HomeMy WebLinkAboutOrdinance 23582-03-2019 ORDINANCE NO. 23582-03-2019 AN ORDINANCE INCREASING ESTIMATED RECEIPTS AND APPROPRIATIONS IN THE WATER AND SEWER CAPITAL PROJECTS FUND, FROM AVAILABLE FUNDS IN THE AMOUNT OF $437,985.00, FOR THE PURPOSE OF FUNDING THE BIG FOSSIL CREEK PARALLEL RELIEF SANITARY SEWER M-402A, PHASE 1 AND HALTOM CITY METER STATION AND SEWER OUTFALL, PHASE 3 PROJECT; PROVIDING FOR A SEVERABILITY CLAUSE; MAKING THIS ORDINANCE CUMULATIVE OF PRIOR ORDINANCES; REPEALING ALL ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF FORT WORTH, TEXAS: SECTION 1. That in addition to those amounts allocated to the various City departments for Fiscal Year 2018-2019 in the Budget of the City Manager, there shall also be increased estimated receipts and appropriations in the Water and Sewer Capital Projects Fund in the amount of$437,985.00, from available funds, for the Big Fossil Creek Parallel Relief Sanitary Sewer M-402A, Phase 1 and Haltom City Meter Station and Sewer Outfall, Phase 3 Project. SECTION 2. That should any portion, section or part of a section of this ordinance be declared invalid, inoperative or void for any reason by a court of competent jurisdiction, such decision, opinion or judgment shall in no way impair the remaining portions, sections, or parts of sections of this ordinance, which said remaining provisions shall be and remain in full force and effect. SECTION 3. That this ordinance shall be cumulative of Ordinance 23392-09-2018 and all other ordinances and appropriations amending the same except in those instances where the provisions of this ordinance are in direct conflict with such other ordinances and appropriations, in which instance said conflicting provisions of said prior ordinances and appropriations are hereby expressly repealed. Adopt the attached appropriation ordinance increasing estimated receipts and appropriations in the Water and Sewer Capital Projects Fund in the amount of$437,985.00 from available funds; and 2. Authorize execution of a Change Order No. 2 to City Secretary Contract No. 48098 with Oscar Renda Contracting, Inc., in the amount of$437,985.00 and the addition of 325 calendar days for Big Fossil Creek Parallel Relief Sanitary Sewer M-402A, Phase 1 and Haltom City Meter Station and Sewer Outfall, Phase 3. (City Project No. CO1303) DISCUSSION: On June 28, 2016, Mayor and Council Communication (M&C C-27823), the City Council authorized a contract with Oscar Renda Contracting, Inc., (City Secretary Contract No. 48098) in the amount of $7,973,721.00 for construction of Big Fossil Creek Parallel Relief Sanitary Sewer M-402A, Phase 1 and Haltom City Meter Station and Sewer Outfall Phase 3. The contract was subsequently revised by Change Order No. 1 in the amount of$72,101.45 authorized administratively on December 10, 2018. Change Order No. 2 will provide for the construction of a larger sewer junction structure to provide for the connection of incoming large diameter sewer main to the outgoing sewer main and also allow for future maintenance. Construction is expected to be completed by May 2019. M/WBE OFFICE — Oscar Renda Contracting, Inc., is in compliance with the City's BDE Ordinance by committing to an additional two percent MBE participation on this change order. The project is located in COUNCIL DISTRICT 4. FISCAL INFORMATION/ CERTIFICATION: The Director of Finance certifies that upon approval of the above recommendation and adoption of the attached appropriation ordinance, funds will be available in the current capital budget, as appropriated, of Logname: 60BF0SSILPIANDP3CO2-RENDA Paize I of 2 the Water and Sewer Capital Projects Fund. The Fiscal Year 2019 Water Operating Budget includes appropriations of$35,856,873.00 for the purpose of providing Pay-As-You-Go funding for Sewer Capital Projects. After this transfer for Fiscal Year 2019, the balance will be $25,161,727.00.
