ITY SECRETARY SECOND AMENDMENT TO THE LEASE AGREEMENT
WHEREAS, the City of Fort Worth, a Texas home rule municipal corporation ("Lessee")
entered into a certain Lease Agreement dated June 1, 2008 (City Secretary Contract No. 37325),
with Texas Christian University ("Lessor") for leased premises located at 2900 W. Berry, Fort
Worth, Texas, 76129, more particularly described in the Lease("Leased Premises); and
WHEREAS, that certain Lease (as amended by subsequent renewals and modifications)
expired effective May 31, 2019; and
WHEREAS,by mutual agreement of both parties,the lease is in holdover status until the
amendment to extend the lease term is approved and executed; and
WHEREAS,the Lessee and Lessor desire to extend the current lease renewal term one(1)
year with an effective date of June 1, 2019 and expire May 31, 2020 with two (2) automatic
successive one (1) year renewals to expire May 31, 2022,
NOW THEREFORE, in consideration of the rentals set forth in the Lease, the parties
agree to amend the lease as follows:
1. The Lease, in Section 3, "Term", provides for five successive renewal terms of 12 months
each, which renewals were properly exercised, and which the final renewal term shall expire on
May 31, 2019. The parties hereby agree that the Lease be amended to provide for the current
renewal term to expire May 31, 2020, and for Tenant to have two (2) additional automatic,
successive, one (1)-year renewal terms, which final renewal term shall expire May 31,
2022. Each renewal term shall automatically occur unless Tenant shall give Landlord written
notice of the intent not to renew in not less than 30 days prior to the beginning of the next
renewal term.
All other terms and conditions of the Lease remain unchanged and in full force and effect.

SUBJECT: Authorize Execution of a Lease Amendment with Texas Christian University to Extend the
Current Lease Renewal Term for One Year and Add Two Additional One Year Renewal

RECOMMENDATION:
It is recommended that the City Council authorize execution of a lease amendment with Texas
Christian University to extend the current lease renewal term for one year and add two additional
one-year renewal terms for space located at 2900 W. Berry Street for a police storefront for the Fort
Worth Police Department.
DISCUSSION:
On July, 8, 2008, City Council approved the execution of a lease with Texas Christian University for
space located at 2900 W. Berry Street, Fort Worth, Texas 76129 to be utilized by the Fort Worth
Police Department as a police storefront (M&C C-22890). The lease was effective June 1, 2008 with
rent of$1.00 per year(City Secretary Contract No. 37325).
By mutual agreement of the parties, the lease continues in holdover status until the amendment is
approved. Approval of this Mayor and Council Communication will authorize the execution of an
amendment to the lease to extend the current lease term for one year with an effective date of June
1, 2019, with two automatic successive one-year renewals expiring on May 31, 2022.
This property is located in Council District 9.
FISCAL INFORMATION/CERTIFICATION:
The Director of Finance certifies that funds are available in the current operating budget, as
appropriated, of the Crime Control and Prevention District Fund.

Yes I saw the naming history cause I clicked on all of them to read the wording of the document and it looks like they
were just numbered incorrectly.
If it is okay with Mary I can go back in and change the metadata to reflect what it should be correctly.Unfortunately I
don't think changing the numbering will help now that everyone's copy has those numbers and then some of the
documents list the previous ones which will cause confusion.I can number this one as 37325-A4 but in the metadata make
sure to place this as Amendment No. 2

Vania,this one has a convoluted naming history at the CSO, but the Amendment we sent to you is legally the second
amendment. The problem started after the first amendment. Here's what I discovered,in chronological order:
CSC No.37325:The initial lease,with a term through 5/31/10
37325-112:A renewal of the term from 6/1/11 through 5/31/12. 1 don't know where R1 is,as it didn't pull up in the
system.
37325-A1: The first amendment,which,among other things, extends the expiration term from 6/1/12 to 5/31/14.
37325-A2: This is actually a renewal, not an amendment,despite the "A2"designation. It extends the term from
6/1/14-5/31/15.
37325-A3: Also a renewal and not an amendment,despite the "A3" designation. It extends the term from 6/1/15-
5/31/16.
37325-113: This is a renewal and is numbered as one,although not exactly in proper sequence given the two above. It
extends the term from 6/l/16-5/31/17.

37325-114: Also a renewal. Extends the term from 6/1/17-5/31/18.
37325-R5:Also a renewal. Extends the term from 6/1/18-5/31/19.
And that brings us to the document you have now,which is an amendment,which also effects a renewal, but should be
numbered as an amendment. I'm not sure what y'all want to do about the older ones that are not designated
properly. If it isn't feasible to change them,then this one should be numbered 37325-A4.

Subject:Question about Numbering for CSC No. 37325
I have the second amendment to the Lease Agreement(CSC No.37325)but there is already an Amendment No.2 on file
but it states that it should be Renewal 3 on the metadata.There is also an Amendment No. 3 on file so I am not sure how
this one should be numbered.These previous amendments/renewals were done before I came into this office so I am not
sure how you would like to proceed with this.
