(Architect) made and entered into City Secretary Contract No. 35557 (The Contract) which was authorized by the City Council by M&C C-222241 the 10th day of July, 2007; and WHEREAS, further amendment is necessary to reimburse the Architect as part of the design services agreement for additional design services to comply with the requirements of the design guidelines of Fort Worth South; and NOW THEREFORE, City and Architect, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article 1.1, SECTION I -- SERVICES OF THE ARCHITECT, the following paragraph is added to read as follows: "Provide additional design services to meet the Near Southside Development Standards and Guidelines for Fire Station #5. The cost of this additional service is $133,060.00 plus $2000.00 for reimbursable expenses. The scope of services is described more fully in the RPGA letter dated June 15, 2009, subject: Fire Stations #5- Re -Design of Prototype to conform to Design Guidelines, Fort Worth, Texas which is attached hereto as Attachment "A" and made a part of this Agreement." 2. Paragraph 1 of SECTION V -COMPENSATION TO ARCHITECT, is amended as follows: "The total compensation for all of the assignments to be performed by Architect as described in CHARACTER AND EXTENT of ARCHITECT'S SERVICES hereof shall be a fixed fee of $267,320.00 plus up to $8,500.00 in reimbursable expenses. June 155 2009 Dalton Murayama Architectural Services Manager Transportation and Public Works (TPW) City of Fort Worth 319 W. 10th Street Fort Worth, Texas 76102 RE: Fire Station #5 — Re -Design of Prototype to conform to Design Guidelines Fort Worth, Texas Mr. Murayama: In order that we might reach a clear understanding, please accept this as our proposal regarding Additional Services to modify the existing Prototype Design for Fire Station #5. It is our understanding that these changes have been requested in response to Design Guidelines enacted by the City at the end of 2008. We submit the following for your consideration: I) General: RPGA Design Group and its team of consultants will provide additional services for Fire Station #5 as follows: A. We will make modifications to the City's prototype Fire Station Design to bring it into conformance with the current "Near Southside —Development Standards and Guidelines." The design will incorporate a pedestrian area on the east side of the property along Evans Avenue to include Public Art. We will also meet with the artist to collaborate on the overall pedestrian area design concept to assist in the integration of the proposed art work. We understand that the Construction Budget for Fire Station #5 is currently set at $215003000.00, less the additional services fees proposed below. We have attached a partial plan of the current prototype and a partial plan of the anticipated floor plan showing the anticipated plan changes. We have also attached a preliminary site plan and schematic renderings identifying the proposed pedestrian area and elevation changes required to bring the overall prototype design into conformance with the current standards and guidelines. Our goal will be to develop a design that meets the current standards and guidelines as well as develop a design that is within or below the current construction budget. In addition, as we have discussed, we will also provide Additive Alternate designs to specific elements of the new design that will allow for the potential of further enhancement to the aesthetics of this prominent public facility. Given the current construction market, these Additive Alternates will allow us the potential to take advantage of current favorable pricing that may allow for further aesthetic enhancements within the established construction budget. We anticipate these design alternates to include enhancements to the three apparatus bay facades that face public streets as well as the entry tower element. It is our goal to continue to work closely with the Fire Department and TPW on modifications to the prototype design as necessary to bring the design into conformance 101 S. The proposed bung and site plan modifications necessary to bring the bung into conformance with the new design guidelines will require modifications to the prototype documents by the structural, MEP, Civil and Landscape consultants. On July 15, 2003, (M&C C-19661) fihe City Council authorized the City Manager to execute a professional services agreement with RPGA Design Group, Inc., for the design of Fire Station No. 38 and the development of a prototype design for a two -company, three -bay fire station. On March 6, 2007, (M&C G-15621) the City Council approved and appropriated funds from the Certificates of Obligation, Series 2007, for the design and land acquisons required for Fire Station No. 5. On July 15, 2008, (M&C G-16204) the City Council approved and appropriated funds from the Certificates of Obligation, Series 2008, to implement Fire Station No. 5. On July 10, 2007, (M&C C-22224) the City Council authorized the City Manager to execute a professional services agreement in the amount of $121,550.00 plus $6,600.00 for reimbursable services, for a prototype facility design and construction administration services for Fire Station No. 5. On September 4, 2007, an .administrative Amendment No. 1 to the professional services agreement in the amount of $3,910.00 was executed with RPGA Design Group, Inc., to provide additional design services for additional, separate boundary surveys for closing purposes for Lots 2, 19, 22 and 23 for Fire Station No. 5. On November 13, 2007, an administrative Amendment No. 2 to the professional services agreement in the amount of $870.00 was executed with RPGA Design Group, Inc., to provide additional design services to comply with the Phase II requirements of the new Forestry Ordinance for Fire Station No. 5. On February 5, 2008, an administrative Amendment No. 3 to the professional services agreement in the amount of $2,530.00 was executed with RPGA Design Group, Inc. to provide additional design services to provide additional boundary survey services to include the survey of six additional lots for Fire Station No. 5. On November 28, 2008, an administrative Amendment No. 4 to the professional services agreement in the amount of $5,400.00 was executed with RPGA Design Group, Inc., to provide additional design services to provide a tower element on the east end of Fire Station No. 5. The overall project cost is estimated to be: Design Construction Utilities, ITS, FF&E Contingency, Geotech, Staff Land Purchase Total $275,920.00 $2,293,080.00 $325,000.00 $303,120.00 �402,880.00 $3,600,000.00 RPGA Design Group, Inc., is in compliance with the City's M/WBE Ordinance by committing to an additional 23 percenf on this Amendment No. 5.
