HomeMy WebLinkAboutOrdinance 18568-04-2009Ordinance Nc. 18568-04-2009 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE GRANTS FUND IN THE AMOUNT OF $33,t}00.00, UPON REGEEPT OF TWO GRANTS FROM THE BURNETT FOUNDATION, FOR THE PURPOSE OF FUNDING THE REIOCATiON AND MAINTENANCE OF THE CHARLES DAVID TANDY SCULPTURE; PROVIDING FOR A SEVERABIIiTY CLAUSE: MAKING THIS ORDINANCE CUMUC_ATIVE OF PRIOR ORDINANCES fN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIt_ OF THE CITY OF FORT WORTH, TEXAS: SECTION 1 That in addition to those amounts allocated to the various City departments for Fiscal Year 2008-2009, there shall also be increased estimated receipts and appropriations in the Grants Fund in the amount of $33,000.00, upon receipt of two grants from the Burnett Foundation, for the purpose of funding the relocation and maintenance of the Charles David Tandy Scuipfure. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections at this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance Na. 18283 and ail other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations. in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Accept a grant in the amount of $30,000.00 from The Burnett Foundation for all costs associated with relocating the Charles David Tandy bronze sculpture; 2. Accept a grant in the amount of $3,000.00 from the Burnett Foundation for maintenance costs for three years; 3. Enter into a Long Term Agreement with Texas Christian University; 4. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations, in the Grants Fund by $33,000.40; and 5. Authorize a contract in an amount not tc exceed $30,000.00 for services with Unified Art Services, LLC, to deinstall, transport and reinstall the sculpture. The Burnett Foundation has committed up to $34,404.00 to underwrite aII costs associated with the relocation including deinsta(Iation, transport to TCU, installation of the sculpture and minor site remediatian in Paddock Park. Any funds not used for the relocation will be returned to the Burnett Foundation. The Burnett Foundation has also committed X3,000.40 to pay far the first three years of maintenance to the sculpture. Fort Worth Public Art, the City's designated contract manager, will supervise the relocation and maintenance on behalf of the City, Unified Art Services, LC.C, was selected through a competitive bid process to provide a(I services needed to relocate the sculpture. Costs for ongoing maintenance following the third year of the Agreement with TCU wil! be negotiated between the City, TCU and the Burnett Foundation. FISCAL INFORMATION t CERTIFICATION: The Financial Management Services Director certifies that upon approval of the above recommendations and adoption of the attached appropriation ordinance funds will be available in the current operating budget, as appropriated, of the Grants Fund.
