AMENDMENT NO. 4 TO AGREEMENT FOR ARCHITECTURAL DESIGN SERVICES CITIZEN DROP-OFF STATION STATE OF TEXAS § CITY SECRETARY CONTRACT NO. COUNTY OF TARRANT § WHEREAS, The City of Fort Worth and Freese and Nichols, Inc. (Architect) made and entered into City Secretary Contract No. 35845 (The Contract) which was authorized by the City Council by M&C C-22341, the 28th day of August, 2007; and WHEREAS, further amendment is necessary to reimburse the Architect for additional design services for the Citizen Drop-Off Station to comply, investigate, and implement additional requirements of the Project as part of the design services agreement; and NOW THEREFORE, City and Architect, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article 1.1, SECTION I -SERVICES OF THE ARCHITECT, a paragraph is added to read as follows: "Provide additional design services to perform and provide additional Civil Engineering and Construction Administration Services for the new Citizen Drop-Off Station. The cost of the additional services is $37,690.00. The scope of services is more fully described in the Freese and Nichols, Inc. letter, dated July 15, 2010 & revised January 20, 2011, reference: Old Hemphill - Citizen Drop-Off Station: Fee Increase Request, with attachments, which are attached hereto as Attachment"A";and including, Freese and Nichols, Inc. letter, dated February 16, 2011, reference: Old Hemphill Citizens Drop-Off Station: Additional Services Proposal - MWBE Participation as Attachment"B", and made a part of this Agreement." 2. Paragraph 1 of SECTION V-COMPENSATION TO ARCHITECT, is amended as follows: "The total compensation for all of the assignments to be performed by Architect as described in CHARACTER AND EXTENT of ARCHITECT'S SERVICES hereof shall be a fixed fee of $236,913.00 for the Citizen Drop-Off Station plus up to$16,600.00 for reimbursable expenses." All other provisions of this Contract which are not expressly amended herein shall remain in full force and effect. EXECUTED this the l) day of 2011, in Fort Worth, Tarrant County, Texas. The changes resulted in additional construction administration services,which have been included. • Effort required to incorporate the change in location of the solar power arrays on the Site Plat Plan. These changes also affected the landscape plan and Urban Forestry Plan. The effort associated with aforementioned changes has been included. • Additional construction administration services directly related to extension of the construction schedule. A more detailed account of specific services can be provided upon request The total requested amount is$37,690. The additional services not included in this request are the additional CA hours necessary for the remainder of the project (09/01/2011 to 10/31/2011), the hours required for the preparation of the demolition plan of the temporary drive, and the hours required for the landscape site walk- thru. Project Architect TPW/Facilities Management—Architectural Services City of Fort worth 401 West 13th Street Fort Worth,Texas 76102-4616 Re: Old Hemphill Citizens Drop-Off Station: Additional Services Proposal—MWBE Participation Dear Mr.Meza: In reference to our January 20,2011 letter identifying the additional services amount of$37,690 for hydraulic analysis,water line changes,plat pian/Forestry changes and additional Construction Administration(CA)time by FNI(wanted to further explain the participation that was involved in that effort. The hydraulic analysis was performed per the request of the Floodplain Department. FNI was the only firm involved in this task;therefore,no MWBE participation occurred. The water line changes resulted from changes in the City's design of the water main feeding the site. The changes to the construction documents were performed by our MWBE subconsultant, Multatech,for the amount of$2,280,and the associated CA services were performed by FNI. The plat plan changes were required by Planning and Zoning and a result of the solar panels being relocated. This relocation also affected the Forestry Plan. The plat plan changes were addressed by FNI while the Forestry Plan changes were addressed by our MWBE subconsultant, Leonard Technical Services, Inc.(ITS),for the amount of$2,350. The release of the construction permit was dependent upon the completion of these tasks. The CA services,totaling$21,000,did not represent an add-to,or change to the original scope but were merely limited to the additional hours incurred by FNI staff to attend meetings,process pay requests,etc.during the delayed-schedule period. The Notice to Proceed occurred in November 2009 with a projected completion date of March 2010. The CA services requested are for the extended schedule of April 2010 to August 2010.
