WHEREAS, the City of Fort Worth ("City") and LopezGarcia Group, Inc.
("Engineer") made and entered into City Secretary Contract No. 35401, (the "Contract")
which was authorized by the City Council by M&C — C22169 on the 12th day of June,
2007 ; and
WHEREAS, the Contract involves engineering services for the following project:
Engineering contract for the design of drainage improvements for the East
Rosedale Street Project .
WHEREAS, it has become necessary to execute Amendment No. 1 to said
Contract to include an increased scope of work and revised maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through their duly
authorized representatives, enter into the following agreement which amends the
Contract:

Article I of the Contract is amended to included the additional engineering
services specified in a proposal letter, a copy of which is attached hereto and incorporated
herein. The cost to City for the additional services to be performed by Engineer total
$16,584.00.
2.
Article II of the Contract is amended to provide for an increase in the maximum
fee to be paid to Engineer for all work and services performed under the contract, as
amended, so that the total fee paid by the city for all work and services shall not exceed
the sum of $104,216.00,
3.
All other provision of the Contract which are not expressly amended herein shall
remain in full force and effect.

RE: Request for a Supplemental Agreement for a Preconstruction Notification
(PCN)
Dear Ms. Young:
Our firm is currently working on the E. Rosedale project from IH35 to US 287. A
PCN is required because we are required to do some drainage work that uses a
trapezoidal channel that exceeds the allowable disturbed area. Due to this
unexpected work, our firm is requesting a supplemental to conduct a PCN for this
project. Attached you will find the fee proposal.

SCOPE OF SERVICES
Section 404 Permitting
Exhibit A
This proposal is for environmental permitting and consulting services by LOPEZGARCIA GROUP
(LGGROUP) for TxDOT .
1.0 SCOPE
LGGROUP's scope shall consist of providing Section 404 permitting services for impacts to
Sycamore Creek, associated with the planned upgrade to East Rosedale Road in Fort Worth,
Texas.
This proposal is based on the following tasks:
1.1 Agency Coordination -This project will require coordination with the U.S. Army Corps of
Engineers (USAGE). The coordination effort may include formal letters, e-mail, telephone
conversations, and potential meetings.
1.2. Environmental Setting - LGGROUP will conduct onsite field visits to evaluate existing
conditions. Information will be recorded including ordinary high water marks, bank
heights, vegetative species and wildlife species within the project area.
1.3. USAGE Permitting —Based on previous coordination efforts with the U.S. Army Corps of
Engineers (USACE), the proposed project will be permitted under the Nationwide
Permitting Program. It is anticipated that associated impacts to jurisdictional waters will
trigger criteria stipulated under a Nationwide Permit requiring that a Pre -Construction
Notification (PCN) will be filed.
The components of the PCN will include:
A. A description of the purpose and need for the project
B. An indication of possible areas of all waters of the United States in the project
area, including wetlands and other special aquatic sites, using the current
USACE Regulations and in accordance with the USACE's 1987 Wetlands
Delineation Manual.
C. Vicinity map and general project area location information, in relation to nearby
roadways and other pertinent features.
D. Plan, profile, and cross section views of all proposed work, permanent and
temporary.
E. Volume of material to be discharged and or excavated from jurisdictional
waters.
F. A written discussion of alternatives considered and a rationale for selecting the
proposed design as the most environmentally compatible.
G. An assessment of the adverse and beneficial effects, both permanent and
temporary of the proposed work and proposed mitigation.
H. A summary of prior coordination with resource agencies.
1.4 Meetings - LGGROUP will attend up to three meetings with TxDOT and/or the USAGE
during the course of the permitting process to coordinate project activities, review
progress and budget, and identify issues and courses of action needed to resolve any
issues.
2.0 LIMITATIONS
Performance of these tasks within the proposed schedule is dependent upon timely agency
review. Additional services required after submittal of the PCN, as a result of changes in
engineering design or other issues, are outside the scope of the contract.
3.0 ADDITIONAL SERVICES
Any additional coordination or material requested by the USACE or other parties to make their
determination, such as the preparation of a detailed mitigation plan or coordination with the Texas
Historic Commission, and any services not outlined above may be provided for an additional fee. If
impacts to jurisdictional waters are determined to exceed Section 404 Nationwide Permitting limits,
preparation of a USACE Individual Permit may be provided as an additional service.
