COUNTY OF TEXAS § CITY SECRETARY CONTRACT NO.
WHEREAS, the City of Fort Worth ("City") and Jones & Bow ("Consultant") made
and entered into City of Fort Worth City Secretary Contract No. 35388, ("Contract"); and
WHEREAS, the Contract involves professional services for the following project:
Park Improvements at Oakmont Park and Clear Fork Park; and
WHEREAS, it has become necessary to amend the Contract to include an increased scope
of work and/or revised maximum fee.
NOW, THEREFORE, City and Consultant, acting herein by and through their
duly authorized representatives, enter into the following agreement which amends the contract:
1.
Article I, Section A of the Contract is amended to include the additional engineering
services specified in a letter dated December 18, 2007, a copy of which is attached hereto and
incorporated herein.
2.
Article II of the Contract is amended to provide for an increase in the maximum fee in
the amount of $ 24,900.00, which is to be paid to Consultant for all work and services under the
Contract, as amended, so that the total fee to be paid by City for all work and services shall not
exceed the sum of $ 905400.00.
3.
All other provisions of the Contract that are not expressly amended herein shall remain in
full force and effect.

RE: Additional Services Proposal for F000dplain Engineering Services

Dear Mr. McElhany:
Thank you for permitting us the opportunity to submit this proposal for floodplain engineering
services on the referenced property. This proposal is based on providing a flood study to analyze three
future trail crossings located within Oakmont Park west of Bellaire South Road. Two of the trail
crossings are located on Stream CF-6, which is designated as a Zone AE floodplain with a floodway.
The third trail crossing is located on an un-named tributary designated as a Zone A floodplain. This
proposal excludes any work necessary for a future CLOMR or LOMR. Based on our conversations
and the information provided to us, we propose the following scope of services:
1. Topographic Survey — We will perform an on -the -ground topographic survey to supplement
previously surveyed data. The survey will also include additional six (6) creek cross -sections
needed for hydraulic modeling. Vertical control will be based on the nearest existing FEMA
Reference Mark. This phase of work is based on underbrush and low-lying limbs being removed
by others so a clear line of site for our instrumentation is established.
2. Waters of the U.S. Determination and Delineation — We will perform a Waters of the U.S.
studMY based on Army Corps of Engineers Section 404 guidelines. Jones &Boyd, Inc. will
perform this work through our wetland biologist subconsultant. The survey will delineate
potential jurisdictional waters that we will use in planning of the project. It should be noted that
only the U.S. Army Corps of Engineers can make the final determination of the type and quality
of jurisdictional waters. Additional permitting services may be required if impacts to the Waters
of the U.S. cannot be avoided.

3. Hydrologic Analysis — We will prepare a hydrologic analysis to determine the fully developed
and existing flow through the Zone A un-named tributary. The analysis will determine the 10-,
25-, 50-, 100- and 500-year flows for the stream. It is anticipated that no hydrologic analysis will
be needed for stream CF-6. Fully developed flows have previously been determined by others
upstream of the project site.
4. Hydraulic Analysis &Floodplain Development Permit — We will prepare hydraulic models for
both the un-named tributary and Stream CF-6 based on the above survey data and hydrologic
analysis. The models will be used to simulate pre -project and post project conditions and to
obtain a Floodplain Development Permit. The analysis will include review of alternative bridge
configurations (estimated 3 alternatives for each bridge).
SUMMARY OF FEE5
For the scope of services described herein, we propose to be compensated as shown on attached
Exhibit "A". Next to each work item, we have noted whether the fee is either a lump sum or hourly. If
the fee is noted to be hourly, the amount shown is an estimate because this work item is difficult to
estimate due to anticipated multiple iterations and/or meetings. Hourly based fees will be billed in
accordance with the attached Hourly Fee Schedule, Exhibit `B". For your budgeting purposes, an
estimated fee has been shown for hourly -based fees.
Non -labor expenses will be charged at cost plus ten (10%) percent. These expenses include all
necessary and related non -labor expenses incurred by Jones & Boyd, Inc., which are directly
chargeable to the work. These generally include expenses for reproduction, deliveries and filing fees.
The terms and conditions of our current contract shall apply to the work described in this proposal.
Services which are not expressly written in this agreement will be considered additional services.
Jones &Boyd, Inc. will not proceed with any additional services without your prior authorization.
This proposal is valid for sixty (60) days from the date of its submittal; if not accepted by the end of
the 60-day period, it is subject to change, renegotiation or withdrawal at the option of Jones &Boyd,
Inc.
If this proposal is acceptable, please signify your acceptance below by initialing each page of the
attached exhibits. Please return one fully executed original to us.
