HomeMy WebLinkAboutContract 35845-A5 AMENDMENT NO. 5 to AGREEMENT for ARCHITECTURAL DESIGN SERVICES CITIZEN DROP-OFF STATION STATE OF TEXAS § § CITY SECRETARY CONTRACT NO.3 SD qS—K COUNTY OF TARRANT § WHEREAS, The City of Fort Worth and Freese and Nichols, Inc. (Architect) made and entered into City Secretary Contract No. 35845 (The Contract) which was authorized by the City Council by M&C C-22341, the 28th day of August, 2007; and Amendment Nos. 1, 2, 3, & 4 were administratively executed in the amount of $122,654.00 for the Urban Forestry Ordinance adherence, site modifications, platting requirements and flood plain requirements; and WHEREAS, further amendment is necessary to reimburse the Architect for additional construction administration services the Architect incurred during the delayed-construction schedule period for the new Old Hemphill Road Citizen Drop-Off Station facility; and NOW THEREFORE, City and Architect, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article 1 1, SECTION I—SERVICES OF THE ARCHITECT, a paragraph is added to read as follows: "Provide additional construction administration services for the construction schedule delays beyond the original project completion date. The cost of the additional services is $12,414.00 total. The scope of services is more fully described in the Freese and Nichols, Inc. letter, dated June 3, 2011 & revised July 13, 2011, reference: Old Hemphill — Citizen Drop-Off Station: Fee Increase Request, with attachments, which are attached hereto as Attachment "A", and made a part of this Agreement." 2. Paragraph 1 of SECTION V- COMPENSATION TO ARCHITECT, is amended as follows: "The total compensation for all of the assignments to be performed by Architect as described in CHARACTER AND EXTENT of ARCHITECT'S SERVICES hereof shall be a fixed fee of $249,327.00 for the Citizen Drop-Off Station plus up to$16,600.00 for reimbursable expenses." All other provisions of this Contract which are not expressly amended herein shall remain in full force and effect. EXECUTED this the _day of Sl/� , 2011, in Fort Worth, Tarrant County,Texas. Project Architect TPW/Facilities Management—Architectural Services City of Fort Worth 401 West 13th Street Fort Worth,Texas 76102-4616 Re: Old Hemphill Citizens Drop-Off Station: Additional Services Proposal—MWBE Participation Dear Mr.Meza: In reference to our June 3,2011 letter identifying the additional services amount of$12,414 for the additional CA hours necessary for the remainder of the project(09/01/2011 to 10/31/2011),the hours required for the preparation of the demolition plan of the temporary drive,and the hours required for the landscape site walk- thru, I wanted to further explain the participation that was involved in that effort. The CA services,totaling$9,800,did not represent an add-to,or change to the original scope but were merely limited to the additional hours incurred by FNI staff to attend meetings,process pay requests, etc.during the delayed-schedule period. The Notice to Proceed occurred in November 2009 with a projected completion date of March 2010. The CA services requested are for the extended schedule of September 2010 to October 2010. All CA services in this request were performed by FNI staff with no MWBE participation. The demolition plan was created per the request of the client(City of Fort Worth Environmental Management). FNI was the only firm involved in this task;therefore,no MWBE participation occurred. The landscape site walk- thru was performed at the end of the project as an additional service by our MWBE subconsultant, Leonard Technical Services, Inc.(LTS),for the amount of$934.
