HomeMy WebLinkAboutContract 35557-A6AMENDMENT NO. 6 FOR ARCHITECTURAL DESIGN SERVICES FIRE STATION 5 STATE OF TEXAS �� �� �� COUNTY OF TARRANT CITY SECRETARY CONTRACT NO. WHEREAS, I Inc. (Architect) made and entered into City Secretary Contract No. 35557 (The Contract) which was authorized by the City Council by M&C C-222241 the 10th day of July, 2007; and Amendment No. 5 (M&C C-23670, July 21, 2009) was authorized by the City Council in the amount of $135,060.00 for design services to meet the Near Southside Development Standards; and Amendment Nos, 1, 21 31 and 4 were administratively executed in the amount of $12,710.00 for additional boundary surveys for the various lots, additional landscape, irrigation, and tower element designs; and WHEREAS, further amendment is necessary to reimburse the Architect as part of the design services agreement for additional design services for a public plaza between the east end of the fire station and Evans Avenue; and NOW THEREFORE, City and Architect, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article 1.1, SECTION I —SERVICES OF THE ARCHITECT, the following paragraphs are added to read as follows: "Provide additional design services for a public plaza between the east end of the fire station and Evans Avenue. The cost of this additional service is $5,500.00 plus up to $250.00 in reimbursable expenses. The scope of services is described more fully in the RPGA letter dated July 9, 2010, subject: Fire Station #5 — Art Plaza, Fort Worth, Texas which is attached hereto as Attachment "A" and made a part of this Agreement." 2. Paragraph 1 of SECTION V -COMPENSATION TO ARCHITECT, is amended as follows: The total compensation for all of the assignments to be performed by Architect as described in CHARACTER AND EXTENT of ARCHITECT'S SERVICES hereof shall be a fixed fee of $272,820.00 plus up to $8,750.00 in reimbursable expenses. " All other provisions of this Contract which are not expressly amended herein shall remain in full force and effect. We submit the following: A) The following will be provided: RPGA Design Group and its team of consultants will provide services for the design of a Public Plaza for the new Fire Station #5. The plaza will include the following: 1. Pubic Plaza to incorporate the Public Art designed by the Ari Council of Fort Worth and Tarrant County's Artist. 2. RPGA and our consultants will design site grading, retaining walls, landscaping, lighting and irrigation as required for the new Public Plaza. RPGA will collaborate with the Artist and coordinate with our consultants in the design of the new Public Plaza. The proposed work will include the participation of the fallowing consultants: 1. Authorize the distribution of $50,000.00 from the Tax Increment Fund of Tax Increment Reinvestment Zone Number Four, Southside T1F for the design and construction of the Public Plaza in association with Fire Station No. 5; 2. Adopt the attached appropriation ordinance increasing estimated receipts and appropriation in the 2007 Critics( Capital Projects Fund by $50,000.00 from the distribution of available funds in the Tax Increment Fund of the Southside TIF; and 3. Authorize a change order in the amount not to exceed $39,750.00 with Imperial Construction, [nc., for the construction of the Public Plaza. DISCUSSION: Fire Station No. 5 was identified for replacement in the 2007 Critics[ Capital Needs requirement. The existing fire station, located on Evans Avenue just north of Rosedale Street, is in the midst of the overall development plan of the Evans and Rosedale Business and Cultural District. The replacement Station (New Fire Station No. 5) is located just south of this District. In association with the replacement Station, the Arts Council of Fort Worth and Tarrant County proposed a plaza with mosaic artwork depicting the neighborhood's history. The proposed plaza would be between the location for the replacement Station and Evans Avenue. The board of directors of the Southside TIF has consented to the distribution ofi $50,000.00 from the tax increment fund of the Southside TIF to pay costs associated with the design and construction of the Public Plaza. The Public Plaza design will be executed with an amendment to the RPGA Design Group, Inc., agreement and with a change orderto the Imperial Construction, Inc., construction contract. The TIF portion of $50,000.00 is expected to be utilized as follows: Design $ 5,750.00 Construction $36,000.00 Contingency, Staff $ 8,250.00 Tots[ $50,000.00 On June 8, 2010, M&C C-24256 authorized the execution of the construction contract in the amount of $2,413,807.00 with Imperial Construction, Inc., to construct replacement Fire Station No. 5 located at 850 Irma Street. On July 10, 2007, M&C C-22224 authorized the execution of cap, v solonc, services agreement in the amoung to $121,555.00 plus $6,600.00 for reimbursable expenses with RPGA Design Group, Inc., for the design of replacement Fire Station No. 5. This project is located in COUNC{L DISTRICT 8. FISCAL INFORMATION /CERTIFICATION: The Financial Management Services Director certifies that upon approval of the above recommendations, funds will be available in the current capital budget, as appropriated, of the 2007 Critical Capital Projects Fund.
