Dear Ms. Yeargan and Ms. Cope:
In accordance with Article 5 (Term of Contract) of the Job Order Contract authorized by M&C C-22191 on
June 19, 2007, City Secretary Contract No. 35558 (the "Contract"), the Job Order contract Renewal No. 4 to
be effective July 23, 2011 to July 22, 2012 was executed.
On July 10, 2012 M&C C-25688 approved Amendment No. 1 to Renewal No. 4 to increase the aggregate
amount for Renewal No. 4 from $1,000,000.00 to $1,400,000,00,
To execute Amendment No. 1 to Renewal No. 4, sign and mail or hand deliver three executed originals to my
attention at the address shown below.

The Mark IV Construction Group, LLC, in the Amount of $50,348.28 to Provide a Female Restroom Facility
in Fire Station No: 6 and Authorize Execution of Amendment No. 1 to the Job Order Contract with Yeargan
Construction Company, LLC —The Mark IV Construction Group, LLC, to Increase the Maximum Annual
Contract Amount of City Secretary Contract No. 35558-R4 by $400,000.00 for a Total Amount of
$1,400,000.00 (COUNCIL DISTRICT 9)
RECOMMENDATION:
It is recommended that the City Council:
1. Authorize the execution of a Work Order with Job Order Contractor, Yeargan Construction Company,
LLC —The Mark IV Construction Group, LLC, in the amount of $50,348.28 to provide a female restroom
facility in Fire Station No. 6; and
2. Authorize the execution of Amendment No. 1 to the Job Order Contract with Yeargan Construction
Company, LLC —The Mark IV Construction Group, LLC, to increase the maximum annual contract amount
of City Secretary Contract No. 35558-R4 by $400,000.00, increasing this individual year's aggregate total
from $1,000,000.00 to $1,400,000.00.
ISCUSSION:
This Work Order is to provide a female restroom in Fire Station No. 6 as part of the 2004 Capital
Improvement Program.

On June 19, 2007, Mayor and Council Communcation C-22191 authorized the execution of a Job Order
Contract with Yeargan Construction Company, LLC -The Mark IV Construction Group, LLC, for
construction services for minor construction and renovation projects.
The current Job Order Contract (JOC) Services Agreement will expire on July 22, 2012. The Request for

Proposals for a new JOC Services was advertised in the Fort Worth Star -Telegram on April 12, 2012 and
April 19, 2012. On May 10, 2012, 13 firms submitted the required documents. Staff is evaluating the firms.
The previously authorized aggregate limit for this JOC is $1,000,000.00. This year, work orders have been
executed that total $934,575.00, leaving a remaining balance of $65,425.00. Amendment No. 1 will
authorize a one time increase in the annual capacity of $400,000.00 for a total capacity of $1,400,000.00.
This increased capacity is needed to be able to award projects that are ready or nearly ready to be
implemented before we are able to award a new JOC later this summer. Any work orders charged against
Amendment No. 1 are subject to availability of funds from the requesting departments.
Yeargan Construction Company -The Mark IV Construction Group, LLC, is in compliance with the City's
M/WBE Ordinance by committing to 25 percent M/WBE participation. The City's goal is 25 percent M/WBE
participation on this JOC..
This project is located in COUNCIL DISTRICT 9.
FISCAL INFORMATION /CERTIFICATION:
The Financial Management Services Director certifies that funds for this Work Order are available in the
current capital budget, as appropriated, of the Fire Improvements Fund.
