HomeMy WebLinkAboutOrdinance 20099-03-2012Ordinance No. 20099 -03 -2012 AN ORDINANCE INCREASING THE ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE AIRPORTS GRANT FUND IN THE AMOUNT OF $1,760,000.00, SUBJECT TO RECEIPT OF A GRANT FROM THE FEDERAL AVIATION ADMINISTRATION, FOR THE PURPOSE OF ACQUISITION OF AVIGATION EASEMENTS IN ACCORDANCE WITH THE PART 150 NOISE MITIGATION PLAN FOR FORT WORTH ALLIANCE AIRPORT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2011 -2012 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Airports Grant Fund in the amount of $1,760,000.00, subject to receipt of a grant from the Federal Aviation Administration, for the purpose of acquisition of avigation easements in accordance with the Part 150 Noise Mitigation Plan for Fort Worth Alliance Airport. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 19911 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize acceptance of a grant from the Federal Aviation Administration in the amount of $1,672,000.00 for the acquisition of avigation easements in accordance with the Part 150 Noise Mitigation Plan for Fort Worth Alliance Airport accepted by the Federal Aviation Administration on December 6, 2010; 2. Authorize use of land credits in the amount up to $88,000.00 for the City of Fort Worth's in -kind local match of five percent of the project cost; and 3. Adopt attached appropriation ordinance increasing estimated receipts and appropriations in the Airports Grant Fund by $1,760,000.00 subject to receipt of the grant. DISCUSSION: On March 3, 2009, (M &C G- 16488) the City Council authorized submission of the revised Noise Exposure Maps for Fort Worth Alliance Airport. The Noise Exposure Maps were approved by the Federal Aviation Administration (FAA) on May 5, 2009. Subsequently a Noise Compatibility Program was developed to mitigate the potential noise exposure. This Noise Compatibility Program was presented to the Alliance Airport Technical Advisory Committee on October 13, 2009. On March 2, 2010, the City Council approved the submission of the Noise Compatibility Plan for Alliance Airport to the FAA. On December 6, 2010, the FAA accepted the Noise Compatibility Plan for Alliance Airport and the implementation of the plan is now eligible for FAA funding. This grant application will be for funding for the acquisition of avigation easements as identified in the Noise Compatibility Program for Alliance Airport. This project is located in COUNCIL DISTRICT 2.
