HomeMy WebLinkAboutContract 36010-A2 (2) i CITY SECRETARY Z AMENDMENT No. 2 CONTRACT 140' THE STATE OF TEXAS § CITY SECRETARY CONTRACT NO. 36010 (M&C Needed) COUNTY OF TARRANT § WHEREAS, the City of Fort Worth (City) and CDM Smith, Inc., (formerly Camp Dresser & McKee, Inc.), (Engineer) made and entered into City Secretary Contract No. 36010, (the Contract) which was authorized by the City Council by M&C 22433 on the 2nd day of October, 2007; and WHEREAS, the Contract involves engineering services for the following project: Westside Water Treatment Plant and Raw Water Pipeline Design WHEREAS, it has become necessary to execute Amendment No. 2 to said Contract to include an increased scope of work and revised maximum fee; NOW THEREFORE, City and Engineer, acting herein by and through their duly authorized representatives, enter into the following agreement which amends the Contract: 1. Article I of the Contract is amended to include the additional engineering services specified in M&C C-25709, adopted by the City Council on July 10, 2012, and further amplified in a proposal letter dated April 6, 2012, a copy of which is attached hereto and incorporated herein. The cost to the City for the additional professional services to be performed by the Engineer total $205,000. 2. Article II of the Contract is amended to provide for an increase in the maximum fee to be paid the Engineer for all work and services under the Contract, as amended, so that the total fee paid by the City for all work and services shall not exceed $5,618,954.00. All other provisions of the Contract which are not expressly amended herein shall remain in full force and effect. DISCUSSION: On October 2, 2007, (M&C C-22433)the City Council authorized the City Manager to execute of an engineering Agreement with Camp Dresser& McKee, Inc., in the amount of$4,992,954.00 for the design of the Westside Water Treatment Plant, Camp Dresser& McKee, Inc., has since changed its name to CDM Smith, Inc. On October 16, 2008, the City received bids from two contractors for the construction of the Westside Water Treatment Plant. The low bid in the amount of$61,185,000.00 was significantly higher than the City's available budget. On December 16, 2008 (M&C C-23242), the City Council rejected both bids. As part of Amendment No.1, Camp Dresser& McKee, Inc., made contract revisions designed to lower the construction cost and increase contractor participation. One of these revisions was to extend the allowable time the contractor had to complete the work from two years to three years. On April 30, 2009 the City took bids for the general construction contract. On June 23, 2009, (M&C C- 23623)the City Council awarded the Westside Plant construction contract to McCarthy Building Companies, Inc., in the amount of$47,044,014.00. The engineering Agreement with Camp Dresser& McKee, Inc., included construction services for a two year construction contract.Amendment No. 2 includes the additional costs associated with providing construction services for the longer duration construction contract. CDM Smith, Inc., is in compliance with the City's M/WBE Ordinance by committing to 28 percent MIWBE participation on this Amendment No.2. The City's goal on this amendment is 27 percent. This project is located in the City's extra-territorial jurisdiction, one quarter mile west of the intersection of Old Weatherford Road and Chapin Road, in unincorporated Tarrant County, Mapsco 71 F. Project Manager Fort Worth Water Department 151111th Avenue Fort Worth,Texas 76102 Subject: Westside Water Treatment Plant Project City Secretary Contract No.36010 M&C C-22433,October 2,2007 Engineering Services Scope and Fee Dear Mr.Harder: CDM Smith has previously informed the City that engineering services outside the scope of our contract are required related to services during construction for the Westside Water Treatment Plant project.The additional services performed and to be performed are required due the extension of the construction schedule,increased level of effort for supporting the construction manager,and significantly greater number of submittals and requests for information than originally planned. These items are further discussed below: Extended Consh-action SclieduIe.The original engineering fee was based upon a 21-month construction schedule. Following the initial project bid,the construction schedule was increased to 36 months. Although our agreement was amended to cover the engineering costs associated with additional design and bidding efforts,the construction services fees were not increased. It is anticipated that the project will not be finally complete until June 2012. This will result in a 35-month construction schedule,fourteen months longer than originally budgeted. This extension in the construction schedule correlates to the additional effort related to project management and monthly construction.meetings. - Construction Manager Support.CDM Smith has provided greater effort than originally estimated to support the City's Construction Manager(CM). Thus increased effort is due in part to a smaller CM staff than what has been provided for other similar recent plant construction projects. It is also due to the procedures and methods used by the General Contractor in conducting a construction project. CDM SmitKs additional effort has included response to Contractor and CM requests for interim discipline-specific site inspections,direct coordination with manufacturers regarding equipment installation and start-up activities(e.g. Mitsubishi and Pall), and coordination of related project and inspection work(e.g.Public Art, WATER+ENVIRONMENT+TRANSPORTATION+ENERGY+FACILITIES CDM Smith Mr. Chris Harder,P.E. April 6, 2012 Page 2 Security Project, and Fire Marshal review and inspection). Other work activities have been performed due to the Contractors operations,such as additional field testing observation related to incomplete ORT activities, structural review of masonry installations,and response to third-party design reviews(architectural and mechanical). Submittals and Requests for Infonnation. To date,CDM Smith has reviewed 588 shop drawings and O&M manual submittals and 290 requests for information(RFIs). This is significantly greater than the amount originally anticipated when developing the project budget. Additional Engineering Fee Request As of February 29,2012,CDM Smith has used$5,390,561.88 of our contract upper limit of $5,413,954.00. Therefore,a balance of$23,392.12 is remaining to be billed. We project the following additional work required to complete the construction and O&M phases of our contract. 1. Construction Services. It is anticipated that four additional months will be required to finalize construction,March through June 2012. Based on recent activity and projected remaining tasks to be performed,CDM Smith has projected the remaining work to be performed on a monthly basis by CDM Smith personnel. The attached table presents the weekly manhour breakdown and associated costs. The monthly summary of these labor costs are as follows: March 2012 $29,000 April 2012 $32,000 May 2012 $18,000 June 2012 $16,000 Total $95,000 2. O&M Services. As previously discussed,preparation of the O&M manual will be performed through the Construction Manager's contract. In addition,expenses related to both the O&M manual and record drawings will be covered.through the Construction Manager's contract. Therefore,the remaining O&M services to be provided by CDM Smith include preparation of the record drawings,assistance with the O&M manual preparation,and plant startup assistance. The remaining labor costs associated with these tasks are as follows: CDM Smith Mr. Chris Harder,P.E. Subconsultant Work.CDM Smith subconsultants have completed work that has not been invoiced and will perform additional services.related to construction and record drawings. The estimated subconsultant services remaining to be invoiced include the following amounts: Alan Plummer Associates,Inc. $ 10,000 JQ Infrastructure $ 6,000- Gupta&Associates,Inc. $ 17,000 Komatsu Architecture $ 15,000 CPY,Inc. $ 2,000 LTI,Inc. $ 3,000 MasTek Engineering $ 20,000 Total $ 73,000 The total engineering costs associated with the services described above is$228,000. The current-balance remaining in our contract is approximately$23,000. Therefore,we request an amendment to our contract to increase the upper limit by$205,000. As part of this amendment,CDM Smith commits to the following M/WBE participation: Gupta&Associates,Inc. $ 17,000 MasTek Engineering $ 20,000 LTI,Inc. 18,000 Total $ 55,000 CDM Smith Mr.Chris Harder,P.E. April 6,2012 Page 4 This equals approximately 27% of the total amendment amount.Note that a majority of the LTI,Inc.effort has already been invoiced,paid and reported. An adjustment will be made to the M/WBE reports to reflect this. If this amendment request is acceptable to the City we will prepare an amendment to our contract for execution.
