Design Group.
