WHEREAS, the City of Fort Worth (City) and Neel Schaffer,
Inc. , (Engineer) made and entered into City Secretary Contract No.
35439, (the Contract) which was authorized by the City Council by
MSC - C-22156 on the 5tn day of June, 2007; and
WHEREAS, the Contract involves engineering services for the
following project:
Academy Boulevard Extended Drainage Study and Grassland Court
Extended Drainage Design Project, Project No. 00479
WHEREAS, it has become necessary to execute Amendment No. 4
to said Contract to include an increased scope of work and revised
maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and
through their duly authorized representatives, enter into the
following agreement which amends the Contract:

Article I of the Contract is amended to include the
additional engineering services specified in a proposal letter
dated September 21, 2011, a copy of which is attached hereto and
incorporated herein. The cost to City for the additional design
services to be performed by Engineer total $29,390.
2 .
Article II of the Contract is amended to provide for an
increase in the maximum fee to be paid to Engineer for all work
and services performed under the Contract, as amended, so that the
total fee paid by the City for all work and services shall not
exceed the sum of $487,680.

All other provisions of the Contract which are not expressly amended
herein shall remain in full force and effect.

Reference: Amendment 44 for Grassland Court Water Line and Construction Management
Dear Mr. Pulido:
Neel-Schaffer, Inc. (NSI) is pleased to offer additional services for the above referenced project in
this amendment to the agreement dated June 22, 2007. This request is for the additional work
required to coordinate incorporating the 8" waterline in Quail Ridge into our Grassland Court
drainage plans, for the extra work necessary to coordinate the acquisition of additional easements
and finally for construction management services. Detailed Scopes of Services are attached to this
letter.
This Letter Amendment, consisting of one page, and the attached Scopes of Services, consisting
of two pages, represents the entire amendment to the agreement between the City of Fort Worth
and Neel-Schaffer, Inc. If the terms of this Amendment are acceptable, please execute the original
and the copy and return the copy to our office to continue the project.
All services were or will be performed in accordance with the original agreement.
We are requesting compensation as a lump sum fee of $8,450.00 for the water line work and a
lump sum fee of$20,940.00 for the construction management services. This Amendment contains
no M/WBE work as the services were or will be performed exclusively by Neel-Schaffer. The
change in contract amount is tabulated as follows:

Scope of Services for: Grassland Court Water Line Design and Construction Phase Services
Water Line Design
Additional services were required on Grassland Court to coordinate incorporating the 8" waterline
in Quail Ridge into the Grassland Court drainage plans and to coordinate the acquisition of
additional easements. The following were specifically included for the water line:
• Review and offer suggestions on the Water portion of the plans, especially the tie-in location
• Revise the Contract and Specifications Book and the bid items four times because there were
three different methods being considered for how the street was going to be repaired,re-
surfaced or rehabilitated; for how the project was going be separated into pay Units; and for
how the work was going to be compensated
• Put off putting together the final plans for a few weeks waiting for the decision on where the
tie-in point for the waterline was to be located
• Review and offer suggestions about pay items and quantities four times on the Water portion
of the Opinion(s) of Probable Costs
• Perform and prepare six different Opinions of Probable Costs,based upon the different street
repair/resurfacing scenarios and the different beginning location point of the Water contract
• Change the cover sheet of the plans twice because of changes in the sheet count for the Water
portion
• Review and offer suggestions on the Water portion of the Contract and Specifications Book
• Coordinate getting the Plans cover and the Contract and Specifications Book cover signed by
the Water consultant
• Spend time making the specifications and contract documents look like one homogeneous
contract document; assuring that there was clarity of intent and that there was no ambiguity or
duplication of terms or phrases
Other additional services were required on Grassland Court since the multi-property owner Lake
access agreement near the project outfall created the need for additional individual easement
documents. This required additional coordination efforts for easement acquisitions. The following
were specifically included for the easements:
• Review easement documents for the additional easements west of Crosswind Drive
• Communicate and coordinate with the Project Manager about moving funding for
easements from the Academy Boulevard Detention Pond Project to the Grassland
Drainage project
• Prepare four or five additional monthly reports due to the approximately six month
timeframe waiting on easement acquisitions
Finally, additional information was needed regarding an Oncor underground power line at
Crosswind and the large culvert crossing,which required additional coordination with Oncor for
an extra D-hole.

Construction Phase Services
ENGINEER will support the construction phase of the project as follows.
1. Construction Support
• The ENGINEER shall visit the project site at requested intervals as construction
proceeds to observe and report on progress.
• The ENGINEER shall review shop drawings, samples and other submittals submitted
by the contractor for general conformance with the design concepts and general
compliance with the requirements of the contract for construction. Such review shall
not relieve the Contractor from its responsibility for performance in accordance with the
contract for construction, nor is such review a guarantee that the work covered by the
shop drawings, samples and submittals is free of errors, inconsistencies or omissions.
The ENGINEER shall log and track all shop drawings, samples and other submittals in
Buzzsaw.
• As requested by the CITY, the ENGINEER shall provide necessary interpretations and
clarifications of contract documents, review change orders, and make
recommendations as to the acceptability of the work.
• The ENGINEER shall attend the "Final" project walk through and assist with preparation
of final punch list.
2. Record Drawings
• The ENGINEER shall prepare record drawings from information submitted by the
inspector and/or Contractor.
