HomeMy WebLinkAboutContract 35859 AMENDMENT NO. 2 TO AGREEMENT FOR ARCHITECTURAL DESIGN SERVICES NEIGHBORHOOD POLICE STATION AND TRAFFIC DIVISION FACILITY STATE OF TEXAS CITY SECRETARY CONTRACT NO. COUNTY OF TARRANT WHEREAS, The City of Fort Worth and Perkins Will (Architect) made and entered into City Secretary Contract No. 32411 (The Contract) which was authorized by the City Council by M&C C-20926, the 30th day of August, 2005; and WHEREAS, further amendment is necessary to reimburse the Architect for including the design and certification documents for Leadership in Energy and Environmental Design (LEED) certification; and NOW THEREFORE, City and Architect, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article 1.1, SECTION I—SERVICES OF THE ARCHITECT, a paragraph is added to read as follows: "Provide additional design services to include the design and certification documents for the LEED certification for the Neighborhood Police Station and Traffic division facility on Nashville Avenue. The cost of this additional service is $28,200.00. The scope of services is described more fully in the Perkins Will EMail dated August 15, 2007 subject: Nashville Police Substation LEED Fees with the attached memo dated August 15, 2007, subject: Nashville Police Substation - LEED, which is attached hereto and as Attachment"A"and made a part of this Agreement." 2. Paragraph 1 of SECTION V-COMPENSATION TO ARCHITECT, is amended as follows: "The total compensation for all of the assignments to be performed by Architect as described in CHARACTER AND EXTENT of ARCHITECT'S SERVICES hereof shall be a fixed fee of $667,570.00 plus up to$4,600 in reimbursable expenses." 3. We believe that there could be tremendous benefit to the City of Fort worth to pursue official LEED Certification for the project. Since this would be the City' s first LEED Certified building, this could set the standard for future projects. The requested additional costs associated with LEED Certification are as follows: 1. Design - (No Additional Charge) P+W feels strongly that good design is sustainable design and therefore it is inherit in the way we design buildings. Although many additional hours have been spent in the development of sustainable strategies for the project, this is included in our base fee. 2. Documentation - $26,000 Industry standard and our experience indicates that it takes approximately 300 hours to develop the required LEED documentation for the submission process over the course of the project. This documentation covers a period of about two years from pre-design to post occupancy. The process involves extensive online and offline documentation in order to justify the LEED points that are being pursued. 3. Registration Fee - $450 This is the required fee by LEED for project registration and setup. This is the discounted Perkins+Will 's member price. 4. Certification Fee - $1,750 NORTH AMERICA I ASIA I MIDDLE EAST I AFRICA I EUROPE ��b This is the required fee by LEED for verification of project certification. Essentially, they review the documentation that we provide and ap�rove or disapprove the various points or credits that we are pursuing. 5. Building Commissioning Program - (No Additional Charge - Included in Base Contract) This is the various third party building commissioning that is required by LEED. Fortunately, the City of Fort Worth already requires this on projects and therefore this fee of $17, 730 was included in the base contract. In summary, the total additional cost that would be incurred by the City of Fort North to obtain LEED certification for the project is $28,200. As I mentioned in our meeting, the sooner the decision can be made the better. We have some documentation from the earlier phases to go back and do and it would be helpful to document the CD phase as we proceed through it . DISCUSSION: On August 30, 2005, (M&C C-20926) the City Council authorized the City Manager to execute an architectural design agreement in the amount of$300,000.00 with Perkins and Will to design the Neighborhood Police Station and Traffic Division facility. Funding in the amount of$332,000 was approved from the Crime Control and Prevention District (CCPD) to support design. Additional funding in the amount of$350,000 was approved from the Critical Capital Needs Certificate of Obligation, Series 2007 to complete the design of the Neighborhood Police Station and Traffic Division facility. On July 31, 2007, (M&C C-22276) the City Council authorized the City Manager to execute Amendment No. 1 in the amount of$343,972.00 to the professional services agreement with Perkins and Will. Funds in the amount of$40,000 are needed for Amendment No. 2 and soil boring cost. This amendment is significant because it will produce the first LEED certified design for a municipal building in the City of Fort Worth. This project will set an example for future sustainable development, not just for municipal facilities, but throughout our construction community. The estimated construction cost could potentially increase approximately 2 percent to meet LEED certification standards. The potential increases will be evaluated by staff during the design phase and any cost increase will be funded from project contingency. The additional $11,000.00 is for soil borings/investigation and staff time. Once the design is completed and advertised, staff will request the approval of the remainder of the funds for construction, including funds for the design firm's construction administration services.
