COUNTY OF TARRANT §
WHEREAS, the City of Fort Worth (City) and Camp Dresser & McKee, Inc., (Engineer)
made and entered into City Secretary Contract No. 36010, (the Contract) which was authorized
by the City Council by M&C 22433 on the 2nd day of October, 2007; and
WHEREAS, the Contract involves engineering services for the following project:
Westside Water Treatment Plant and Raw Water Pipeline Design
WHEREAS, it has become necessary to execute Amendment No. 1 to said Contract to
include an increased scope of work and revised maximum fee;
NOW THEREFORE, City and Engineer, acting herein by and through their duly
authorized representatives, enter into the following agreement which amends the Contract:
1.
Article I of the Contract is amended to include the additional engineering services
specified in M&C C-24243, adopted by the City Council on May 18,2010, and further
amplified in a proposal letter dated February 11, 2010, a copy of which is attached hereto
and incorporated herein. The cost to the City for the additional professional services to
be performed by the Engineer total $421,000.00.

Article II of the Contract is amended to provide for an increase in the maximum fee to be
paid the Engineer for all work and services under the Contract, as amended, so that the total fee
paid by the City for all work and services shall not exceed $5,413,954.00.
All other provisions of the Contract which are not expressly amended herein shall remain
in full force and effect.

Engineering Services Scope and Fee(Revision 1)
Dear Mr.Harder:
CDM requests and increase in the upper limit fee for the referenced Engineering Services
Agreement based on additional out-of-scope engineering services performed related to re-
bidding the Westside Water Treatment Plant project and construction services for the 54-inch
raw water pipeline to be constructed later in 2010. This letter provides backup information
related to our request.
Westside WTP Project—Redesign and Rebidding
CDM has previously informed the City that engineering services outside the scope of our
contract have been performed related to rebidding the Westside Water Treatment Plant project.
Bids for construction of this project were initially received in October 2008. Due to the bidding
climate at the time,including limited available bidders and high construction material prices,the
low bid was significantly higher than the Engineer's opinion of probable construction cost and
the City's budget. The City requested CDM to review the design,associated costs,and bidding
process,and recommend a means for proceeding with the project. The plan of action included
rejecting the bids,modifying the plant design to reduce costs,pre-selecting major equipment for
assignment to the General Contractor,and using the Competitive Sealed Proposal(CSP)process
for bidding the project.
The additional work performed by CDM and our subconsultants is presented below:
Evaluate Project Changes to Reduce Construction Cost
1. Conducted internal team workshop in December to review and evaluate alternatives for
reducing project scope and costs.
2. Met with equipment vendors and subcontractors to develop means for reducing project
costs.

3. Formulated options and recommendations for reducing costs,and met with City staff in
January to discuss these issues. Based on these meetings,a plan for proceeding with the
project was finalized.
Equipment Pre-Selection
1. Developed equipment pre-selection specifications including development of front-end
documents and revisions to technical specifications.
2. Printed,distributed,and tracked pre-selection documents during the Equipment Pre-
Selection bidding process.
3. Answered questions from equipment suppliers,prepared addenda,and conducted pre-
proposal meeting.
4. Evaluated Equipment Pre-Selection proposals,clarified terms and exceptions taken by
equipment suppliers,and recommended suppliers to be included with the construction
contract.
Redesign of Westside WTP
1. Modified the initial Westside WTP drawings with cost saving changes.Design changes
included:
• Rerouting raw water pipeline to reduce overall pipe length.
■ Revising the ozone diffusion system and contact basin to include two sidestream
venturi pipeline injectors and two ozone contact basins.
■ Modifying the rapid mix basins and lime system to accommodate changes to the
ozone contact basin.
■ Reducing the number of plate settlers in the sedimentation basins.
■ Eliminating one of four operational filters.This includes media,underdrains,
troughs,piping,and valves.
■ Eliminating one of the five membrane racks,one feed pump,and associated piping
and valves.
■ Eliminating the membrane pilot plant.
■ Redesigning the electrical building to eliminate the PLC room and the basement and
using a pier foundation.
■ Modifying the site grading to accommodate additional onsite disposal of excavated
materials.
• Revising the electrical design to incorporate several cost saving measures.
2. Modified the initial Westside WTP specifications to incorporate changes for Competitive
Sealed Proposals,clarifications for pre-selected equipment,schedule modifications,and
technical specifications.

3. Produced an updated construction cost estimate.
Rebid the Westside WTP Project
1. Printed revised plans (two volumes) and specifications (five volumes),distributed
bidding documents,and tracked planholders.
2. Answered questions from contractors,subcontractors,and equipment suppliers,
prepared addenda,and conducted pre-proposal meeting.
3. Evaluated contractor pre-qualification packages and made recommendations to City.
4. Evaluated proposals from contractors submitting bids,prepared bid tabulation and
submitted recommendation for award.
This additional work was conducted during the six month period between November 2,2008
and May 2,2009. The associated engineering costs associated with these services are
summarized in the attached table. The total cost expended by CDM and its subconsultants for
the additional work was$486,715.42.
Raw Water Pipeline Project—Construction Services
The engineering fee negotiated for the referenced project was based on only one construction
contract. It was later decided to design and construct the 54-inch raw water pipeline under a
separate construction contract from the water treatment plant. Therefore,some of the
construction services tasks to be performed for the raw water pipeline are additional to what
were originally budgeted for the project. The City will provide construction inspection and will
coordinate distribution of documents for review from the Contractor. The City has requested
that CDM provide bidding services,establish topographical benchmarks,reviewing shop
drawings,and providing record drawings upon completion of construction. CDM will also
provide responses to Contractor questions during construction and attend periodic construction
meetings and site visits when requested.
The attached table presents the additional engineering fee for providing construction services for
the raw water pipeline. Please note that CDM has accounted for some submittal review that
would have taken place had the raw water pipeline been included in the WTP project. CDM
already has budget for establishment of the topographical benchmarks and has not requested
additional fee for these services. The total additional engineering fee for these construction
services is$40,093.
The total additional fee for the out-of-scope engineering services presented in this letter is
$526,808. However,CDM will complete the design phase of the project under budget by about
$105,000. Therefore,we request an amendment to our contract to increase the upper limit by
$421,000. If this is acceptable to the City we will prepare an amendment to our contract for
execution.

SUBJECT: Confirm Amendment No. 1 in the Amount of$421,000.00 to City Secretary Contract No.
36010, an Engineering Agreement with Camp Dresser& McKee, Inc., for the Redesign,
Repackage and Rebid of the Westside Water Treatment Plant Construction Contract
RECOMMENDATION:
It is recommended that the City Council authorize the City Manager to execute Amendment No. 1 in
the amount of$421,000.00 to City Secretary Contract No. 36010, an engineering agreement with
Camp Dresser & McKee, Inc., for the design of the Westside Water Treatment Plant, for the redesign,
repackage and rebid of the construction contract, thereby increasing the contract amount from
$4,992,954.00 to $5,413,954.00.
DISCUSSION:
On October 2, 2007, (M&C C-22433) City Council authorized the City Manager to execute an
engineering agreement with Camp Dresser& McKee, Inc., in the amount of$4,992,954.00 for the
design of the Westside Water Treatment Plant (City Secretary Contract No. 36010).
On October 16, 2008, the City received bids from two contractors for the construction of the Westside
Water Treatment Plant. The low bid of$61,185,000.00 was significantly higher than the city's
available budget. On December 16, 2008, (M&C C-23242)the City Council rejected both bids.
Subsequently, Camp Dresser& McKee, Inc., made contract revisions designed to lower the
construction cost and increase contractor participation. On March 13, 2009 the city took bids for
specialized treatment equipment to be used at the Westside Plant. On April 30, 2009 the city took
bids for the general construction contract, assigning the specialized equipment bids to the general
contractor. On June 23, 2009, (M&C C-23623) City Council awarded the Westside Plant construction
contract to McCarthy Building Companies, Inc., in the amount of$47,044,014.00.
Amendment No. 1 compensates Camp Dresser& McKee, Inc., for the extra work required to
redesign the Westside Plant plans and repackage the contract documents, including an equipment
pre-selection bid. These revisions, coupled with a much more competitive bid environment, allowed
the City to save substantial costs on the Westside Plant construction contract, compared with the
initial bid.
Camp Dresser& McKee, Inc., is in compliance with the City's M/WBE Ordinance by committing to an
additional 27 percent M/WBE participation on this Amendment No. 1. The City's goal on this
amendment is 21 percent.
This project is located in the City's extra-territorial jurisdiction, one quarter mile west of the
intersection of Old Weatherford Road and Chapin Road, in unincorporated Tarrant County, Mapsco
71 F.
FISCAL INFORMATION/CERTIFICATION:
The Financial Management Services Director certifies that funds are available in the current capital
budget, as appropriated, of the Water Capital Projects Fund.
