COUNTY OF TARRANT §
WHEREAS, the City of Fort Worth ("City") and Neel-Schaffer, Inc.
("Engineer") made and entered into City Secretary Contract No. 35439, (the "Contract")
which was authorized by the City Council by M&C -C-22156 on the 5th day of June,
2007 ; and
WHEREAS, the Contract involves engineering services for the following project:
Engineering contract for the design of drainage improvements for the Grassland
Court Project.
Capital Project No. 00479; DOE NO.5419
WHEREAS, it has become necessary to execute Amendment No. 2 to said
Contract to include an increased scope of work and revised maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through their duly
authorized representatives, enter into the following agreement which amends the
Contract:
1.
Article I of the Contract is amended to include the additional engineering services
specified in a proposal letter, a copy of which is attached hereto and incorporated herein.
The cost to City for the additional services to be performed by Engineer total $64,300.
2.
Article II of the Contract is amended to provide for an increase in the maximum
fee to be paid to Engineer for all work and services performed under the contract, as
amended, so that the total fee paid by the city for all work and services shall not exceed
the sum of$141,690.
3.
All other provision of the Contract which are not expressly amended herein shall
remain in full force and effect.

Reference: Grassland Court Drainage Contract Amendment 2 for Design Services
Dear Mr. Bergeron:
Neel-Schaffer, Inc. (NS1) offers additional Professional Engineering Services for this project.
These additional services are required to follow up on the study on Grassland Court with design
services as discussed recently in our meeting with Steve Eubanks.
This Engineering Services Contract Amendment includes the following attached to this letter:

NSI proposes to provide the attached scope of additional services for the lump sum of
$64,300.00.

All additional services proposed will be performed in accordance with the original contract dated
June 22, 2007. The survey work will be completed by Spooner & Associates, our M/WBE
Subconsultant. Their share will be 13.14% or $8,450.00. The geotechnical work will he
performed by Alpha Testing, Inc.
This Amendment, consisting of two pages, and the attached documents described above
represent the entire Amendment 2 to the original agreement between the City of Fort Worth and
Neel-Schaffer, Inc. If the terms of this Amendment are acceptable, please execute both copies
and return one to our office to begin the design services.

SUPPLEMENTAL SCOPE OF SERVICES

PROFESSIONAL SERVICES: DRAINAGE DESIGN FOR GRASSLAND COURT—
AMENDMENT 2

The following is a clarification of the tasks that the ENGINEER will perform under
ATTACHMENT "A". Work under this attachment includes the preparation of a drainage design
for the project area described below and shown graphically on Attachment E:
Additional work is necessary following the drainage study on Grassland Court for design including
preparation of construction drawings and documents. The limits of the proposed project extend
from Eagle Mountain Lake, through the existing culvert to Crosswind Drive (approximately 200'),
up and around the existing channel to near the Quail Ridge outfall (approximately 800') and up the
tributary channels (approximately 100' each)to the existing closed drainage systems from Skylake
(at Quail Ridge and Woodside Hill). No plans are considered for the closed drainage system
planned from Skylake (at Westwind)which we have been advised will not enter this system.
A combination of a closed system and an open system that will contain the 100-year discharge is
proposed. It will have a licadwall to capture die flow from the upen area north and east of
Grassland Court. The system will carry the capacity flow from the existing system in Quail Ridge
and the 100 year flow from the open area at the upstream headwall. The Quail Ridge system will be
extended and connected to this proposed system at a manhole. The proposed system will extend
slightly farther upstream to capture the open area. Local and overflow storm water will be carried
in a swale(above the closed system)and captured in a drop inlet. The flow from the Woodside Hill
system will he captured .similarly. The remaining flow in the open area will he captured in another
drop inlet upstream from the culvert. Finally, the culvert will be improved to carry the discharge in
conjunction with another swale from Crosswind to the lake.
Upon receipt of an executed amendment,the Engineer will perform the following tasks:
Data Collection
• Attend and document a Pre-design kick-nff meeting to discuss and coordinate various aspects
of the project and to ensure that the project stays on schedule.
• Research and make efforts to obtain pertinent information to aid in coordination of the
proposed improvements with any planned future improvements that may influence the project.
Identify and seek to obtain data for existing conditions that may impact the project including:
utilities, City Master plans and property ownership as available from the Tax Assessor's office.
• Coordinate with utilities, including utilities owned by the City. These entities-s-s a(f a so

contacted if applicable, to determine plans for any proposed facilities or adjustment to existing
facilities within the project limits. The information obtained shall be shown on the plans.
• Perform one site visit.
Survey
• Perform field surveys to collect horizontal and vertical elevations and other information needed
in design and preparation of plans for the project. Information gathered during the survey shall
include topographic data, elevations of all sanitary and adjacent storm sewers, rim/invert
elevations, location and elevations of known buried utilities, structures, and other visible
features that would affect proposed construction.
• Establish survey control or a suitable reference base line on the ground and obtain complete
and accurate cross section data at a maximum of 50 foot intervals and at major grade breaks.
• Provide legal descriptions and exhibits for three easements necessary for the construction of the
project to the City for acquisition.
Calculations
A drainage area map will be drawn at a scale of 1"—200' (or on an appropriate scale to fit on one
sheet) from available contour maps. Prepare rational method hydrologic calculations and Manning
equation hydraulic calculations for drop inlets,pipes, the overflow swale and the culvert.
Permitting
Submit copies of the proposed project information for the Corps of Engineers to make a
determination for permitting under Section 404 of the Clean Water Act and Section 10 of the
Rivers acid Harbor Act as applicable. It is anticipated that the project can be authorizcd under
Nationwide Permit 7 for out-fall structures.
Geotechnical
Perform a geotechnical investigation including: soil borings of sufficient quantity (three to a depth
of 10')to determine depth to rock, provide a laboratory analysis, and prepare a report of field and
laboratory data.

• Proposed plan/profile sheets will conform to City of Fort Worth construction legend.
• Existing channel centerline,existing left and right top of channel bank, existing utility crossings
and existing right-of-way/easement.
• Profiles fur existing and proposed stone drain mains and leads.
• Adequate horizontal and vertical control to locate all proposed and existing facilities.
• Existing found property corners(e.g. iron pins) along the existing right-of-way.
• Legal descriptions(Lot Nos., Block Nos. and Addition Names) along with property ownership.
• Limits of proposed rights-of-way or easements and temporary construction easements.
• Proposed top of channel banks, channel flow line (existing and proposed), 100 year water
surface profile along with water and sanitary sewer line arljuetments to accommodate the
proposed channel improvements.
• Culvert upgrades and roadway pavement replacement.
• Typical channel details.
Channel cross-sections at 50 foot intervals along the project length will extend to the right-of-way
or easement line on both sides of the channel. Additional cross-sections at important features
including grade breaks in the channel flow line, retaining walls, etc., will also be provided. Scale
will be I"—20' horizontally and 1"—2' vertically.
Preliminary Construction Documents
• Preliminary plans and specifications shall be submitted within 120 days of receipt of signed
amendment.
• Sixteen (16) sets of preliminary construction plans and two (2) sets of specifications and
contract documents will be delivered for review and distribution to utility cunipaides.
• Submit a preliminary estimate of probable construction cost.
• Meet to discuss teview comments from preliminary submittal.
• Attend public meeting(coordinated by City)to help explain the proposed project to residents.
Final Construction Documents
• Final Construction Documents shall be submitted within 60 days of receipt of preliminary
review comments.
• Submit a final estimate of probable construction cost.
• Prepare final plans and specifications and contract documents (each sheet stamped, dated and
signed)and submit two (2)sets within 15 days of final approval.
Bidding
• Make available for bidding up to forty (40) sets of the final approved and dated plans and
specifications and contract documents to the City for distribution to potential bidders. Provide
four(4)sets of all easements to the City forbidding purposes.
• Assist the City; including preparation and delivery of addenda to plan holders and responses to
questions submitted to the DUE by prospective bidders. _
• Attend the pre-bid conference.

Construction

I. Compensation
A. The Engineer shall be compensated a total lump sum fee of$64,300.00 as summarized in
Exhibit "B-3". Payment of the total lump sum fee shall be considered full compensation
for the services described in Attachment "A" and Exhibit "A-l" for all labor materials,
supplies and equipment necessary to complete the project. All permitting, application and
similar project fees will be paid directly by the City.
B. The Engineer shall be paid in four partial payments as described in Exhibit "13-1",
Section 1 —Method of Payment.
C. Each invoice is to be verified as to its accuracy and compliance with the terms of this
contract by an officer of the Engineer.
II. Schedule(Calendar Days)—Refer lu Attachntem D for the complete schedule.
A. Preliminary plans and specifications shall be submitted within 120 calendar days after the
"Notice to Proceed" letter is issued.
B. Final plans and specifications shall be submitted within 60 calendar days after approval
of preliminary plans and specifications.
C. Bidding plans and specifications shall be submitted within 15 calendar days after
approval of final plans and specifications.

1. Method of Payment
Partial payment shall be made to the ENGINEER monthly upon City's approval of an
invoice from the ENGINEER outlining the estimated current percent complete of the total
project.
The aggregate of such monthly partial fee payments shall not exceed the following.
• Until delivery of the preliminary construction documents, a sum not to exceed 60 percent
of the total Jump sum fee.
• Upon delivery of the final construction documents, a sum not to exceed 90 percent of the
total lump sum fee.
The balance of fee, less previous payments, shall be payable after the pre-construction
conference.
II. Progress Reports
The ENGINEER shall submit to the designated representative of the Director of the Department
of Engineering monthly progress reports covering all phases of the study in the format required
by the City.

Authorize Amendment No. 2 in the Amount of$64,300.00 to Contract No. 35439 with Neel-Schaffer, Inc.,
for Storm Water Utility Project—Academy Boulevard Culvert Improvements and Grassland Court Drainage
Improvements
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute Amendment No. 2 in the
amount of$64,300.00 to City Secretary Contract No. 35439 with Neel-Schaffer, Inc., to provide additional
engineering services and plan preparation for the above-named project, thereby revising the total contract
amount to $141,690.00.
DISCUSSION:
The Storm Water Management Program was established to reduce flooding in the City of Fort Worth, to
preserve streams, minimize water pollution and to operate the storm water system in a more effective
manner to fully comply with State and Federal regulatory requirements. On October 16, 2007, (Ordinance
No. 17840-10-2007) City Council authorized the issuance and sale of$25,000,000.00 in Storm Water
(Drainage) Revenue Bonds, Series 2007, to fund a two-year Storm Water Capital Project Program.
On June 5, 2007, (M&C C-22156) the City Council authorized the City Manager to execute an Engineering
Agreement (Agreement) with Neel-Schaffer, Inc., (City Contract No. 35439) for a study for Academy
Boulevard culvert improvements and Grassland Court drainage improvements. The result of the study for
Grassland Court was a recommendation for upgrading the existing storm drainage facilities. The drainage
study also recommended upgrading the drainage facilities and culverts in the green space adjacent to
Grassland Court that provide an outfall for the Grassland Court drainage system.
This Amendment No. 2 will allow Neel-Schaffer, Inc., to perform the necessary design for the Grassland
Court project that is beyond the recommendations of the study. Academy Boulevard is a separate part of
the project and will be addressed in another design. That design will also require a scope amendment
which will be handled separately from Grassland Court and at a later time.
Neel-Schaffer, Inc., proposes to perform the additional necessary work for a lump sum fee of$64,300.00.
City staff considers this fee to be fair and reasonable for the scope of services proposed.
In addition to the contract amount, $6,430.00 is required for project management by the Transportation
and Public Works Department.
Neel-Schaffer, Inc., is in compliance with the City's M/WBE Ordinance by committing to an additional 13
percent M/ BE participation on this Amendment No. 2. The City's goal on the amendment is 13 percent.
