AND XTO ENERGY INC., FOR THE PURPOSE OF PURCHASING FITNESS EQUIPMENT FOR FIRE STATION NO. 2; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2011 -2012 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the General Fund in the amount of $3,500.00, subject to receipt of monetary donations from Quicksilver Resources Inc. and XTO Energy Inc., for the purpose of purchasing fitness equipment for Fire Station No. 2. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance No. 19911 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. SECTION 4. This ordinance shall take effect upon adoption. Authorize acceptance of monetary donations in the amount of $1,500.00 from Quicksilver Resources Inc. and $2,000.00 from XTO Energy Inc.; 2. Adopt attached supplemental Appropriation Ordinance increasing estimated receipts and appropriations in the General Fund by $3,500.00 subject to receipt of monetary donations; 3. Authorize purchase of fitness equipment for Fire Station No. 2 in accordance with City of Fort Worth regulations and state laws. DISCUSSION: Fire Station No. 2 is located in and responds to emergency and service calls in the downtown area, which is populated with high -rise buildings. Firefighters must use the stairs to respond to emergency calls in a timely and competent manner in these types of buildings. The donations from Quicksilver Resources and XTO Energy Inc., will be used toward the purchase of a stair climber for Fire Station No. 2 to aid responders in achieving and maintaining fitness levels appropriate to the service area. The equipment will be purchased in accordance with City regulations and State and local laws.
